recommendation on a unanimous vo e.

WHEREAS, B. B. & D. Investments, file #1 413, has petitione to rezone 1187-1197
North Dale Street situated on the wes s de of Dale between aryland Avenue and the
Burlington Northern north mainline ov rp ss from R•4 to B-3 or the purpose of
permitting development of a restauran , etail stores and a onvenience store with
gas pumps; and
WHEREAS, the Zoning Committee of the la ning Commission on April 6, 1989, held a
public hearing at which all persons es nt were given an o portunity to be heard
pursuant to said application in acco e with the requir ents of Section 64.400
of the Saint Paul Legislative Code; d
WHEREAS, Saint Paul Planning Commiss on based on the evid ce presented to its
Zoning Committee at the public heari g s substantially re ected in the minutes,
made the following findings of fact: ;
That three groups have reviewed and o ented on this deve opers proposed reuse of
the combined site. Letters receive by the zoning committ e from the District Six
Planning Council, the Como Park Co ni y Council (Distric Ten) , and the Senate
District 66 DFL Club recommend deni o the proposed rezo ing and redevelopment.
The organizations cite traffic cong st n, possible 24-ho -a-day businesses, and
that " . . .the proposed use of the la d uld not provide m h needed services or a
dramatic increase in employment opp rt ities." Based on his information, the �
commenting groups do not feel that he proposed rezoning an ". . .equitable
exchange of zoning districts. . ." 'e aint Paul Public S ools have also
recommended denial.
The developer's stated objective is to create a neighborh od convenience center
having a variety of uses and thereb , rovide a significa tly broader range of
services than is presently availab t the nearby commun ty. The proposed
development would set the new buil n along the westerl side of the site facing
Dale Street. Thirty-five off-stre t rking spaces woul be provided on the site,
which would meet the parking requi em ts for the propos uses.

John Daubney, 700 Amhoist Tower, tt rney representing he applicants,
described the Maryland/Dale comme ci 1 intersection and said that the
applicants would be willing to ha e heir entire parcel rezoned for B-2 usage.
He stated that the applicants nee a larger area for th ir proposed
development, that their use would be consistent with th existing commercial
corners and its usage would not a ve sely impact the i ediate residents or
area traffic.
Mr. Daubney introduced Tom Raymon , 806 Dunkirk Lane, lymouth, Minnesota.
Mr. Raymond stated that most conv i nce stores are ope 24 hours a day and
other stores in the development w 1 probably be open til 10 or 11 o'clock
in the evening.
Mr. Christenson requested informa o on the rezoning p ition signators.
Mr. Daubney said that particular fe ence would be to ers of lots four and
five, Richie's Addition, on Maryl d. Mr. Christenson ated that signatures
from owners of those two lots appe r o be missing. Mr. Raymond said that he
does not know the name of the resi en of lot five; tha the Mitchells are the
resident/owners of lot four.
°Vern Henning, 3240 Owasso Heights oa , Shoreview, said hat he owns the
vacant Video Shop and previously r si ed in the area. H stated that he
declined two offers for the sale o h s property because of the potential
negative impact of their proposed ev lopments on the ne ghborhood.
Don Mitchell, 634 West Maryland, c ar fied that they did not sign the rezoning
petition. He said that when they ef sed to sign the pe ition, Mr. Raymond
offered to buy their property. Mr M tchell referred to the ongoing
commercial expansion of the area a d aid that, if he co tinues to reside in
the area, another type of business wo ld be more accepta e to him than a
24-hour-a-day convenience store.

