Zoning Committee at the public he ri g as substantially reflected in the minutes,
' made the following findings of fa t:
That three groups have reviewed a d ommented on this de elopers proposed reuse of
the combined site. Letters recei ed by the zoning commi tee from the District Six
Planning Council, the Como Park C ity Council (Distr ct Ten), and the Senate
District 66 DFL Club recommend de ia of the proposed re oning and redevelopment.
The organizations cite traffic co ge tion, possible 24-h ur-a-day businesses, and
that ". . .the proposed use of the an would not provide uch needed services or a
dramatic increase in employment o po tunities." Based o this information, the -
commenting groups do not feel tha t e proposed rezoning is an ". . .equitable
exchange of zoning districts. . ." Th Saint Paul Public chools have also
recommended denial.
The developer's stated objective s create a neighbor ood convenience center

Mr. McGuire showed slides of the sit a d reviewed the sta f report with a
recommendation for denial.
John Daubney� 700 Amhoist Tower, att rn y representing the applicants,
described the Maryland/Dale commerci 1 ntersection and sa d that the
applicants would be willing to have he r entire parcel re oned for B-2 usage.
He stated that the applicants need a la ger area for their proposed
development, that their use would be co sistent with the e isting commercial
corners and its usage would not adve se y impact the immed ate residents or
area traffic.
Mr. Daubney introduced Tom Raymond, 80 Dunkirk Lane, P1 outh, Minnesota.
. Mr. Raymond stated that most conveni nc stores are open 2 hours a day and
other stores in the development woul p obably be open unt 1 10 or 11 o'clock
in the evening.
Mr. Christenson requested informatio o the rezoning peti ion signators.
Mr. Daubney said that particular ref re ce would be to own rs of lots four and
five, Richie`s Addition, on Maryland r. Christenson sta ed that signatures
from owners of those two lots appear to be missing. Mr. ywond said that he
does not know the name of the reside t f lot five; that t e Mitchells are the
resident/owners of lot four.
-Vern Henning, 3240 Owasso Heights Ro d, Shoreview, said th t he owns the
vacant Video Shop and previously res de in the area. He tated that he
declined two offers for the sale of is property because o the potential
negative impact of their proposed de el pments on the neig borhood.
Don Mitchell, 634 West Maryland, cla if ed that they did n t sign the rezoning
petition. He said that when they re us d to sign the peti ion, Mr. Raymond
offered to buy their property. Mr. it hell referred to t e ongoing
commercial expansion of the area an sa d that, if he cont nues to reside in
the area, another type of business ul be more acceptabl to him than a
24-hour-a-day convenience store.

Ms. Zieman asked if the Mitchell es dence Would be sol to the developers.
Mr. Mitchell said yes and added a they own two 40 fo t lots, one on which
the garage is located, zoned B-3� a one on which thei house is located.
Terry Schmidt, 1187 North Dale S e t� spoke to the ben fits of having a
convenience store located in the ar a, said that there as much noise due to
the proximity of the railroad tr c as well as traffic on Maryland and Dale,
cited problems created by snowpl wi g� and commented on the commercial growth
of the neighborhood.
Mr. Levy asked how the shops wou d ssist neighboring sidents. Mr. Schmidt
referred to the elderly resident i the vicinity and eir need for nearby
stores accessible to pedestrian ra fic.
Ms. Zieman asked Mr. Daubney abo t he number of parce s the developers plan
to purchase from individual home wn rs. Mr. Daubney r sponded that it is
property owned by the Schmidts, ul ivans and Mitchell .
Robert Sullivan, 1177 North Dale St eet, said that he as a signed purchase
agreement with the developers a c nfir�ed his agreem nt with Mr. Schmidt's
•remarks.
Terry Richards, 1173 North Dale t et, testified that he was representing his
�mother in opposition to the dev lo ent� said that tra fic is only heavy
during rush hours, that present y e neighborhood is relaxing place in
which to live, and cited ob3ect on to the development due to potential
. litter, loitering and increased tr ffic.
Thomas Sirian, 656 West Marylan � tated that a 24-ho -a-day convenience
' store is not compatible with th n ighborhood and sch 1 grounds, and that the
increased traffic associated wi h convenience store ill adversely affect
the area.
Mr. Daubney addressed comments o eighbors' objectio .
Mr. Christenson asked about the de eloper's plans reg rding property to be
acquired. Mr. Raymond replied ' ha purchase agreemen s are contingent on
rezoning, that the developers ul assuae the owners financial risk, and
eventually the property would rketed/sold, not r nted. He said that
presently there are purchase c t cts, contingent up n rezoning, �,�ith the
Sullivans and the Mitchells.
Hearing no further testimony, s. orton closed the p blic hearing.
Ms. Hirte moved to recommend d ni 1 of the Rezoning f om R-4 to B-3 based on
staff report findings and evid nc presented to the C mmittee at the public
hearing. Ms, Zieman seconded he motion:

permitted to withdraw the pres nt application and su it a new application for
B-2 rezoning. Ms. Morton requ st d advice from Mr. egal. He responded that

area of approximately 26,890 s ua e feet.

