1 WI�REAS, Citizen Service Office, Division of Code Enforcement has requested the City

WHEREAS, based upon the records in the Raznsey County Recorder's Office and information
obtained by Division of Code Enforcement on or before February 8, 1999, the following are the now
known interested or responsible parties for the Subject Property: State of MN Trust Exempt,
50 Kellogg Blvd. W. Ste 620B, St. Paul, MN 55102; James A. & Lora Etta Logan, Sr., 1331 Dayton

WHEREAS, Division of Code Enforcement has served in accoxdance with the provisions of

requested that the Ciry Clerk schedule public hearings before the Legislative Hearing Officer of the City
Council and the Saint Paul City Council; and
WIIEREAS, the interested and responsible parties have been served notice in accardance with
the provisions of Chapter 45 of the Saint Pau1 Legislative Code, of the time, date, place and purpose of

WHEI2EAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, November 2, 1999 to hear testimony and evidence, and after receiving testimony
and evidence, made the recommendation to approve the request to order the in#erested or responsible
parties to make the Subject Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating this structure in
accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing
the stzucture in accordance with all applicable codes and ordinances. The zehabilitation or demoliUon of
the structuce to be completed withiu fifteen (15) days after the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, November
10, 1999 and the testimony and evidence including the acUon taken by the Legislative Hearing Officer
was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order
concerning the Subject Property at 790 Selby Avenue:
That the Snbject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chaptex 45.

That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dollazs ($3,000.00).
That there now exists and has existed multiple Housing or Building code violations at the
Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then Irnown responsible
parties to conect the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been corrected.
That Division of Code Bnforcement has posted a placard on the Subject Property which
declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Offices, Division
of Code Enforcement, Vacant/Nuisance Buildings.
8. That the lmown interested parties and owners are as previously stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The abave referenced interested or responsible parties shall make the Subject Pxoperty safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting influence
on the coxnmunity by rehabilitating tlus structure and correcting all deficiencies as prescribed in
the above refexenced Order to Abate Nuisance Building(s) in accoxdance with all applicable
codes and ordinances, or in the alternative by demolishing and removing the structure in

1 2. If the above conecrive action is not completed within this period of time the Citizen Service

4 Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.

3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal
properry ar fixtares of any kind which interfere with the demolition and removal shall be
removed from the property by the responsible parties by the end of this time period. If all
personal property is not removed, it shall be considered to be abandoned and the City of Saint
Paul shall remove and dispose of such property as provided by law.
4. It is fiirther ordered, that a copy of this resolution be mailed to the owners and interested parties
in accordance with Chapter 45 of the Saint Paul Legislative Code.

The meeting was called to order at 10:06 am.
STAFF PRESENT: Steve Magner, Code Enforcement; Guy Willits, Code Enforcement
Summary Abatement Order for 838 Blair Avenne; David R Jones.
David Jones, owner, appeazed and staxed he has a utility trailer parked behind his shed. 'There
was a ticket on it the other day, and he called the City Clerk's Office to fuid out why. He was
told the trailer is on an unapproved pazking surface. However, the trailer has been there over 30
years, is well off the alley, and out of the way. Mr. Jones has the neighbor's permission to have
it hang over their properry line. He was informed the intent of the City ordinance was to get junk
cazs out of people's yazd. Mr. Jones feels t'aey aze too broadly interpreting the meaning of the
ordinance. He keeps the trailer in good repair, the wheels are securely blocked, and he keeps the
weeds mowed. It is not a hazard to anyone.

Gerry Strathman stated inspectors usuall,r�rer�zsponding to a compiaint. He asked how this
issue came about. Guy Willits responded this was red tagged by the police department. The
inspector felt obligated to have the trailer removed. There was no complaint received from the
neighbors on this issue.
Gerry Strathman granted the appeal with respect to this particular order. If there are complaints
in the future about the trailer and it is tagged again, something may have to be done.