Ms. Zieman asked if the Mitchell re idence would be so d to the developers.
Mr. Mitchell said yes and added ha they own two 40 ot lots, one on which
the garage is located, zoned B-3 a d one on which the r house is located.
Terry Schmidt, 1187 North Dale Slre t, spoke to the be efits of having a
convenience store located in the ar a, said that there was much noise due to
the proximity of the railroad tr ck as well as traffi on Maryland and Dale,
cited problems created by snowpl wi g, and commented o the commercial growth
of the neighborhood.
Mr. Levy asked how the shops wou d ssist neighboring sidents. Mr. Schmidt
referred to the elderly resident i the vicinity and eir need for nearby
stores accessible to pedestrian ra fic.
Ms. Zieman asked Mr. Daubney abo t e number of parce the developers plan
to purchase from individual home s. Mr. Daubney r ponded that it is
property owned by the Schmidts, S 11'vans and Mitchell
Robert Sullivan, 1177 North Dale tr et, said that he s a signed purchase
agreement with the developers and co firmed his agreem t with Mr. Schmidt's
•remarks.
Terry Richards, 1173 North Dale S re t, testified that e was representing his
�mother in opposition to the devel pm nt, said that tra ic is only heavy
during rush hours, that presently th neighborhood is a relaxing place in
which to live, and cited ob�ectio s o the development ue to potential
- litter, loitering and increased t af ic.
Thomas Sirian, 656 West Maryland, 'st ted that a 24-hour a-day convenience
' store is not compatible with the ei hborhood and schoo grounds, and that the
increased traffic associated with a onvenience store w 11 adversely affect
the area. �
Mr. Daubney addressed comments to �ne ghbors' objections
Mr. Christenson asked about the d e oper's plans regar ing property to be
acquired. Mr. Raymond replied th t rchase agreements re contingent on
rezoning, that the developers wou sume the owners' 'nancial risk, and
eventually the property would be r ted/sold, not ren d. He said that
presently there are purchase cont c , contingent upon ezoning, k•ith the
Sullivans and the Mitchells.

Ms. Hirte moved to recommend denia o the Rezoning fro R-4 to B-3 based on
staff report findings and evidence pr sented to the Co ttee at the public
hearing. Ms. Zieman seconded the ot on.
Committee discussion followed. Mr D ubney requested th t the applicant be
permitted to withdraw the present pp ication and submit a new application for
B-2 rezoning. Ms. Morton requeste a vice from Mr. Sega . He responded that
the Committee could proceed, or th C mmittee could defe action in deference
to the applicant's withdrawal. He 'sa d that the final a tion would be with
the City Council.

B. PARCEL SIZE: The site to be rezon d s an irregular sha ed parcel having 91.2
feet of frontage on Dale Street an a average depth of 72.5 feet. The area of
the parcel is About 15,890 square ee . The total site o be developed has an
area of approximately 26,890 squa f et.
C. EXISTING LAND USE: The site is c rr tly occupied by a ingle family wood frame
structure.
D. SURROUNDING LAND USE:
North: Land to the north of the si is zoned B-3 and -4. The adjacent sites
are occupied by Video Up at store in an old r t beer stand, which
appears to be vacant now a d a single family me which faces Maryland
Ave. Across Maryland Av t the north is Dey others Garden Center.
East: To the east across Dale tr et is the Coachman estaurant. A single
family home and a genera r pair garage lie to the southeast.
South: Properties to the south re occupied with sing e family homes facing
Dale Street. There are th e single family ho es between the site and
the B.N. tracks. The t ac s are elevated thr gh this area.
West: Land to the west of the si e is zoned R-4 res ential. The area and
southwest of the site i p rt of the Como Par Senior High School site

