Preliminary and Final Plat Approval for Westminster Cottages
WHEREAS, River Town Homes, LLC has submitted for City Council approval the attached preliminary and fmal plat for
subdivision of property along the east side of Wesbninster Street south of Hoyt into seven residential lots and one unbuildable
outlot to be sold and tied together with one of the residential lots; and
WHEREAS, the appropriate City departments have reviewed the plat and found, subject to the recommended conditions, that it
meets the requirements of Chapter 67 of the Zoning Code; and
WHEREAS, notice of a public heazing before the City Council was duly published in the official newspaper of the City and notices
were mailed to each owner of affected property including all property situated within 350 feet of the subject property; and
WHEREAS, the City Council held a public hearing on the proposed plat on September 1, 1999, where all interested parties were
given the oppor[unity to be heard and the Council considered all the facts and recommendations conceming the plat;
NOW, THEREFORE, BE IT RESOLVED, that ffie City Council accepts and approves the attached preliminary and fmal plat for
Westrninster Cottages along the east side of Westminster Street south of Hoyt subject to the following conditions:

City Council approval of the necessary vacation of Montana Avenue and portions of the alleys in Blocks 1 and 4,
Morton's Addition; and
Lot 1, Block 2, Weshninster Cottages (which has no street &ontage and is not a buildable lot) shall be labeled as an
outlot and sold and tied together with Lot 4 and/or Lot 5 as one parcel for taY purposes; and
3. The applicant shall file a copy of the Council Resolution approving the plat with the Ramsey County Recorder's
Office.

1. All the applicable provisions of the Legislative Code are being complied with.
A petition has been submitted for vacation of a section of Montana and portions
of the existing alleys in Blocks 1 and 4, Morton's Addition, and vacation of these
i segments is in process.
2. The proposed subdivision will not be dettimentaI to the present and potential
, sur'rounding land uses. The proposed subdivision is consistent with the single-
family homes on the west side of Westminster, direcfly across from the site, and
" with other surrounding residential land uses.
3. The area surrounding the subdivision can be planned an developed in
coordination and compatibility with the proposed subdivision. The azea
surrounding the proposed plat is developed with single-family, duplex and multi-
family housing and is compatible with the proposed plat. The few remaining
vacant lots in the azea can be developed in coordination and compatibility with the
proposed plat.
4. The subdivision is in conformance with the Comprehensive Plan. The
proposed subdivision is in conformance with the Housing Plan, which calls for
ensuring availability of a full range of housing choices to meet the needs of a full
range of household types and income levels.
5. The subdivision preserves and incorporates the site's important natural
features, whenever possible. The lots are oriented to eacisting Westrninster
Street.
6. All land intended for building sites can be used safety without endangering
residents by perii from flood, erosion, continuously high water table, severe
soil conditions or other menace. The site and site grading aze being designed to
meet tlus requirement. A proposed storm sewer connection and site contours aze
designed to avoid site drainage onto the Gateway Trail right-of-way.
I. STAFF RECOMMENDATION: Based on required findings i thmugh 7 above, staff
recommends approval of the final plat for Westminster Cottages along the east side of
Weshninster Street south of Hoyt Avenue subject to the following conditions:
1. City Council approval of the necessary vacation of Montana Avenue and portions
of the alieys in Blocks 1 and 4, Morton's Addition.
2. The applicant shall file a copy of the Council Resolution approving the plat with

Preliminary and Final Plat Approval for Westminster Cottages
WHEREAS, River Town Homes, LLC has submitted for City Council approval the attached preliminary and fmal plat for
subdivision of property along the east side of Wesbninster Street south of Hoyt into seven residential lots and one unbuildable
outlot to be sold and tied together with one of the residential lots; and
WHEREAS, the appropriate City departments have reviewed the plat and found, subject to the recommended conditions, that it
meets the requirements of Chapter 67 of the Zoning Code; and
WHEREAS, notice of a public heazing before the City Council was duly published in the official newspaper of the City and notices
were mailed to each owner of affected property including all property situated within 350 feet of the subject property; and
WHEREAS, the City Council held a public hearing on the proposed plat on September 1, 1999, where all interested parties were
given the oppor[unity to be heard and the Council considered all the facts and recommendations conceming the plat;
NOW, THEREFORE, BE IT RESOLVED, that ffie City Council accepts and approves the attached preliminary and fmal plat for
Westrninster Cottages along the east side of Westminster Street south of Hoyt subject to the following conditions:

City Council approval of the necessary vacation of Montana Avenue and portions of the alleys in Blocks 1 and 4,
Morton's Addition; and
Lot 1, Block 2, Weshninster Cottages (which has no street &ontage and is not a buildable lot) shall be labeled as an
outlot and sold and tied together with Lot 4 and/or Lot 5 as one parcel for taY purposes; and
3. The applicant shall file a copy of the Council Resolution approving the plat with the Ramsey County Recorder's
Office.