Steve Magner reported this properCy was laid over by request of Chris Kujala from the Ramsey
County Tas Forfeited Land Department who said this property was going to be sold at auction.
Two weeks prior to the auction, Joy Agbara brought her con�act current and paid her back ta�ces.
Mr. Magner had two conversations with Ms. Agbara and informed her she needed to post a bond.
No work has been done to the property. No bond has been posted nor permits pulled.

Mr. Magner reported this property was condemned April 1990 and has been vacant since June
1984. The current owners aze James and Lora Logan. Fourteen sLmunazy abatement orders have
been issued to clean the yazd, cut grass, remove snow/ice from sidewalks. Vacant building fees
and real estate t�es aze paid. Taxation has placed an estimated mazket value of $40,000 on the
building. The owner has been working on this buildinQ ��r.t��dically. The last inspection was
October 18, and the owner said at that time he was planning to have everyfl�ing signed off and
planning to attend today's mee6ng. Mr. Magner is surprised he is not here. There are a number
of deficiencies on the interior, and the owner is not close to fuushing the properry.
Mr. Strathman stated from the photographs, the properry looks like it has new siding and stairs,
but the interior shows signs of deterioration. Mr. Magner stated a bond has been posted and
forfeited. The owner would need to post a new bond and work with the building department to
get his permits. The owner told Mr. Magner he is retired �nd will concentrate on these buildings
(790 Selby and 872 Selby, which will be discussed late:.)
Mr. Strathman stated the paperwark shows that the State of Minnesota-Tax Exempt is also the
owner. Mr. Magner responded the owner tends to get behin� with taxes, the building reverts to
the State of Minnesota, and then the owner gets caught up.

Mr. Magner reported the properiy was condemned 7uly 1988 by Code Enforcement and has been
vacant since October 1989. The current properiy owners aze State of Minnesota-Trust Exempt
and James and Lora Logan. Twelve summary abatement notices have been issued to remove
refiue, secure the building, and cut grass. The vacant building fees have been paid. Real estate
taxes aze unpaid in the amount of $1506.39. Tasatiott has placed an estimated mazket value of
$32,400 on the properiy. As of today, a bond has not been posted. Code Enforcement estimated
the repair cost to be appro�dmately $20,000.
Gerry Strathman recommended approval.
805 Agate Street (continued from earlier in the meeting)
7eremy Monroe, representing Joy Agbara, arrived and stated Ms. Agbaza lrnows the property is in
bad shape. She is not a wealthy person, has five children, and has been working hard to obtain
fmancing to do repairs. She has a bid for repairs in the neighborh�od of $13,000. Ms. Agbara
has been requested to post a$2,000 bond to secure the work to be done and is raising the money
to do that. She does not have a commitrnent from a bank.
Mr. Strathman asked is the 4-15-98 code complianee inspection still va&d. Mr. Magner
responded that wauld have to be discussed with Don Wagner (of the Office of License,
Inspections, Environmental Protection). There is generally a sunset period of one year.
Gerry Strathman recommended giving the owner six months to complete rehabilitation on
condirion that the owner do the following by noon of November 10, 1999: post a$2,000 bond
and have the current code compliance inspection determined to be valid or a new code
compliance inspection completed. If the owner has not done these things, then Mr. Stratlunan
will recommend approval of the resolution.

The meeting was called to order at 10:06 am.
STAFF PRESENT: Steve Magner, Code Enforcement; Guy Willits, Code Enforcement
Summary Abatement Order for 838 Blair Avenne; David R Jones.
David Jones, owner, appeazed and staxed he has a utility trailer parked behind his shed. 'There
was a ticket on it the other day, and he called the City Clerk's Office to fuid out why. He was
told the trailer is on an unapproved pazking surface. However, the trailer has been there over 30
years, is well off the alley, and out of the way. Mr. Jones has the neighbor's permission to have
it hang over their properry line. He was informed the intent of the City ordinance was to get junk
cazs out of people's yazd. Mr. Jones feels t'aey aze too broadly interpreting the meaning of the
ordinance. He keeps the trailer in good repair, the wheels are securely blocked, and he keeps the
weeds mowed. It is not a hazard to anyone.

