WHEREAS, Saint Paul City Charter § 5.02 permits the City, upon recommendation of
the City Attorney and in the case of special or unusual circumstances, to appoint outside counsel
to represent the City; and
WHEREAS, special and unusual conditions exist in the matter of the acquisition,
relocation and possible condemnation and taking of certain properly owned by Advanced
Recycling needed for the Phalen Corridor Phase I Project as well as the East Metro Transit
Facility Project and the future I-35E Project which requires special skills and expertise; and
WHEREAS, the City Attorney recommends the appointment of outside counsel for this
matter; NOW, THEREFORE,
BE IT RESOLVED, that the appropriate city officials are hereby authorized to retain the
law firm of Briggs and Morgan (Marc Manderscheid, Esq., contact person) to represent the City
in this matter under a separate legal services agreement which shall be consistent with the City
Attorney's Office Policy Regazding Fees for Legal Services by Outside Counsel and the City
Attorney's Office Policy and Procedure for Retaining Outside Legal Counsel. Legal service fees
are to be taken from the previously approved budget for the Phalen Corridor Phase I Project.
