WHEREAS , Edward F . it enberg, 4025 Birch Knoll Drive ,
White Bear Lake , Minneso a, 55110, made application to the
Planning Commission of the Ci y of Saint Paul ior a nonconforming
use permit under the pr vi ions of Section 62. 102(e) ( 11 ) of
the Saint Paul Legislativ ode for the purpose of permitting
a nonconforming three-unit a ' ly dwelling to continue on property
located at 655 Plum Stree , legally described as Lot 16 , Block
58 , Lyman Dayton' s Addition to the City of Saint Paul ; and
WHEREAS , Section 62. 1 2 e) ( 11 ) provides that the Planning
Commission may grant lega onconforming status to uses which
fail to meet the standar s f the Code if following a public
hearing the Commission make t e following findings :
(1 ) The use occurs ent re y within an existing structure ;
(2) The use is sim la to other uses permitted within
the district;
(3) The use is app op iate and is consistent with the
general welfare of the co m ity and the enjoyment of adjacent
pro�erties ;
(4) The use has been in existence for a period of at least
10 years prior to the appli at ' on to the Planning Commission;
( 5) The off-street par i is adequate to serve the use ;
(6) The use is in s bs antial agreement with the Compre-
hensive Plan;
(7) Hardship would s lt if the use were discontinued;
(8) Rezoning the pro e ty would result in "spot zoning"

WHEREAS , the Zoning o ittee of the Planning Commission
on April 20, 1989 held a p bl c hearing at which time all persons
present were given an opp rt nity to be heard pursuant to this
application and the Zonin ommittee adopted a recommendation
that the Planning Commissi n deny the nonconforming use permit
based upon their findings t at the applicant did not provide
sufficient evidence that h structure had been occupied as
a tri-plex for the requi ed 10 year period as specified in
the ordinance and further, ha the proposed use was inappropriate
and inconsistent with th eneral welfare of the community
and the enjoyment of adjace t roperty; and
WHEREAS , the Planning C mmission did consider this matter
on April 28 , 1989 and, b ts Resolution No. 89-30, accepted
the recommendation of the Z ning Committee and denied Edward
F . Wittenberg a nonconfor in use permit for the reasons as
set forth in the minutes o he Zoning Committee and the reso-
lution of the Planning Commi s ' on; and
WHEREAS , Edward F. W' t enberg filed with the City his
appeal from the decision a e by the Planning Commission in
this matter requesting tha hearing be held before the City
Council for the purposes f considering the actions taken by
the said Commission; and
WHEREAS , acting pursua t to Sections 64.205 through 64.208
and upon notice to appellan nd other affected property owners ,
a public hearing was duly onducted by the City Council on
Thursday, June 22 , 1989 whe e all interested parties were given

On April 20, 1989, the Zoning Commit ee of the Planning Commission held a
public hearing on this Nonconforming Us Permit. The petitioner testified. At
the close of the public hearing, the Co ittee voted 7 to 0 to deny the
Nonconforming Use based on the use b in inappropriate and inconsistent with
the general welfare of the community an the enjoyment of adjacent property;
and lack of adequate evidence that t e tructure has been occupied as a triplex
for the required number of years as pe ified in Section 62.102. (e)(11) .
On April 28, 1989, the Planning Comm ss on upheld the Zoning Committee's
recommendation on a unanimous voice ot .
This appeal is scheduled to be heard by the City Council on June 22, 1989.

WHEREAS, Edward Wittenberg� file #1 44 , has applied for a Nonconforming Use Permit
under the provisions of Section 62. 02 (e)(11) of the Saint Paul Legislative Code,

WHEREAS, Saint Paul Planning Commis io , based on the evidence presented to its
Zoning Committee at the public hear ng as substantially reflected in the minutes,
made the following findings of fact
1. The triplex use of the property oc rs entirely within an existing structure;
2. The use of the property is resi en al, and is therefore generally consistent
with other uses permitted in th d trict.
3. The use is inappropriate and in on stent with the general welfare of the
community and the enjoyment of dj ent property; and

Edward Wittenberg (#10449) : A Nonc nf rming Use Permit for property located
at 655 Plum Street to allow continu d -plex occupancy of an existing
residential structure.
� The applicant was present; there wa n opposition present.
Mr. McGuire showed slides of the si e nd reviewed the staff report with a
recommendation for denial. He stat d at pictures of the site, enclosed with
' one letter in opposition, were avai ab e to the Committee. Mr. McGuire said
that there has been no formal co ic tion from District 4.
Edward F. Wittenberg, 4025 Birch Kn 11 Drive, White Bear Lake� testified that
� he purchased the building as a trip ex approximately 12 years ago. He
' outlined income and expenses relati e o 655 Plum Street and said that if the
' application is approved he could pr vi e the two needed parking spaces near
the garage.
Ms. Zieman inquired about construct on in September, 1988. Mr. Wittenberg
replied that it was a bid covering on ersion of the building to a duplex.
Mr. Repke asked if the applicant ha r ntal receipts or other evidence of the
building having been occupied as a ri lex. Mr. Wittenberg replied that he
purchased the building as a 3-plex ro Real Estate Dynamics and could try to
locate rental receipts.
Ms. Hirte asked about the bids subm tt d with the applicant's materials. Mr.
Wittenberg responded that those bi w re. costs which would be incurred if the
building was reconfigured to a dupl x.
I�ir. Neid asked the applicant if he d other rental property in Saint Paul,
and if so, how many. Mr. Wittenber r sponded affirmatively, approximately
45.
Mr. Christenson asked if the applic t had rent records or financing
information for the 12 years for vh ch he has owned the property� and also
asked if the applicant checked with th city on the legal status of the
triplex. Mr. Wittenberg replied th t e was not positive if he could locate
rent receipts, explained the financ ng and said that he did not check with
the city. Mr. Christenson and the pp icant discussed property tax statements
and improvements made to the proper y uring his ownership.

