RESOLVED, that the license of the Licensee, Sufian Wazwaz dba Tobacco Field (License ID No. 59656),
located at 2419 West 7�' Street in Saint Paul is hereby revoked; provided, however, that such revocation is stayed on the
following conditions. The Licensee shall (1) pay a fine of $2,000 on or before the close of business on December 27,
1999, (2) comply with a11 the terms and conditions of his probation resulting from lus conviction of the felony offense
of possession of untased tobacco, and (3) have no further violations of law during the 18 month period following
October 27, 1999. If Licensee violates any of the above conditions, his license shall be revoked upon the following
procedure:

This resolution and the action of the Council in this matter aze based upon the facts contained in the September
9, 1999 Notice of Violation letter to the Licensee, the documents and materials part of the record submitted to the
council, and the arguments as may haue been presented to the Council at the public hearing on October 17, 1999. The
facts were not contested by the Licensee.

for 5:30 p.m., Wednesday, October 27,1999 in the City Council Chambers, Third Floor, Saint
Paul City Hall and Ramsey County Courthouse.

Dear Ms. Paimer:
Sufian Wazwaz does not dispute the facts giving rise to the above-referenced Notice of
Viotation. Therefore, he does not request a hearing before an administrative faw judge.
As part of his sentence in the criminal case, Mr. Wazwaz was ordered to pay
$4,575.28 in restitution, and $330.00 in court fines and fees. Of the restitution total, $2,574.65
was the actual tobacco tax owed, with the remaining balance refiecdng interest ($96.69) and
penalties ($518.93 LF/LP penalty; $1,297.33 50% Civil Fraud Penalty). Additionally,
thousands of dollars worth of cigars were seized from Mr. Wazwaz. Special Agent Rod
Nyenhuis told me today that the Commissioner of Revenue will file a complaint requesting the
cigars be adjudged as contraband and forfeited to the state.
As you can see, Mr. Wazwaz has already sufferea significant financial consequences
in this case. Mr. Wazwaz hereby offers to pay $500.00 to sett{e the tobacco license violation
and avoid any further appearances. If this offer is acceptable, please let me know. If it is not,
Mr. Wazwaz requests a hearing in front of the city council.

Deaz Mr. Wazwaz:
The O�ce of License, Inspections and Environmental Protection has recommended that adverse
action be taken against the cigarette license held by Tobacco Field for the premises 2419 W. 7`�'
Street in Saint Paul. The basis for the recommendation is as follows
On May 14,1999 you pled guilty to the felony offense of
Possession of Untaxed Tobacco. The complaint states that in
November of 1998 you received shipments of tobacco products
from unlicensed suppliers. The Minnesota Department of
Revenue executed a search warrant at Tobacco Field and
seized a large number of tobacco product's on �vhich tax had
not been paid, as well as cigars manufactured in Cuba, which
cannot lawfully be offered for retaii sale in the United States.
The conduct described is grounds for adverse action against
your license pursuant to Saint Paul Legislative Code
§310.06(b)(6)a.
If you do not dispute the above facts, please send me a letter to that effect, and the matter will be
scheduled for a hearing before the Saint Paul City Council to determine the appropriate penalty
to impose on your license. You, or someone on your behalf, will have the opportunity to appeaz
before the City Council and make a statement as to the proper penalty, if any, to be imposed.

If you wish to dispute the above facts, you are entitled to an evidentiary hearing before an
administrative law judge. At that hearing both you and the City will present witnesses, evidence
and cross-examine the other's witnesses. If this is your choice, please send me a letter stating
that you aze contesting the facts. You will then be sent a notice of the administrative hearina
with the time, date, and place of the hearing, and a brief explanation of the procedures.
In either case, please let me know in writing no later than Monday, September 20,1999,
how you would like to proceed. If I have not heard from you by that date, I will assume
that you are not contesting the facts. The matter will then be scheduled for the hearing
before the St. Panl City Council.

