Office of the City Attorney 647 City Hall St. Paul, MN 55102 Re: Fitti' s Bar D�ar Mr. Byrne: as we have already greed, a hearing before an administrative law judge on h subject of gambling allegations at Fitti's Bar has been waiv d. In addition, my client, Richard Fitzgerald, has agreed not t c ntest the police report facts but does wish to refute some o the conclusio�s drawn by the reporting officer and to pro id an explanation.; �,fter reviewing the off ce s report with M�. Fitzgerald, the following is his explanatio i the same chronology as set forth in the police report. The four sports tip-b ar tickets and t�e $10.00 in cash found in a drawer in the b k bar were the pe�'sonal property of the owner Richard Paul Fi zg rald. The $10. 00 represented a repayment of a loan previ u ly made to a customer which had subsequently made the repa e t to a bartender. The four sports tip-board tickets and the a ditional five single tickets all containing the same Serial er 2276L were purchased privately and individually by Mr. F t erald for nine consecutive Twins games. The 11 pieces of pa r which were dated and noted "cigs 100" or "cigs 200" found i the cash register in fact were notations regarding the pu c ase of cigarett�s out of till cash by Mr. Fitzgerald. He pu ch ses the cigarettes sold at the bar from a Wholesale Club wit ash taken from the till. Although the officer suggests that he did not see a volume of cigarettes in the bar, he appare tl did not mak� a very thorough inspection. Mr. Fitzgera d states that at all times he has an average inventory of app x mately 40 carto�s of cigarettes in stock. � . , � , F�� V- � Phi.11ip B. Mr. Fitzgerald purchased this ba i January, 1989 and these boards which were totally in tact wi h o missing tickets, were there at the time of his purchase. He d nies having evex sold tickets of this type during the operatio o the bar. The $30. 00 in cash an e check made out to cash for $240. 00 both represent repaym nt of customer lo�ns. The $240. 00 �heck was the result of a p e ious loan of $250.00 made to a friend-customer who had previ u ly repaid $10.00. The check had remained uncashed because the f iend-customer had requested that Mr. Fitzgerald hold it for a f days before p�esentment to the bank. The other five tip- oa d tickets have! previously been explained as having been per n lly purchased by Mr. Fitzgerald. They bear the same serial n b r as the ones found in the back bar drawer. ' Mr. Fitzgerald has no no ledge or information concerning the mirror and razor blade w ich allegedly contained cocaine residue. These two items w r discovered in Mr. Fitzgerald' s presence and apparently were o ated on top of a foundation wall behind a recently construc ed office wall. The office in question had been under cons r ction for several weeks and had been completed only three d ys prior to the xecution of the search warrant. Up to that p i , anyone and ev�ryone had access to the office area. Mr. Fi z rald' s only explanation is that the mirror and razor blade co 1 well have been there at the time he purchased the bar or may h v been put there by anyone without his knowledge prior to its iscovery. Thi� was the first knowledge he had of its exis e ce. The so-called bindle papers discovered were in a large t as box measuring approximately 2'x 3'x 18" in depth, which was pp oximately three�quarters full of debris, including building m te ial scraps. Ag�in, some of this material had accumulated ri r to his ownership and some obviously during the construc i of the office. He had no prior knowledge of the paper's exi te ce. He had hired four gentlemen to construct the office and th y did so over � period of some five or six weeks. As previously indicated fact which is substantiated by the record, Mr. Fitzgerald p r ased this bar in January, 1989. It had previously been known s the "Quick Stop" . The bar had a dubious reputation in the pas nd its clientele had a lot to be desired. Since his purchas , Mr. Fitzgerald has made a very active and intense effort t hange the character of the bar. Previous to his ownership, t apparently had a notorious reputation with the law enf rc ment community. Mr. Fitzgerald has been quite successful to a e in changing that reputation and . . , �� � Phillip B. Byrne, Esq. It stands to reason, h wever, that one cannot make an absolute change of the b ' clientele and its operation overnight without financial r in. It is Mr. Fitzgerald' s intention to maintain his ef or toward the goal of operating a bar free from complaint or vi 1 ion. In the a e of licenses for intoxicating and non=intoxicating liquor , a t ority is also conveyed by section 340JA.415 of the Minnesota ta utes. During the wezk of March 6, 1989, payoffs were being made on video poker machines i t e licensed premises. A search warrant was executed on A ril 4 , 1989 , and led to the discovery of evidence f ideo poker payoffs , sports gambling , possession o ambling paraphernalia , and possession of illegal narc t 'cs . The foregoing violates se t on 409.08 (6) of ' the Saint Paul Legislative Code relat n to gambling on a licensed premise, including the ke pi g and possession of dice. The foregoing constitute evide c as well of ba�es for adverse action under sections 1 . �16 (6 ) and 3141. �6 (9 ) of the Legislative Code. You may also have a p rson of your choice represent you, to the extent not prohib ' te as unauthorizled practice of law. A search warrant was executed n April 4 , 1989, and led to the discovery of evidence o video poker �ayoffs, sports gambling , possession o gambling paraphernalia , and possession of illegal na c tics . The foregoing violates ' e tion 409.08 (6) of the Saint Paul Legislative Code rel ti g to gambling on a licensed premise, including the ee ing and possession of dice. The foregoing constitute evi e ce as well of bases for adverse action under section 10. P16 (6 ) and 3�,10. 4l6 (9 ) of the Legislative Code.