E. ZONING HISTORY: Prior to the 19 5 city-wide rezoni g, the site was zoned
commercial. The B-3 site to he north which is to e developed in conjunction
with this site if rezoned, wa g anted a permit for a service station in May of
1947 and a permit for a root ee stand in June of 948.
F. DISCUSSION: The rezoning sit i one of five singl family homesites facing
Dale Street between Maryland ve ue, and the Burlin on Northern north mainline
tracks. While four of these om sites on the west 'de of the street have the
advantage of school ground op n pace behind them, ey face active commercial
frontage on the opposite side of ale. The elevate railroad track to the south
has the potential for additio al egative impact on hese homes. As a major
east-west rail route of natio 1 ignificance, conti ued daily use of these
tracks should be anticipated. , D e Street traffic i another adverse influence
for continued residential use f hese sites. The A erage Daily Traffic
(A.D.T. ) on Dale Street at thi 1 cation, measured i March of 1986, was nearly
15,000 vehicles. The long ter v ability of these h mesites will be dependent �
on their owners' ability to co e ith these somewhat adverse influences.
The B-3 site to the north whic w uld be redeveloped ith the rezoning site is
somewhat limited in size, (sli ht y under 11,000 squ e feet) . Reuse of this
site may also present some pro le s. Clearly, this rner will not make a good
homesite, melding the two adja en residential strip which lie to its west and
south. The reuse of this site fo other B-3 busines will be limited by the
small lot size. Although most p ations requiring 3 zoning look for much
larger sites, the current B-3 s'te could accommodate n average size convenience
store with gas pumps, and provi e dequate off-street parking. Such a use would
even be permitted in a B-2 zone
Three groups have reviewed and o ented on this deve pers proposed reuse of
the combined site. Letters rec iv d by the zoning co ittee from the District
Six Planning Council, the Como ar Community Council (District Ten) , and the
Senate District 66 DFL Club rec mm nd denial of the p posed rezoning and
redevelopment. The organizatio s ite traffic conges on, possible 24-hour-a-
day businesses, and that ". . .th p posed use of the nd would not provide much
needed services or a dramatic i r se in employment portunities." Based on
this information, the commentin g ups do not feel t t the proposed rezoning
is an " . . .equitable exchange of o ng districts. . ." e Saint Paul Public
Schools have also recommended de ia .
It is unclear from the organizat on s letters, whether or not they realize that
a convenience store which operat s 4 hours a day and s gas pumps could be
constructed on the northerly sit w thout rezoning the alance of the parcel.
The developer's stated objective is to create a neighb hood convenience center
having a variety of uses and the eb , provide a signif antly broader range of
services than is presently avail bl to the nearby co nity. The proposed
development would set the new bu ld gs along the west iy side of the site
facing Dale Street. Thirty-five f street parking sp es would be provided on
the site, which would meet the p ki g requirements for the proposed uses.
Because of the irregular shape of th lot, the develope has asked that Section
60.534. (6) (b) which requires a 1 f ot buffer area bet een buildings used for
auto service stations and adjoini g esidential propert be modified to permit a
four foot buffer area along a 35 00 6 inch portion of he rear wall of the
proposed building. Excepting th s ne element, the pr osed development
appears to meet all special condi io use requirements r the proposed use.

G. SUMMARY:
1. Given the current adverse influence a fecting the single row of homes on
the west side of Dale Street betwee ryland and the B.N. tracks, their
long term viability is at best que ti able. This would e true with or
without the rezoning of the first es'dential property.
2. The uses proposed by this develope c uld all be accommo ted in a B-2 zone.
B-3 zoning is not necessary, and t i al B-3 uses are no appropriate to
this site. A rezoning to B-2 to lo less intensive co ercial activity
similar to that proposed in the d e pment plan, would e appropriate.
3. Although the filed petition asks or rezoning of the si currently occupied
by the house, it has sufficient s gn tures to petition e rezoning of both
parcels in the development site.
4. Appropriate findings can be made to ermit the modific ion of provisions of
Section 60.534. (6)(b) in that:
a. The strict application of th s rovision would unr sonably limit an
otherwise lawful use of this ,pr perty,
b. Such modification will not i pa r the intent and p rpose of the
condition,
c. The modification is consist nt with health, moral and general welfare
of the community; and
d. The modification is consist nt with the reasonabl enjoyment of ad�acent
property.
H. STAFF RECOMMENDATION: The staff ec ends denial of t petition to rezone the
sub�ect property to B-3 since typ ca B-3 uses are not propriate to this site.
The staff would recomrnend rezonin t e entire site to a -2 classification and
granting the Special Condition Us P rmit with modifica ion of Section
60.534. (6)(b) to allow the propos d tructure to be bui t four (4) feet from the
adjoining residential property f e northerly 35 fo 6 inch segment of the
