Mr. Wlsh explained his contacts with Naegele and the reason f r requesting the va,riance. Ms. Hirte asked about proposed sign ligh in . Mr. Walsh replied that four quartz lights would be used, that there w ul be no moving part to the sign. Mr. Repke stated that it was his understa di g that during disci'SSion with the Federation, community members agreed that a ign on the back of '. he building was less obtrusive than a sign would be at st eet level, one blak from Irvine Park. Mr. Walsh concurred. Fila T10435 P€a Two ris , yoron asked for clarifica io regarding the sig drawings. Mr. kTalsh rEliad that engineers drew pl ns for the proper stee work and architectural desn in order to secure the ig , said that the stel work would ba hidden fro:n the face of the wall sign, wo ld blend into the ack of the buiiding and wculd extend above the three st ry building. :•ir. McGuire stated that accordi t the Building Depa, tment the sign is clssified as a roof sign, not a wa 1 sign, not substatially parallel to the wall, because the sign would ext nd five feet at one em and be flush with te tiall at the other end. He said ha the sign would be upported on the roof of the three story section of the bu'lding, cantilevere off the roof of the t'r.ree story section and extend ab ut six feet in excess ',of that section. i ^:s. Hirte inquired about maintena ce f the sign. Mr. 4 lsh answered that the copy would not be changed, and tha t e proposed sign wold be well n:nintained. „ Dave Cossetta, 756 Stewart Avenue, r of Cossetta's Ilian Market, testified in support of the sign va ia ce, said that Seve Corners Ace is one of the most well known hardware sto es in the nation, and'''vouched for the business reputation of the owner. , , Hearing no further testimony, Ms. Mo to closed the public',,'Iportion of the meeting. ', Mr. Repke moved to recommend approva o the sign variance ',ased on findings that the proposed sign would not crea e hazard, or violat' State statutes, ' rules and regulations; that it is not ob ectionable to adjacent property owners, that it would not adversely a fe t residentiai propety through excessive glare and lighting and that 't ould be in keeping',with the general character oi the surrounding area. Th m tion died for lack '',of a second. Committee discussion followed regardin t e definitions of w 1 signs and roof signs , projection from a building, supp rt which would be nel, ded on the roof of a three story building, uniqueness o t e proposed sign an' contact with the West Seventh Federation. Mr. McGuire added that prior to the pres nt meeting he was conacted in person by a representative from the West Sevent F deration who said that, "They are recommending approval based on the fact ha there was no oppo$ition from surrounding neighbors based on a perspec iv sketch of the site," Mr. Christenson moved to recommend denial of the sign variance based on staff report findings and evidence presented to th Committee at the public hearing (1) that the applicant has failed to demo t te that the proposd sign is unique; and (2) that the applicant will st'll be able to erect a'sign to adequately identify his place of business it out need for a modfication of the sign height requirements. Mr. Levy se on ed the motion which', passed on a roll call vote of S-1 (Repke) . LEGAL DESCRIPTION: Lots 10 & 1 B ock 26 Rice and Irv'ine's Addition 6. PRESENT ZONING: B-5 NING CODE REFERENC: Section 66.409 7. STAFF INVESTIGATION AND REPORT: D TE: 03/15/89 BY: Charles L. McGuire A. PURPOSE: Permit the installatio o a sign which exceeds height restrictions for the zoning district by appro 'ma ely six feet. B. PARCEL SIZE: The subject propert h s 120 feet of frontage on West Seventh Street and 120 feet of depth alon C estnut. The area o the parcel is 14,400 square feet. C. EXISTING LAND USE: The property s c rrently occupied by a hardware store. D. SURROUNDING LAND USE: Northeast: A church occupies the dj cent site. There a other mixed commercial uses to the no theast. Southeast: Uses to the southeast e ixed commercial/reidential. South: Uses to the southwest a e rimarily commercial', on the lower floors with some upper story r si ential occupancy. Northwest: Sites to the northwest re predominantly comme,$cially occupied. E. ZONING CODE CITATION: Section 66.4 o the Zoning Code s$ates that "The Planning Commission shall have the a th rity to grant varinces from the strict applications of this chapter for uni ue signs or unusual cnditions pertaining to sign needs for a specific buildin o lot, provided suct signs would not be contrary to the general intent of th s hapter, would not c eate a