stating the E3oard does not ha� e a quorum for this meeting. Let
the records show that Bill Tilt n called Paui McCloskey, the
Boards Legal Advisor , for an p nion regarding having no quorum.
The preferable method would b , to act as a Committee of the
Board, to render advisory opi i ns, let the people know that any
opinion that is expressed tod y is likely to be ratiFied by the
Board at the next meetir�g in u e. If any one is aggrieved by the
decision of the board today. h y would have the right to return
to the next meeting an plead i /her case the second time.
Chairman Glassman informed th oard that the Rainleader Disconnect
Ordinance Sec. 41 . 03 of the 5 i t Paul Legislative Code was
amended and approved by the C t Council to include the appeals
process , therefore, the Board iil be hearing Rainleader
Disconnect cases.

a variance on padlocks , instead gave the Appellant an extension .
of time until September i , 1989 to install approved locks on the
doors. Second by Ronaid Ankeny. MOTION CARRRIED UNANIMOUSLY.

PROCEEUINGS: Mr . Buckie�i t=eeis that the furnaces are t=unctional .
He had an estimate to have two nPw ones put in and the cost was
$5400 . 00 not includina piping anci chimney wr�ich would make the
cost considerably higher.
Dick Lippert, from Public Health stated that he had discussed
this with Mr. Votel before the meeting and Mr. Votel stated that
even though the_y could be repaired. the furnaces probably would
not meet the Minnesota State Energy Code. Mr. Votel wouid be
willing to accept adequate repair of the two furnaces, keeping
in mind, that they probably can't be repaired to the quality that
they need to be. The prudent thing to do would probabiy replace
the two boiiers. Mr. Lippert stated that at this time there would
be no problem on giving Mr. Buckley time until the new heating
season to do the necessary repairs.
Biil Tilton asked Mr. Lippert what was wrong with the furnaces?
Mr. Lippert stated that when Mr. Votel , the inspector was in the
building there were flames blowing out of the charge doors,
like a blast furnace. Mr. Votel feels, its not just minor repairs,
he feels the furnace is near being shot. Extremely hazardous.

PR��CEEDIN�S: Mr . Buckiev teeis that t.he furnaces are runctional .
He had an estimate to have two new ones put in and the cost was
$5400. 00 not including piping and chimney wr�ich would make the
cost considerably higher.
Dick Lippert, from Public Health stated that he had discussed
this with Mr. Votel before the meeting and Mr. Votel stated that
even though they could be repaired, the furnaces probably wo�ld
not meet the Minnesota State Energy Code. Mr. Votel wouid be
wiiling to accept adequate repai � of the two furnaces, keeping
in mind, that they probably can't be repaired to the quality that
they need to be. The prudent thing to do would probabiy replace
the two boilers. Mr. Lippert stated that at this time there would
be no problem on giving Mr. Buckley time until the new heating
season to do the necessary repairs.
Bill Tilton asked Mr. Lippert what was wrong with the furnaces?
Mr. Lippert stated that when Mr. Votel , the inspector was in the
building there were flames blowing out of the charge doors ,
like a blast furnace. Mr. Votel feels, its not just minor repairs.
he feels the furnace is near being shot. Extremely hazardous.
