WHEREAS , the Council of he City of Saint Paul by Council
Resolution C .F. 89-389 on Mar h , lgs9 did authorize the proper
City officials to condemn pe manent utility easements and
temporary construction easeme ts for the SYLVAN/ACKER COMBINED
SEWER SEPARATION PROJECT on, nd r, and across properties as
shown on the map on file with th Department of B'inance and
Management Services , Division of Real Estate, Room 218 City Hall ,
and as shown on the attached ap ;
WHEREAS , the Council of he City of Saint P�.ul will hold a
final hearing on Tuesday, Jun 1 , lg8g for the purpose of
ratifying and confirming the ak ' ng of said easements and for
making an award of damages fo t e taking of the�e easements
including an award of damages in the amount of $47 , 950•00 to
Lawrence H. Smith;
WHEREAS , as a matter of ub ic necessity, construction of
the storm sewer should be com e ced immediately to avoid delaying
the separation of the storm a w rs from the sanitary sewers , such
separation being mandated by h State of Minneaota;
WHEREAS , in order to pro e d with construction immediately,
it is necessary for the City o have title to the above described
easement interest ;
NOW THEREFORE BE IT RESO V D , that the Council of the City of
Saint Paul by this resolution h reby authorizes the proper City
officials to deposit with the C erk of District Court the amount
of $47� 950• 00 which represent he award granted to the above
named property owner, as a re u t of the condemnation referred to
in Council Resolution C .F. 89 3 9;
BE IT FURTHER RESOLVED, h t upon deposit o'f said amount
into District Court and upon a sage of title as directed by the
court , the proper City offici 1 are hereby dire'cted to commence
