Dear Members of the City Co n il:
Our office represents m rican Linen Supply Company in
connection with a special a s ssment scheduled to be levied
against their former proper y on May 2, 1989. The property at
issue, which was acquired b nDOT at the end of 1988, is located
at 219 Fifth Street West in S . Paul. A more detailed
description of the property, nd the proposed assessment, is
contained on the assessment n tice attached hereto. I am writing
to formally object to the a s ssment, and to request
reimbursement of a check pr v ously issued to the City of
St. Paul, in the amount of 6 739.83, in connection with this
assessment.
By way of background, n OT acquired American Linen's
property in December 1988 f r highway purposes. As a part of the
settlement, MnDOT tendered heck to American Linen for the
purchase price. The check 1 o named the City of St. Paul as a
payee, in case there were y unpaid taxes or assessments. All
taxes and assessments, how e , were paid up to date.
Nevertheless, because f the pending special assessment, the
City refused to endorse th c eck unless American Linen paid the
assessment in full, in adv c , before it was even levied, and
even though American Linen o longer owned the assessed property.
Under this duress, America L nen did issue a check to the City.
For these reasons, we b ect to the assessment and request a
refund in the amount of $6,73 .83 . We believe the City had no
authority to require Ameri n Linen to pay the assessment at that
time, since the assessment a not been levied and was not then a
lien against the property.
We further object to e assessment on the grounds of
unequal assessment and tha t e levy exceeds the benefit, in
order to preserve our righ s n this connection.

Dear Mr. Gunn:
I have been requested by the Sa'nt Paul City Council to reply
to your letter of May l , 198 . I have reviewed the file and
determined that due to the h za dous condition of the sidewalk
adjacent to your client' s pr pe ty, a final order to repair was
adopted by the City Council n une 25, 1987. City records would
show that a "pending" irnprov me t and assessr�7erii, was to be Ievied
against your client ' s proper y s of this date. The sidewalk was
replaced on September 25, 19 7. During this time your client was
occupying the premises adjac nt to the sidewalk. Staff is unaware
of any objections by America L nen to this proposed improvement.
Per your letter to the Council , American Linen sold this property
to the State in December, •198 or $1 .875 million dollars. The
assessment for the sidewalk i p ovement was not officially levied
until May 2, 1989.
In our experience, the paymen f "pendings" in land transactions
between private parties is re o ved through negotiations between
the parties. Apparently .this w s not covered in your negotiations
with the State.
In this instance the State ma e the City a co-payee in order to
guarantee payment of all outs a ding assessments and service changes.
We exercised our right to rec i e payment for the sidewalk improve-
. ments that had been in place o nearly fifteen months at the time of
the sale of your client ' s pro e ty by refusing to sign off on the
check until we received our p y nt.