hazard, would not violate Minnesota State Statutes or rules and regulatid s developed pursuant thereto, would not be'objectionable jacent property o ', ers, would not adversely affect residential propert th ough excessive glae and lighting and provided that the signs would be in k ep ng with the general character of the ,I File #10435 Page Two surrounding area. The commis io may not grant a vaiance that would permit the sign within a zoning district wh ch is not otherwise',permitted in that zoning district under the provisions of this chapter. F. DISCUSSION: The applicant pro os s to have a sign m'suring 11 feet by 36 feet (396 sq.ft. ) installed above t e econd level of the ,ection of the building situated at the corner of Ches nu and West Seventh S,$reet. Since the sign as proposed would exceed the heigh o the third story sction of the building and would be angled away from the w 11 at the southeaster end, the ordinance limits the height of the sign t a maximum of 37' 6" . ', As proposed, the sign would extend to a height of 44' 6" , or 7 feet above t$ maximum allowed by the code. The sign would carry the name Ac H rdware, the store 4erated on the premises. However, in appearance, size, an c nstruction it is mqe like a billboard than a business identification sign. il boards are not a prmitted use in this section of the B-5 zoning distric . Based on the drawigs provided, about half of the total area of the sign wou d e devoted to the aertising of a product line that is available on the sit . The remaining sign ''rea would provide additional identification for the st e. Although an olier identification sign which hung over the public sidewal s recently removed ',from the front of the store, the remaining signage provi es ample identificatiQ, through full use of the structure's sign band. Numero s indow signs advertie the availability of the store's major product lines. G: FINDINGS: If the commission were t g ant a variance fro the provisions of the sign ordinance, several findings as no ed in Section 66.408 (see E. Zoning Code Citation above) would be required. Th Commission must fid that the proposed sign: 1. Is not contrary to the general i te of this chapter: Although the chapter does not con ai a "general intent 'tatement" , it is clear from Section 66.101. Purpos . hat the elimination'', of visual clutter is a vital consideration of the o di nce. Paragraphs (') "To encourage a concern for the visual environment. . . ' and (5) "To proteG,t . . .areas characterized by unique environmen al historical and arhitectural resources" speak to the issue of v su 1 clutter. The erection of a smaller sign to i en ify the business i possible within the limits of the ordinance and wit ou the need for modication of the height requirements. 2. Would not create a hazard, violate at Statutes or rules 'and regulations developed pursuant thereto: It does not appear that the sign as ro osed would be hazarous or in violation of State Statutes, Rules, tc. File #10435 Page Three 3. Would not be objectionable to adacent property qwners: i Although no objections hav b en indicated by nehbors as of the date of this report, we have no ev de ce in hand to find ', hat there would be no objections. I 4. Would not adversely affect es dential property tkrough excessive glare and lighting, The proposed sign would be ig ted during hours of',darkness, although it is unclear what if any effect is would have on adjaent residential uses, it does not appear to be benefi ia to adjacent resid ntial uses; and I 5. Would be in keeping with the ge eral character of tte surrounding area. Although this area is not de ig ted an historic ar, a there are many old and historic buildings in the ge ra area. The Irvinel Park Historic District lies one block to the south. Th area is a high ac ivity area and subject to significant congestion wit t e Civic Center just to the northeast. The "advertising sign" charac er stics of the proposl d sign, while they may add to the busyness and conge ti of this portion o. the street, do not appear to be an enhancement. 'I H. STAFF RECOIIlriENDATION: Based on th se findings, staff reqommends denial of the proposed sign. ,,I I ,i 'I ',I I ,I , I . 9- LIST OF A TACHMENTS FILE #10435 Page ; Sign Variance Application 1 , Proposed Sign Plan 3 ; Proposed Sign Face 5 ; Location Maps 6 , Land Use Map g I I ` - , . '•- .. r ZONIN4 d0 RD $ Qy , APP IC TION FOR ZONING RDINANCE VARIANCE CiTY OF 3AINPAUI 0 1 T I , A VARIANCE OF ZON NG COOE CHAPTER lbSECTION 66OARAGRAPH IS REQUESTED I C FORMITY WITH TME►OW6ils VESTED IN THE BOARO OF 20NING AP— PEALS TO PERM T T E ON PfiOPERTY OE9CRIBED BE A.