At all times material to this complaint, the defendant SUFIAN ORTHMAN WAZWAZ was the owner of
Tobacco Field, a store in the city of St. Pau1, Ramsey County, that offers ci�arettes and tobacco products for sale
to the public. Except as other�vise provided in Minnesota Statutes, Chapter 297F, distributors of tobacco
products must pay a tax to the state of Minnesota equal to 35% of the wholesale value of the tobacco products the
distributor manufactures or distributes for sale in the state. Chapter 297F establishes licensing and recordkeeping
requirements to ensure that ihis 35% tax is paid on all tobacco products sold in Minnesota. Chapter 297F
requires that tobacco retailers such as defendant purchase tobacco products from licensed distributors and
subjobbers and keep invoices for purchases of tobacco products for one year &om the date of purchase.
Audits conducted by the Minnesota Department of Revenue in September 1997 and April 1998 found that
defendant had a substantial number of untaYed tobacco products at Tobacco Field. On both occasions, defendan?
��•as required to pay the uncollected tar on those tobacco products. In November 1995, your complainant leamed
that several shipments from unlicensed suppliers had been made to Tobacco Field after the Apri] 1998
Department of Revenue audit. On December I1, 199S, a�ents of the Minnesota Department of Revenue and St_
Paul police oFficers executed a seazch �varrant at the store and seized a large number of tobacco products.
Defendant identified himself during execution of the wazrant as the manager and sole proprietor of Tobacco
Field. Defendant �vas unable to produce valid invoices for all of the tobacco products in the store. Many of the
items seized at Tobacco k�ield on December 11, 1998 were cigars appazently manufactured in Cuba, which cannot
lawfully be offered for retail sale in the United States.

Your complainant, Rod Nyenhuis, an investi�ator with the Minnesota Department of Revenue, states that he has
reviewed the investigative reports re�arding the offense listed below and that he believes that the followin�
factual basis establishes probable cause to believe that the listed offense was committed and that the named
defendant committed said offense.

The Minnesota Departrnent of Revenue has examined the invoices provided by defendant and completed an
inventory and audit of the tobacco products seized at Tobacco Field on December 11, 1998. This inventory and
audit compared the seizures on December 11, 1998 with the untaxed items inventoried during the DepartmenYs
April 1998 audit of Tobacco Field. The Department has thereby estabiished that defendant had in his store on
December 11, 1998 untaxed tobacco products worth $7,413.29 that were not in the store when the Department
conducted its April 1998 audit of Tobacco Field.

Viotation. Therefore, he does not request a hearing before an administrative faw judge.
As part of his sentence in the criminal case, Mr. Wazwaz was ordered to pay
$4,575.28 in restitution, and $330.00 in court fines and fees. Of the restitution total, $2,574.65
was the actual tobacco tax owed, with the remaining balance refiecdng interest ($96.69) and
penalties ($518.93 LF/LP penalty; $1,297.33 50% Civil Fraud Penalty). Additionally,
thousands of dollars worth of cigars were seized from Mr. Wazwaz. Special Agent Rod
Nyenhuis told me today that the Commissioner of Revenue will file a complaint requesting the
cigars be adjudged as contraband and forfeited to the state.
As you can see, Mr. Wazwaz has already sufferea significant financial consequences
in this case. Mr. Wazwaz hereby offers to pay $500.00 to sett{e the tobacco license violation
and avoid any further appearances. If this offer is acceptable, please let me know. If it is not,
Mr. Wazwaz requests a hearing in front of the city council.

The O�ce of License, Inspections and Environmental Protection has recommended that adverse
action be taken against the cigarette license held by Tobacco Field for the premises 2419 W. 7`�'
Street in Saint Paul. The basis for the recommendation is as follows
On May 14,1999 you pled guilty to the felony offense of
Possession of Untaxed Tobacco. The complaint states that in
November of 1998 you received shipments of tobacco products
from unlicensed suppliers. The Minnesota Department of
Revenue executed a search warrant at Tobacco Field and
seized a large number of tobacco product's on �vhich tax had
not been paid, as well as cigars manufactured in Cuba, which
cannot lawfully be offered for retaii sale in the United States.
The conduct described is grounds for adverse action against
your license pursuant to Saint Paul Legislative Code
§310.06(b)(6)a.
If you do not dispute the above facts, please send me a letter to that effect, and the matter will be
scheduled for a hearing before the Saint Paul City Council to determine the appropriate penalty
to impose on your license. You, or someone on your behalf, will have the opportunity to appeaz
before the City Council and make a statement as to the proper penalty, if any, to be imposed.