Gerry Strathman stated inspectors usuall,r�rer�zsponding to a compiaint. He asked how this
issue came about. Guy Willits responded this was red tagged by the police department. The
inspector felt obligated to have the trailer removed. There was no complaint received from the
neighbors on this issue.
Gerry Strathman granted the appeal with respect to this particular order. If there are complaints
in the future about the trailer and it is tagged again, something may have to be done.

Steve Magner reported this properCy was laid over by request of Chris Kujala from the Ramsey
County Tas Forfeited Land Department who said this property was going to be sold at auction.
Two weeks prior to the auction, Joy Agbara brought her con�act current and paid her back ta�ces.
Mr. Magner had two conversations with Ms. Agbara and informed her she needed to post a bond.
No work has been done to the property. No bond has been posted nor permits pulled.

Mr. Magner reported this property was condemned April 1990 and has been vacant since June
1984. The current owners aze James and Lora Logan. Fourteen sLmunazy abatement orders have
been issued to clean the yazd, cut grass, remove snow/ice from sidewalks. Vacant building fees
and real estate t�es aze paid. Taxation has placed an estimated mazket value of $40,000 on the
building. The owner has been working on this buildinQ ��r.t��dically. The last inspection was
October 18, and the owner said at that time he was planning to have everyfl�ing signed off and
planning to attend today's mee6ng. Mr. Magner is surprised he is not here. There are a number
of deficiencies on the interior, and the owner is not close to fuushing the properry.
Mr. Strathman stated from the photographs, the properry looks like it has new siding and stairs,
but the interior shows signs of deterioration. Mr. Magner stated a bond has been posted and
forfeited. The owner would need to post a new bond and work with the building department to
get his permits. The owner told Mr. Magner he is retired �nd will concentrate on these buildings
(790 Selby and 872 Selby, which will be discussed late:.)
Mr. Strathman stated the paperwark shows that the State of Minnesota-Tax Exempt is also the
owner. Mr. Magner responded the owner tends to get behin� with taxes, the building reverts to
the State of Minnesota, and then the owner gets caught up.

Mr. Magner reported the properiy was condemned 7uly 1988 by Code Enforcement and has been
vacant since October 1989. The current properiy owners aze State of Minnesota-Trust Exempt
and James and Lora Logan. Twelve summary abatement notices have been issued to remove
refiue, secure the building, and cut grass. The vacant building fees have been paid. Real estate
taxes aze unpaid in the amount of $1506.39. Tasatiott has placed an estimated mazket value of
$32,400 on the properiy. As of today, a bond has not been posted. Code Enforcement estimated
the repair cost to be appro�dmately $20,000.
Gerry Strathman recommended approval.

7eremy Monroe, representing Joy Agbara, arrived and stated Ms. Agbaza lrnows the property is in
bad shape. She is not a wealthy person, has five children, and has been working hard to obtain
fmancing to do repairs. She has a bid for repairs in the neighborh�od of $13,000. Ms. Agbara
has been requested to post a$2,000 bond to secure the work to be done and is raising the money
to do that. She does not have a commitrnent from a bank.
Mr. Strathman asked is the 4-15-98 code complianee inspection still va&d. Mr. Magner
responded that wauld have to be discussed with Don Wagner (of the Office of License,
Inspections, Environmental Protection). There is generally a sunset period of one year.
Gerry Strathman recommended giving the owner six months to complete rehabilitation on
condirion that the owner do the following by noon of November 10, 1999: post a$2,000 bond
and have the current code compliance inspection determined to be valid or a new code
compliance inspection completed. If the owner has not done these things, then Mr. Stratlunan

Division of Code Enforcement has deciared this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Division of Code Enforcement has issued an order to the then
known responsible parties to eliminate this nuisance condition by conectin� the deficiencies or
by razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division of Code Enforcement that the City Council pass a resolution
ordering the responsible parties to either repair, or demolish and remove this building in a timely
manner, and failing that, authorize the Division of Code Enforcement to proceed to demolition
and removal, and to assess the costs incurred against the real estate as a special assessment to be
coliected in the same manner as tases.

The meeting was called to order at 10:06 am.

