SRR/kjl WHITE - CITV CLERK PINK - FINANCE COV�ICII �{ C4NARV -DEPARTMENT GITY OF AINT PAUL //� BLUE - MAVOR File NO• /`� Counci esolution � PAGE 1 OF 2 Presented By � �Referred To � ' Committee: Date 1�%Q'�l�� ��� `" Out of Committee By Date WHEREAS, The City Council , by Resolution .F. 88-1607, adopted tober 20, 1g88, authorized a Stipulation Agreement between the City nd the Minnesota Poll ion Control Agency (PCA) regarding an accidental diversion of stor wa er into a sanitary ewer and untreated sanitary/ storm sewage into the Mississippi River d ri g a�4 day period i 1987; and WHEREAS, The PCA Board, at its December, 98 meeting, had reje ed the proposed Stipulation and recommended that the prop se penalty be increa d due to circumstances which became known subsequent to the init al discussion between the parties concerning the diversion; and WHEREAS, The staff of the PCA and the De rt ent of Public Work have now recommended a re-drafted Stipulation whereby the Cit w ld pay a penalty i the amount of $150,000.00, establish a more formalized reporting sy te approved by the PC , and in the event of an unreported improper diversion within hr years of the agr ment, the City would be obligated to pay an additional penalty o $100,000.00; and WHEREAS, The Department of Public Works ec mmends that the Ci Council approve the Stipulation in the form submitted and au ho ize the execution ereof by the Department Director; now therefore be it RESOLVED, That the Council does hereby a pr ve the proposed St ulation in the form presented and a copy of which is attache h reto, and subject acceptance thereof on by the Board of the PCA, the Director of the Department of ublic Works and the Director of the Department of Finance an M nagement Services re hereby authorized and directed to execute the Stipulation on b ha f of the City.