At all times material to this complaint, the defendant SUFIAN ORTHMAN WAZWAZ was the owner of
Tobacco Field, a store in the city of St. Pau1, Ramsey County, that offers ci�arettes and tobacco products for sale
to the public. Except as other�vise provided in Minnesota Statutes, Chapter 297F, distributors of tobacco
products must pay a tax to the state of Minnesota equal to 35% of the wholesale value of the tobacco products the
distributor manufactures or distributes for sale in the state. Chapter 297F establishes licensing and recordkeeping
requirements to ensure that ihis 35% tax is paid on all tobacco products sold in Minnesota. Chapter 297F
requires that tobacco retailers such as defendant purchase tobacco products from licensed distributors and
subjobbers and keep invoices for purchases of tobacco products for one year &om the date of purchase.
Audits conducted by the Minnesota Department of Revenue in September 1997 and April 1998 found that
defendant had a substantial number of untaYed tobacco products at Tobacco Field. On both occasions, defendan?
��•as required to pay the uncollected tar on those tobacco products. In November 1995, your complainant leamed
that several shipments from unlicensed suppliers had been made to Tobacco Field after the Apri] 1998
Department of Revenue audit. On December I1, 199S, a�ents of the Minnesota Department of Revenue and St_
Paul police oFficers executed a seazch �varrant at the store and seized a large number of tobacco products.
Defendant identified himself during execution of the wazrant as the manager and sole proprietor of Tobacco
Field. Defendant �vas unable to produce valid invoices for all of the tobacco products in the store. Many of the
items seized at Tobacco k�ield on December 11, 1998 were cigars appazently manufactured in Cuba, which cannot
lawfully be offered for retail sale in the United States.

The Minnesota Departrnent of Revenue has examined the invoices provided by defendant and completed an
inventory and audit of the tobacco products seized at Tobacco Field on December 11, 1998. This inventory and
audit compared the seizures on December 11, 1998 with the untaxed items inventoried during the DepartmenYs
April 1998 audit of Tobacco Field. The Department has thereby estabiished that defendant had in his store on
December 11, 1998 untaxed tobacco products worth $7,413.29 that were not in the store when the Department
conducted its April 1998 audit of Tobacco Field.

Dear Ms. Paimer:
Sufian Wazwaz does not dispute the facts giving rise to the above-referenced Notice of
Viotation. Therefore, he does not request a hearing before an administrative faw judge.
As part of his sentence in the criminal case, Mr. Wazwaz was ordered to pay
$4,575.28 in restitution, and $330.00 in court fines and fees. Of the restitution total, $2,574.65
was the actual tobacco tax owed, with the remaining balance refiecdng interest ($96.69) and
penalties ($518.93 LF/LP penalty; $1,297.33 50% Civil Fraud Penalty). Additionally,
thousands of dollars worth of cigars were seized from Mr. Wazwaz. Special Agent Rod
Nyenhuis told me today that the Commissioner of Revenue will file a complaint requesting the
cigars be adjudged as contraband and forfeited to the state.
As you can see, Mr. Wazwaz has already sufferea significant financial consequences
in this case. Mr. Wazwaz hereby offers to pay $500.00 to sett{e the tobacco license violation
and avoid any further appearances. If this offer is acceptable, please let me know. If it is not,
Mr. Wazwaz requests a hearing in front of the city council.

