In full settlem nt of negotiations, the parties hereto have agreed as follows: 1. Except as herein modified, the 1 88 1989 Agreement executed on February 29, 1988 between the p rt' s shall be the basis of the forthcoming labor agreement. 2. The following Articles attached he eto shall be a part hereof and become effective upon executio ' of this Memorandum: A. Article 3.8 regarding hour o work shall replace the current Article 3.8. B. Article 3.9 and 3.10 shall be added to the current Article III. C. Article 5.5 shall be added to the current Article V. D. Article 17.3 and 17.9 rega di g leave of absence shall replace the current Articles 17.3 and 17.9. E. Article XXVII regarding s'ck eave usage for dependent care shall be added. F. Article XXVII regarding t rm of agreement shall become Article XXVIII. Such an arrangement must be mutually a re d upon by the Employer and the employees involved. Vacation, ho iday and sick leave benefits for employees who share a position' sh 11 be pro-rated based upon the percent of hours worked. Heal h nsurance benefits shall be administered in accordance wi e provisions of Article 10 of this Agreement. In the event that on of the employees participating in the shared position is termin te or terminates employment, the Employer shall post the job s ar ng vacancy for a period of ten (10) days. If, at the end of ten 10 days, such vacancy cannot be filled, the Employer shall ha e he option of increasing the remaining employee's work hou s. 3.10 Articles 3.8 and 3.9 shall n b subject to the provisions of Article 6 of this Agreement. . . , . �,�.�'`�6 3 5.5 Notwithstanding Article 5.1, th Employer may at anytime during the life of this Agreement desig at the day after Thanksgiving as a paid holiday. In the event of su h esignation, the Columbus Day holiday shall be deleted from the pa d olidays list as set forth in Article 5.1. i , . ���_7G 3 17.3 Any employee who has accumulate s ck leave credits as provided above shall be granted leave wi h ay, for such period of time as the head of the department deems ne es ary, on account of sickness or injury of the employee, quarant ne established by a public health enforcement agency, death of th e ployee's mother, father, spouse, child, brother, sister, mother-"n- aw, father-in-law, or other person who is a member of the househo ; nd may be granted leave with pay for such time as is actually n es ary for office visits to a doctor, dentist, optometrist, etc. 17.9 Maternity and Parental Leave. �Pr gnant employees of the City of Saint Paul shall be eligible f r he use of paid sick leave and unpaid leave of absence in the sa e manner as any other disabled or ill City employee. Such paid ic leave eligibility shall begin upon certification by the employee' a tending physician that the employee is disabled in terms of her ab li y to perform the duties of her position. A twelve (12) month Parental 1 av of absence without pay shall be granted to a natural parent o a adoptive parent, who requests such leave in conjunction with the i h or adoption of a child. Such leave may be extended an addi io al twelve (12) months by mutual agreement between the employe a d the Employer. Refusal on the part of the Employer to grant an e te sion of such leave shall not be subject to the provisions of rt cle 6 of this Agreement. Employees who return followin s ch leaves of absence shall be placed in a position of equivalent s la y and tenure as the one held just prior to the beginning of the r eave. � . � ��--7� 3 . ARTICLE XXVII - SICK LEAVE USAGE FO D PENDENT CARE 27.1 In the case of a serious illn ss or disability of an employee's child, parent or household me be , the head of the department shall grant leave with pay in order fo the employee to care for or make arrangements for the care of uc sick or disabled persons. Such paid leave shall be drawn fro t e employee's accumulated sick leave credits. Use of such sick le ve shall be limited to 40 hours per incident. 27.2 The head of the Department or th Personnel Director may require a physician's certificate or ad it onal certificates at any time during an employee's use of sick lea e or the purposes stated in 27.1 above. All such certificates sh 11 be forwarded by the appointing officer to the Personnel Offi e. If an employee is absent bec se of the provisions of Article 27.1 for three or fewer calendar ys he/she shall submit to the head of the Department a certificate ' i ed by the employee stating the nature of the child, parent, ' r ousehold member's sickness. If the sickness continues for more a three calendar days, no further sick leave shall be granted unles o until a physician is consulted. The sick leave may be continued ro and include the day of consultation, but only if a certificate si ne by the physician certifying to the nature and period of the per on's sickness is submitted and approved by the head of the departmen a d forwarded to the Personnel Office. 27.3 No sick leave shall be grant d or the above reasons unless the employee reports to his/her ep rtment head the necessity for the absence not later than one-h lf hour after his/her regularly scheduled time to report for wo k, unless he/she can show to the satisfaction of the departme t ead that the failure to report was excusable. 27.4 An employee shall be paid un er the provisions of this paragraph only for the number of days or ho rs for which he/she would normally have been paid if he/she had not ee on sick leave.