North: Land to the north of e ite is zoned B-3 a d R-4. The ad�acent sites
are occupied by Video p te store in an old root beer stand, which
� appears to be vacant ow, and a single famil home which faces Maryland
Ave. Across Maryland v to the north is De Brothers Garden Center.
East: To the east across Da e treet is the Coachm n Restaurant. A single
, family home and a gen ra repair garage lie o the southeast.

South: Properties to the sou h re occupied with si gle family homes facing
Dale Street. There a e hree single family omes between the site and
i the B.N. tracks. The tr cks are elevated th ough this area.

southwest of the site is part of the Como Pa k Senior High School site
A portion of the west rl end of the rezoni site abuts on the rear

E. ZONING HISTORY: Prior to the 1975 it -wide rezoning, th site was zoned
commercial. The B-3 site to the no t which is to be dev loped in conjunction
with this site if rezoned, was gra te a permit for a se ice station in May of
1947 and a permit for a root beer ta in June of 1948.
F. I?ISCUSSION: The rezoning site is ne of five single fami y homesites facing
Dale Street between Maryland Avenu , nd the Burlington N rthern north mainline
tracks. While four of these homes te on the west side o the street have the
advantage of school ground open sp ce behind them, they f ce active commercial
frontage on the opposite side of D le The elevated railroad track to the south
has the potential for additionai n ga ive impact on thes homes. As a major
east-west rail route of national s gn ficance, continued daily use of these
tracks should be anticipated. Dal S reet traffic is an ther adverse influence
for continued residential use of t es sites. The Avera e Daily Traffic
(A.D.T.) on Dale Street at this lo at on, measured in Ma ch of 1986, was nearly
15,000 vehicles. The long term v' bi ity of these homes tes will be dependent •
on their owners' ability to cope it these somewhat adv rse influences.
The B-3 site to the north which w 1 be redeveloped wit the rezoning site is
somewhat limited in size, (slight y nder 11,000 square eet) . Reuse of this
site may also present some proble s. Clearly, this corn r will not make a good
homesite, melding the two ad�acen r sidential strips wh ch lie to its west and
south. The reuse of this site fo o her B-3 business wi 1 be limited by the
small lot size. Although most op ra ions requiring B-3 oning look for much
larger sites, the current B-3 sit c uld accommodate an verage size convenience
store with gas pumps, and provide ad quate off-street p rking. Such a use would
even be permitted in a B-2 zone.
Three groups have reviewed and co e ted on this develo ers proposed reuse of
the combined site. Letters recei ed by the zoning comm'ttee from the District

It is unclear from the organizat on s letters, whether r not they realize that
a convenience store which operat s 4 hours a day and s gas pumps could be
constructed on the northerly sit w thout rezoning the alance of the parcel.
The developer's stated objective is to create a neighb rhood convenience center
having a variety of uses and the eb , provide a signif cantly broader range of
, services than is presently avail bl to the nearby co nity. The proposed
; development would set the new b 1 ngs along the west rly side of the site
� facing Dale Street. Thirty-fiv o -street parking sp ces would be provided on
the site, which would meet the ar ing requirements fo the proposed uses.
Because of the irregular shape f e lot, the develop r has asked that Section
60.534. (6) (b) which requires a 10 foot buffer area be een buildings used for
auto service stations and ad�oi in residential proper y be modified to permit a
four foot buffer area along a 3 f ot 6 inch portion o the rear wall of the
proposed building. Excepting hi one element, the p oposed development
appears to meet all special con it on use requirements for the proposed use.

G. SU1�Il�IARY:
1. Given the current adverse inf ue ces affecting the s ngle row of homes on
the west side of Dale Street e een Maryland and th B.N. tracks, their
long term viability is at bes q estionable. This w uld be true with or
without the rezoning of the f rs residential proper .
2. The uses proposed by this dev lo r could all be acc mmodated in a B-2 zone.
B-3 zoning is not necessary, d ypical B-3 uses ar not appropriate to
this site. A rezoning to B-2 0 llow less intensiv commercial activity
similar to that proposed in t velopment plan, wo ld be appropriate.
3. Although the filed petition as s or rezoning of the site currently occupied
by the house, it has sufficien s gnatures to petiti n the rezoning of both
parcels in the development sit .
4. Appropriate findings can be ma e o permit the modifi ation of provisions of
Section 60.534. (6)(b) in that:
a. The strict application of i provision would un easonably limit an
otherwise lawful use of thi p operty,
b. Such modification will not mp ir the intent and urpose of the
condition,
c. The modification is consist nt with health, moral , and general welfare
of the community; and
d. The modification is consist nt with the reasonable enjoyment of ad3acent
property.
H. STAFF RECOI�R�IENDATION: The staff r o ends denial of the petition to rezone the
subject property to B-3 since typi 1 -3 uses are not ap ropriate to this site.
The staff would recommend rezoning he entire site to a B 2 classification and
granting the Special Condition Use e it with modificati n of Section
60.534. (6)(b) to allow the proposed st cture to be built four (4) feet from the
ad�oining residential property for he northerly 35 foot inch se�ent of the
west wall of the southerly portion f aid structure, as oted on the attached
, site plan. Staff's recommendation or approval is condit ned on the
satisfactory completion of the site pl n review process.