Summary Abatement Order for 838 Blair Avenne; David R Jones.
David Jones, owner, appeazed and staxed he has a utility trailer parked behind his shed. 'There
was a ticket on it the other day, and he called the City Clerk's Office to fuid out why. He was
told the trailer is on an unapproved pazking surface. However, the trailer has been there over 30
years, is well off the alley, and out of the way. Mr. Jones has the neighbor's permission to have
it hang over their properry line. He was informed the intent of the City ordinance was to get junk
cazs out of people's yazd. Mr. Jones feels t'aey aze too broadly interpreting the meaning of the
ordinance. He keeps the trailer in good repair, the wheels are securely blocked, and he keeps the
weeds mowed. It is not a hazard to anyone.

Gerry Strathman stated inspectors usuall,r�rer�zsponding to a compiaint. He asked how this
issue came about. Guy Willits responded this was red tagged by the police department. The
inspector felt obligated to have the trailer removed. There was no complaint received from the
neighbors on this issue.
Gerry Strathman granted the appeal with respect to this particular order. If there are complaints
in the future about the trailer and it is tagged again, something may have to be done.

Steve Magner reported this properCy was laid over by request of Chris Kujala from the Ramsey
County Tas Forfeited Land Department who said this property was going to be sold at auction.
Two weeks prior to the auction, Joy Agbara brought her con�act current and paid her back ta�ces.
Mr. Magner had two conversations with Ms. Agbara and informed her she needed to post a bond.
No work has been done to the property. No bond has been posted nor permits pulled.

Mr. Magner reported this property was condemned April 1990 and has been vacant since June
1984. The current owners aze James and Lora Logan. Fourteen sLmunazy abatement orders have
been issued to clean the yazd, cut grass, remove snow/ice from sidewalks. Vacant building fees
and real estate t�es aze paid. Taxation has placed an estimated mazket value of $40,000 on the
building. The owner has been working on this buildinQ ��r.t��dically. The last inspection was
October 18, and the owner said at that time he was planning to have everyfl�ing signed off and
planning to attend today's mee6ng. Mr. Magner is surprised he is not here. There are a number
of deficiencies on the interior, and the owner is not close to fuushing the properry.
Mr. Strathman stated from the photographs, the properry looks like it has new siding and stairs,
but the interior shows signs of deterioration. Mr. Magner stated a bond has been posted and
forfeited. The owner would need to post a new bond and work with the building department to
get his permits. The owner told Mr. Magner he is retired �nd will concentrate on these buildings
(790 Selby and 872 Selby, which will be discussed late:.)
Mr. Strathman stated the paperwark shows that the State of Minnesota-Tax Exempt is also the
owner. Mr. Magner responded the owner tends to get behin� with taxes, the building reverts to
the State of Minnesota, and then the owner gets caught up.

Mr. Magner reported the properiy was condemned 7uly 1988 by Code Enforcement and has been
vacant since October 1989. The current properiy owners aze State of Minnesota-Trust Exempt
and James and Lora Logan. Twelve summary abatement notices have been issued to remove
refiue, secure the building, and cut grass. The vacant building fees have been paid. Real estate
taxes aze unpaid in the amount of $1506.39. Tasatiott has placed an estimated mazket value of
$32,400 on the properiy. As of today, a bond has not been posted. Code Enforcement estimated
the repair cost to be appro�dmately $20,000.

805 Agate Street (continued from earlier in the meeting)
7eremy Monroe, representing Joy Agbara, arrived and stated Ms. Agbaza lrnows the property is in
bad shape. She is not a wealthy person, has five children, and has been working hard to obtain
fmancing to do repairs. She has a bid for repairs in the neighborh�od of $13,000. Ms. Agbara
has been requested to post a$2,000 bond to secure the work to be done and is raising the money
to do that. She does not have a commitrnent from a bank.
Mr. Strathman asked is the 4-15-98 code complianee inspection still va&d. Mr. Magner
responded that wauld have to be discussed with Don Wagner (of the Office of License,
Inspections, Environmental Protection). There is generally a sunset period of one year.
Gerry Strathman recommended giving the owner six months to complete rehabilitation on