1. All the applicable provisions of the Legislative Code are being complied with.
A petition has been submitted for vacation of a section of Montana and portions
of the existing alleys in Blocks 1 and 4, Morton's Addition, and vacation of these
i segments is in process.
2. The proposed subdivision will not be dettimentaI to the present and potential
, sur'rounding land uses. The proposed subdivision is consistent with the single-
family homes on the west side of Westminster, direcfly across from the site, and
" with other surrounding residential land uses.
3. The area surrounding the subdivision can be planned an developed in
coordination and compatibility with the proposed subdivision. The azea
surrounding the proposed plat is developed with single-family, duplex and multi-
family housing and is compatible with the proposed plat. The few remaining
vacant lots in the azea can be developed in coordination and compatibility with the
proposed plat.
4. The subdivision is in conformance with the Comprehensive Plan. The
proposed subdivision is in conformance with the Housing Plan, which calls for
ensuring availability of a full range of housing choices to meet the needs of a full
range of household types and income levels.
5. The subdivision preserves and incorporates the site's important natural
features, whenever possible. The lots are oriented to eacisting Westrninster
Street.
6. All land intended for building sites can be used safety without endangering
residents by perii from flood, erosion, continuously high water table, severe
soil conditions or other menace. The site and site grading aze being designed to
meet tlus requirement. A proposed storm sewer connection and site contours aze
designed to avoid site drainage onto the Gateway Trail right-of-way.
I. STAFF RECOMMENDATION: Based on required findings i thmugh 7 above, staff
recommends approval of the final plat for Westminster Cottages along the east side of
Weshninster Street south of Hoyt Avenue subject to the following conditions:
1. City Council approval of the necessary vacation of Montana Avenue and portions

Preliminary and Final Plat Approval for Westminster Cottages
WHEREAS, River Town Homes, LLC has submitted for City Council approval the attached preliminary and fmal plat for
subdivision of property along the east side of Wesbninster Street south of Hoyt into seven residential lots and one unbuildable
outlot to be sold and tied together with one of the residential lots; and
WHEREAS, the appropriate City departments have reviewed the plat and found, subject to the recommended conditions, that it
meets the requirements of Chapter 67 of the Zoning Code; and
WHEREAS, notice of a public heazing before the City Council was duly published in the official newspaper of the City and notices
were mailed to each owner of affected property including all property situated within 350 feet of the subject property; and
WHEREAS, the City Council held a public hearing on the proposed plat on September 1, 1999, where all interested parties were
given the oppor[unity to be heard and the Council considered all the facts and recommendations conceming the plat;
NOW, THEREFORE, BE IT RESOLVED, that ffie City Council accepts and approves the attached preliminary and fmal plat for
Westrninster Cottages along the east side of Westminster Street south of Hoyt subject to the following conditions:

City Council approval of the necessary vacation of Montana Avenue and portions of the alleys in Blocks 1 and 4,
Morton's Addition; and
Lot 1, Block 2, Weshninster Cottages (which has no street &ontage and is not a buildable lot) shall be labeled as an
outlot and sold and tied together with Lot 4 and/or Lot 5 as one parcel for taY purposes; and
3. The applicant shall file a copy of the Council Resolution approving the plat with the Ramsey County Recorder's
Office.

1. All the applicable provisions of the Legislative Code are being complied with.
A petition has been submitted for vacation of a section of Montana and portions
of the existing alleys in Blocks 1 and 4, Morton's Addition, and vacation of these
i segments is in process.
2. The proposed subdivision will not be dettimentaI to the present and potential
, sur'rounding land uses. The proposed subdivision is consistent with the single-
family homes on the west side of Westminster, direcfly across from the site, and
" with other surrounding residential land uses.
3. The area surrounding the subdivision can be planned an developed in
coordination and compatibility with the proposed subdivision. The azea
surrounding the proposed plat is developed with single-family, duplex and multi-
family housing and is compatible with the proposed plat. The few remaining
vacant lots in the azea can be developed in coordination and compatibility with the
proposed plat.
4. The subdivision is in conformance with the Comprehensive Plan. The
proposed subdivision is in conformance with the Housing Plan, which calls for
ensuring availability of a full range of housing choices to meet the needs of a full
range of household types and income levels.
5. The subdivision preserves and incorporates the site's important natural
features, whenever possible. The lots are oriented to eacisting Westrninster
Street.
6. All land intended for building sites can be used safety without endangering
residents by perii from flood, erosion, continuously high water table, severe
soil conditions or other menace. The site and site grading aze being designed to
meet tlus requirement. A proposed storm sewer connection and site contours aze
designed to avoid site drainage onto the Gateway Trail right-of-way.
I. STAFF RECOMMENDATION: Based on required findings i thmugh 7 above, staff
recommends approval of the final plat for Westminster Cottages along the east side of
Weshninster Street south of Hoyt Avenue subject to the following conditions:
1. City Council approval of the necessary vacation of Montana Avenue and portions