Mr. Neid asked how long rent rece ts are kept. Mr. Wittenberg said that he
was not sure, would have to check i records, and did not realize that he
should have kept the receipts lon er han three or four years.
Ms. Hirte stated that Councilmemb r imond transmitted information as of this
date that District Council 4 vote nimously in opposition.
There being no further testimony, Ms. Morton closed the public portion of the
hearing.
Mr. Christenson moved to recommen 1 over to allow the applicant to obtain
evidence regarding the building h vi g been occupied as a triplex for over ten
years. 1+Ir. Neid seconded the mot on hich failed on a voice vote of 1-6
(Zieman, Repke� Tracy, Hirte, Nei , orton).
Mr. Christenson moved to recommen d nial of the Nonconforming Use Permit
based on the use being inappropri te and inconsistent with the general welfare
of the community and the enjoymen o ad3acent property; and lack of
sufficient evidence that the stru tu e has been occupied as a triplex for the

A. PURPOSE: To consider a request to pe it the continued occupancy of the
structure at 655 Plum Street as a ri lex.
B. PARCEL SIZE: The property has 40 ee of frontage on Plum Street and a depth of
151.4 feet. The area of the parce i 6056 square feet.
C. EXISTING LAND USE: The parcel is ur ently occupied by a structure that appears
to have been built for duplex occu an y. The land use maps indicate duplex use
for this property. Tax records in ic te that the property has been taxed as a
single family residential use.
D. SUR.ROUNDING LAND USE:
North: Land to the north is occup"e by the I-94 freeway
East: A duplex and a single fami y ome occupy sites to the east.
South: To the southeast and sout , t e land is occupied by mixed density
housing, however single f il and duplex uses are the most common.
West: Vacant property held by M OT, and Mounds Boulevard parkway lands.
E. ZONING CODE CITATION: Section 62. 02 (e)(11) Exception. states that "The
Planning Commission may grant lega n nconforming status to uses or structures
which fail to meet the standards o t is section if, following a public hearing,
the Planning Commission makes the ol owing findings: (1) the use occurs
entirely within an existing struct re (2) the use is similar to other uses
pe.rmitted within the district; (3) th use is appropriate and is consistent with
the general welfare of the communi y nd the enjoyment of adjacent property; (4)
the use has been in existence for p riod of at least ten (10) years prior to
the application to the Planning Co i sion; (5) the off-street parking is
adequate to serve the use; (6) the us is in substantial agreement with the
comprehensive plan; (7) hardship w ul result if the use were discontinued;

(8) rezoning the property would re ul in "spot zoning" or a zoning
inappropriate to the surrounding 1 nd uses; and (9) that a notarized petition of
two-thirds of the property owners it in one hundred (100) feet of the property
has been obtained stating support f he use.
The applicant shall present the pe it on, evidence of a ten-year period of
existence, and evidence that conve si n of the use and structure would result in
hardship. The applicant shall pro id floor plans and other information as
required to substantiate his case.
F. FINDINGS:
1. The triplex use of the propert o curs entirely within an existing
structure, and therefor the fi st ondition is met.
2. The use of the property is res de tial, and is therefore generally
consistent with other uses pe it d in the district. The second condition
appears to be met.
3. The use appears to be " . . .appr pr te and is consistent with the general
welfare of the community and t e �oyment of adjacent property," meeting
the third condition.
4. The petitioner reports that a ex door neighbor states the property has
been used as a triplex " . . .as on as she can remember and she moved in next
door in May of 1954." The fou th ondition appears to be met.
5. To use of the structure as a t ip x, four off-street parking spaces should
be provided. A two-car garage is ituated at the rear of the site.
Although no other off-street s ac are paved and identified for parking,
there is ample room on the sit t provide the additional spaces. The fifth
condition could be met.
6. Since the use as a triplex is es' ential, it is generally consistent with
the comprehensive plan for thi a a of the city.
7. The owner states that a signif' a financial hardship will result of the
property is returned to a dupl cupancy.
8. Rezoning the property would cl rl result in a "spot zoning" and does not
appear to be in the best inter ts of all concerned,
9. The property owner has submitt a signed consent petition containing the
required number of signatures.
G. STAFF RECOMMENDATION;. Although th d minant land use pattern for the area is
single- and two-famil;y. housing, th re are a number of triplexes and fourplexes
in the general vicinity. There is a ix unit multi-family building at the
corner of Plum and Mounds Boulevar , eighbors indicate that significant
exterior improvements, have been ma e the building since it was purchased by
the present owner. Since the cond ti s specified in the ordinance are either
met, or could be met, the staff re o nds approval, sub�ect to the condition
that off-street parking for two ad it' nal vehicles be provided on the site in a
designated and properly developed ar ing area.
