Maloney APPEARANCE : Jerry Gustafson _ SUBJECT: Appellant is requesting a waiver of the registration fee for a vacant building in the amount of $ 110 . 00. ( letter dated March I5, 1989. ) PROCEEDINGS: Mr. Gustafson stated that Ms. Maloney is in a nursing home and has an income of only $413. 00 a month. After expenses only $40. 00 is left for Ms. Maloney' s spendinq money. The home is for sale. there is a signed purchase agreement. Closing should be in about three weeks. - Jim Prill , from Div. of Public Heaith stated that Ms. Maloney has a life estate in the property. There also are three other parties that are listed as fee owners. Bill Tilton referred to a letter that the Board received from Ken Johnson of PED, dated April 4, 1989, asking the board to deny the request for a waiver of the vacant building fees. BOARD ACTION: Motion made by Bill Tilton- to deny the req�est for a waiver of the vacant building fees. Requesting the city to refrain from collecting the fees , until the sale of the building. The f�e of $ 110. 00 is to be collected at the time of closing. Seconded by Harold Knutson. The building is not a new building, but it is in very good shape. Mike Ricketson, from Fire Prevention stated, that although a one hour fire separation is required. A hollow core door gives it a 20 minute rating, the glass in the doors do not give it a 20 minute rating, I suggested that the appellant instal-1 wired glass doors. Especially for children, o hers with c,tiildren and the kind of weather that is typical in innesota. _ After much discussion th B ard postponed this issue requesting that Mr. Lein do some mo e esearch.The Board advised the Appellant to work with F re Prevention and maybe come up with a solution about the secon e it from third floor. ( lett r ated December 8;� 1988) 5 ����.- ?r-�v� PROCEEDINGS: 7he appellant would like to continue to allow the tenants share oath. The building has 19 units and only four bathrooms. Two of the units have private baths, therefore. that leaves 17 tenants sharina two bathrooms. which are on the second floor. � Mike Ricketson, from Fire Prevention stated that these are (� efficiency apts. This case was before the Board once before, � only under a defferent owner. At that time the Board granted a - �' variance, with the condition that two more baths were to be � installed. � Upon doing an inspection it was discovered that there is only two bathrooms on the second floor. The previous owner did not bring the building up to code. Pat Fish, from Fire Prevention advised the Appel )ant since he was th� new owner that he should apply for a variance. BOARD ACTION: Motion made by Bill Tilton to deny the request for a variance, instead granted the appel )ant an extension of time for six months (October 14, 1989) to instali the additional bathrooms, if at that time the appellant needs more time Fire Prevention wou�id be willing to given additional time. She has been in court with her tenants, as they have not been paying the rent. Most of the items can be done in a short time, but the overflow in the bath is very costly. Mr. Jackson talked to .� a Fire Marshall , a year or so before, and he told me that the thi•�d ,R,� floor was an easy reach fr m the gas station below. The last � time there was an inspec io , there was no mention of a second exit. At that time, I insta le fire rated doars and numerous smoke detectors inter-connecte t the basement. �r. Lein _ (3 units) APPEARANCE : Eric M. �ein SUBJECT: Appellant is requesting a variance on having to provide a second exit from the third floor. ( letter dated January 18, 1989) -- PROCEEDINGS: The Appellant passed out some material regarding a ladder device, which he was hoping to be able to install to the outside of the building. The reason was that he feels all sides are exposed to Summit. This area is in the Historic Preservation Area, and he feels if regular stairs were installed it would ruin the aesthetics of the building. Sue Toskey, from Fire Prevention stated that the Fire Department was not opposed to this kind of ladder, other than a building permit must be obtained, and the building department will not accept ladders as a means of egrees. Dick Amey, from Building Department stated that the type of ladder that Mr. Lein wishes to put in does not meet code. Especially for children, mothers with ckiildren and the kind of weather that is typical in Minnesota. - After much discussion the Board postponed this issue requesting that Mr. Lein do some more research.The Board advised the Appellant to work with Fire Prevention and maybe come up with a solution about the second exit from third floor. Upon doing an inspection 'it was discovered that there is oniy two bathrooms on the second lo r. The previous owner did not bring the building up to code. Jackson SUBJECT: Appellant is requesting a variance on have to provide, Second exit from third floor unit. ( letter dated March 1 , 1989) PROCEEDINGS: 7here was an inspection of the buiiding. Mr. Jackson was issued 50 work orders, which were completed. The third floor is an efficiency apartment. The building is about a block and- half from the fire station. Mr. Jackson talked to a Fire Marshali , a year or -so before, and he told me that the third floor was an easy reach from the gas station below. The last time there was an inspection, there was no mention of a second exit. At that time, I installed fire rated doors and numerous srnoke detectors inter-connected to the basement. Mr. Jackson's attorney informed me that the law has not changed, but how it is interpreted. Sue Toske,y, from Fire Prevention stated that the interpretation that Mr. Jackson is referring about is; at one time the issue about a second exit from the third floor; was in the wording. The Fire Department requested an official explanation from the State Fire Marshall . BOARD AGTION: Motion made by Harold Knutson to deny the request for a variance on the second exit from the third floor, with the stipulation that the Fire Department meet with Mr. Jackson on the job to see if there is a viable solution.
