ZONING AND ENVIRON EN AL REVIEW FEES, 1989
WHEREAS, Sections 64.203, 64.204, 64 20 , 64.400, and 67.308 of the Zoning
Code authorize the City Council to e ta lish zoning fees by resolution;
WHEREAS, the city has not previously ha a schedule of environmental fees even
though the Rules of the Minnesota En ir nmental Quality Board, 4410.6000,
authorize municipalities to establis f es for environmental review work they
are required to do;
WHEREAS, PED has estimated that the os of its zoning case function for 1988
was $233,000; of which approximately 27 percent was recovered from the current
zoning fees collected by either PED r he Building Inspection and Design
Division;
WHEREAS, the proposed zoning fees wi 1 ecover approximately 44 percent of
PED's cost for the zoning case funct on
WHEREAS, the Mayor has recommended t at zoning fees should reflect three
factors: actual cost of processing pp ications; private gain versus public
benefits of zoning; and ability to p y;
WHEREAS, the Mayor has recommended t e chedule of zoning and environmental
fees listed below;
NOW, THEREFORE, BE IT RESOLVED, that th City Council does hereby nullify and
replace the following City Council R so utions: C.F. 277710 - Schedule of
zoning fees with formula for adminis ra ive updating; C.F. 279084 - Fees for
subdivision of land; C.F. 277925 - F es for public notification costs for
zoning hearings;

BE IT FURTHER RESOLVED, that the Cit C uncil establishes the following zoning
fees, which shall be paid upon appli at'on for zoning action and which shall
become effective upon adoption.
1. Rezoning
A. Residential : $390 for ne lot, plus $20 for each additional lot;
$540 for unsubdivided pa ce s of more than 25,000 square feet.
B. Commercial , Industrial , nd Institutional : $600 for sites less
than 25,000 square feet, pl s $100 for each additional 25,000
square feet.
2. PD Zoning
$600 for sites less than 75 000 square feet, plus $50 for each
additional 25,000 square fe t.
3. S ecial Condition Use or Flood la n Conditional Use
A. Residential : $400 for t e irst lot, plus $30 for each additional
lot; $450 for unsubdivid d arcels over 25,000 square feet.
B. Commercial , Industrial , ns itutional : $450 for sites less than
25,000 square feet, plus $1 0 for each additional 25,000 square

Dear President Scheibel and Member o the City Council:
In accordance with the 1989 City B dg t, PED is proposing significant
increases in zoning fees and estab is ment of environmental review fees. I
recommend adoption of the attached Co ncil Resolution to implement the new fee
schedule.
Here are some highlights of this f e roposal in addition to the establishment
of environmental review fees.
1. The zoning fees will increase it revenue by about $40,000 per year to a
new total of $100,000 per year. E timating revenue from the environmental
review fees is difficult becaus a plications are sporadic, but the base
fee for major environmental app ic tions will be $1000.
2. Over half of the increased reve ue will come from two types of zoning
cases, site plan reviews and sp ci 1 condition uses, where our existing
fees are clearly too low.
3. The new fees contain a penalty If p to $200 for applications made after
construction has already starte , Such penalties currently exist for
building permits, but are new f r oning.
4. The fee schedule provides for a nu 1 increases which can be made
administratively.
5. The new Council Resolution cons li ates zoning fees into one resolution,
whereas they are currently foun i three separate resolutions.
6. The City's existing zoning fee ch dule is in the upper quartile of
municipalities in the metropoli an area. With the proposed fees, Saint
Paul will clearly be in the top te .

The Planning Division has done a s ud of zoning fees and developed a new
schedule of fees that should be pr po ed to the City Council for adoption by
resolution. The attached fee prop sa contains the following significant
changes:
1. Environmental review fees are be ng established. PED has followed a
policy of requiring applicant t pay consultant costs for environmental
review work, but has not prev ou ly charged for City staff time.
2. There are large increases for a w types of zoning cases (site plan
review, special condition use, d termination of similar use, and lot
splits) where our current fee a really bargain rates in terms of the
staff time they take and in c p ison to other municipalities.
3. A few new zoning fees are est li hed for administrative activities which
have previously been free (o rs ip list for petitions, sign district
review, and zoning certificati n etters) .
4. The rest of the zoning fees ar b ing increased by about 20-25 percent,
which is reasonable given that th y have not been increased since 1986.

resolution whereas they are cu re tly found in three separate
resolutions.
6. The new City Council resolutio c ntains a penalty fee of up to $200 for
certain types of applications ad after construction has already
started.
Under the new zoning fees (not coun in the environmental fees) , the City's
revenue will increase from approxim te y $60,000 a year to $100,000. This is
a 66 percent increase. Nearly half 'of this increase in revenue comes from
just one type of zoning case, site la review. It is by far our most common
type of application and we have bee c arging a base fee of only $65 for
commercial and multifamily applicat on . The proposed base fee is $200.

The City's existing zoning fee sc d e is in the upper quartile of municipal
zoning fees in the metropolitan a a. Some of the other high-fee communities
are Minneapolis, Edina, Fridley, r ville, and Richfield. With the proposed
fee schedule, Saint Paul will cle 1 be in the top ten.
Although the proposed fees contai si nificant increases, they still will
cover only 44� o£ PED's costs for on ng casework. The cost of doing zoning
cases is, in effect, divided betwe n he applicants and the city at large,
which receives the benefit of zoni g egulations. We can't break out costs
for individual types of zoning cas s, but obviously cases that become
controversial, with layovers and r qu sts for more information, become very
costly. Fees should be high enoug t deter "speculative" applications, but
not so high as to encourage evasio o zoning procedures.