Deaz Mr. Wazwaz:
The O�ce of License, Inspections and Environmental Protection has recommended that adverse
action be taken against the cigarette license held by Tobacco Field for the premises 2419 W. 7`�'
Street in Saint Paul. The basis for the recommendation is as follows
On May 14,1999 you pled guilty to the felony offense of
Possession of Untaxed Tobacco. The complaint states that in
November of 1998 you received shipments of tobacco products
from unlicensed suppliers. The Minnesota Department of
Revenue executed a search warrant at Tobacco Field and
seized a large number of tobacco product's on �vhich tax had
not been paid, as well as cigars manufactured in Cuba, which
cannot lawfully be offered for retaii sale in the United States.
The conduct described is grounds for adverse action against
your license pursuant to Saint Paul Legislative Code
§310.06(b)(6)a.
If you do not dispute the above facts, please send me a letter to that effect, and the matter will be
scheduled for a hearing before the Saint Paul City Council to determine the appropriate penalty
to impose on your license. You, or someone on your behalf, will have the opportunity to appeaz
before the City Council and make a statement as to the proper penalty, if any, to be imposed.

At all times material to this complaint, the defendant SUFIAN ORTHMAN WAZWAZ was the owner of
Tobacco Field, a store in the city of St. Pau1, Ramsey County, that offers ci�arettes and tobacco products for sale
to the public. Except as other�vise provided in Minnesota Statutes, Chapter 297F, distributors of tobacco
products must pay a tax to the state of Minnesota equal to 35% of the wholesale value of the tobacco products the
distributor manufactures or distributes for sale in the state. Chapter 297F establishes licensing and recordkeeping
requirements to ensure that ihis 35% tax is paid on all tobacco products sold in Minnesota. Chapter 297F
requires that tobacco retailers such as defendant purchase tobacco products from licensed distributors and
subjobbers and keep invoices for purchases of tobacco products for one year &om the date of purchase.
Audits conducted by the Minnesota Department of Revenue in September 1997 and April 1998 found that
defendant had a substantial number of untaYed tobacco products at Tobacco Field. On both occasions, defendan?
��•as required to pay the uncollected tar on those tobacco products. In November 1995, your complainant leamed
that several shipments from unlicensed suppliers had been made to Tobacco Field after the Apri] 1998
Department of Revenue audit. On December I1, 199S, a�ents of the Minnesota Department of Revenue and St_
Paul police oFficers executed a seazch �varrant at the store and seized a large number of tobacco products.
Defendant identified himself during execution of the wazrant as the manager and sole proprietor of Tobacco
Field. Defendant �vas unable to produce valid invoices for all of the tobacco products in the store. Many of the
items seized at Tobacco k�ield on December 11, 1998 were cigars appazently manufactured in Cuba, which cannot
lawfully be offered for retail sale in the United States.

reviewed the investigative reports re�arding the offense listed below and that he believes that the followin�
factual basis establishes probable cause to believe that the listed offense was committed and that the named
defendant committed said offense.

The Minnesota Departrnent of Revenue has examined the invoices provided by defendant and completed an
inventory and audit of the tobacco products seized at Tobacco Field on December 11, 1998. This inventory and
audit compared the seizures on December 11, 1998 with the untaxed items inventoried during the DepartmenYs
April 1998 audit of Tobacco Field. The Department has thereby estabiished that defendant had in his store on
December 11, 1998 untaxed tobacco products worth $7,413.29 that were not in the store when the Department
conducted its April 1998 audit of Tobacco Field.

is hereby revoked; provided, however, that such revocafion is stayed on the following conditions.
The Licensee shall (1) pay a fine of $2,000 on or before the close of business on December 27,
1999, (2) comply with all the terms and conditions of his probation resulting from his conviction
of the felony offense of possession of untased tobacco, and (3) have no further violations of law
during the 18 month period following October 27, 1999. If Licensee violates any of the above
condirions, his license shall be revoked upon the following procedure:

the director LIEP or his designee shall execute an affidavit reciting the violation or
violations of the foregoing conditions; and
such �davit shall be served upon the Licensee; and
a resolution imposing the revocation and specifying the effective date thereof sha11 be
prepared by LIEP and the council shall place it on the next available consent agenda for
appropriate action; and
a copy of the resolution sha11 be served upon the Licensee.
