That vehicles fumished to the City by the Supplier hereunder shall be for the exclusive use of the City's Police Department and no other persons shall make use of such vehicles. 3. That the Supplier will have available during regular business hours for the City's use, vehicles of a make and model as may be agreed to by the parties. 4. That in consideration of the use of SuYpiier's vehicle (s) the City agrees to pay Supplier the sum $175 per day, per vekicle, to maximum of $1400 per month per vehicle. aa-�oq� 5. That the City agrees to save and hold Supplier harmless from any and all claims arising out of the City's use of vehicles hereunder and shall, additionally, repair at its own expense and to the manufacturers specifications any damage sustained by the vehicles during the course of City's use, normal wear and tear excluded, and that in no event shall the liability of the City exceed the limits set forth in MN Statute Chapter 466.00. 6. That the City shall be responsible for supplying each vehicle rented hereunder with such amounts of gasoline and oil as is needed to ma:�e the vehicle operational, but no other maintenance obligations shall be the responsibility of the City. That the City will not use any vehicle for a period of more than one year (365 days) without Supplier's consent, but the City reserves the right to request and receive from Supplier a replacement vehicle of a type and make as above- described at any time; time being of the essence in fulfilling requests for replacement vehicles. 8. That the City acknowledges the righ*. o: *he Supplier to demand the return of the vehicle rented hereunder upon twenty-four (24) hours' notice to the City and upon such notice, the City will return said automobile. u9- ioR� 9.
