Officers confirmed that the individual, Frank Lopez, was only 20 years of age. They then went inside the bar, where they saw a large group of people in the back, several of whom ran out the back door when they saw the officers. Seated at two tables were a group of people who appeared very young. Officers identified Sherise Blair, 20 years of age, who was seated with a drink in front of her which police determined was oranae juice and vodka. Blair stated she was watching the drink for somebody, but couid not tell the officers who. Next to her was an individual identified as Golden Reed, 19 years of age, who was seated with a beer in front of him at the tabie. Reed stated the beer was not his, but he did not identify anyone for the officers. OfSicers spoke to the bartender, who stated that he was unaware of any minors in the bar. These acts constitute violations of section 409.08 of the Sa9nt Paul Legislative Code, as Fvell as sate law, Minn. State § 340A.503 (1994). Page 2 Arlington Pub September 10, 1999 a`l-��5a Since this is your first violation, the licensing office will recommend a$500.00 fine, pursnant to St. Paul Legislative Code §409.26. At this time you have three options on how to proceed: 1. If you do not dispute the above facts and do not wish to have a public hearing, you wili need to pay the recommended fine for this violation. If this is your choice, you should make payment directly to the Office of License Inspections and Environmental Protection, Room 300 Lowry professionai Building, 350 Saint Peter Street, Saint Paul, Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the fine will be considered to be a waiver of the heazing to which you aze entitled. An envelope has been provided if this is your choice. 2. Alternatively, if you do not dispute the above facts, but wish to have a public hearing before the Saint Paul City Council, you will need to send me a letter with a statement admitting the violation and requesting a heazing by Tuesday, September 21, 1999. The matter will then be scheduled before the City Council for a public hearin� to determine what penalty, if any, to impose. You will have an opportunity to appeaz before the Council and make a statement on your own behalf as to the penalty to be imposed. 3. If you do dispute the above facts, a hearing will be scheduled before an Administrative Law Judge. At that heazing both you and the City will be able to appear and present witnesses, evidence, and cross-examine the other's witnesses. The St. Paul City Councii will ultimately decide the case. Please let me know in writing no later than Tuesday, September 21, 1999 how you wish to proceed. If you have not contacted me by September 21,1999, I will assume that you are not contesting the facts and will schedule this matter for a hearing before the City Council. Officers confirmed that the individual, Frank Lopez, was only 20 years of age. They then went inside the bar, where they saw a large group of people in the back, several of whom ran out the back door when they saw the officers. Seated at two tables were a group of people who appeared very young. Officers identified Sherise Blair, 20 years of age, who was seated with a drink in front of her which police determined was oranae juice and vodka. Blair stated she was watching the drink for somebody, but couid not tell the officers who. Next to her was an individual identified as Golden Reed, 19 years of age, who was seated with a beer in front of him at the tabie. Reed stated the beer was not his, but he did not identify anyone for the officers. OfSicers spoke to the bartender, who stated that he was unaware of any minors in the bar. These acts constitute violations of section 409.08 of the Sa9nt Paul Legislative Code, as Fvell as sate law, Minn. State § 340A.503 (1994). At this time you have three options on how to proceed: 1. If you do not dispute the above facts and do not wish to have a public hearing, you wili need to pay the recommended fine for this violation. Officers confirmed that the individual, Frank Lopez, was only 20 years of age. They then went inside the bar, where they saw a large group of people in the back, several of whom ran out the back door when they saw the officers. Seated at two tables were a group of people who appeared very young. Officers identified Sherise Blair, 20 years of age, who was seated with a drink in front of her which police determined was oranae juice and vodka. Blair stated she was watching the drink for somebody, but couid not tell the officers who. Next to her was an individual identified as Golden Reed, 19 years of age, who was seated with a beer in front of him at the tabie. Reed stated the beer was not his, but he did not identify anyone for the officers. OfSicers spoke to the bartender, who stated that he was unaware of any minors in the bar. These acts constitute violations of section 409.08 of the Sa9nt Paul Legislative Code, as Fvell as sate law, Minn. State § 340A.503 (1994). At this time you have three options on how to proceed: 1. If you do not dispute the above facts and do not wish to have a public hearing, you wili need to pay the recommended fine for this violation. If this is your choice, you should make payment directly to the Office of License Inspections and Environmental Protection, Room 300 Lowry professionai Building, 350 Saint Peter Street, Saint Paul, Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the fine will be considered to be a waiver of the heazing to which you aze entitled. An envelope has been provided if this is your choice. 2. Alternatively, if you do not dispute the above facts, but wish to have a public hearing before the Saint Paul City Council, you will need to send me a letter with a statement admitting the violation and requesting a heazing by Tuesday, September 21, 1999. WE WENT TO THE AREA OF PAYNE AND MINNEHAHA AT ABOUT 2330 HRS BECAUSE OF COMPLAINTS AND OBSERVATIONS BY OFFICERS OF DRUG DEALING AND LOITERING IN FRDNT OF BAILEYS BAR. WE DROVE AROUND IN AN UNMARKED SQUAD AND SAW 3-4 PEOPLE IN FRONT OF THE BAR ENTRANCE COMING AND GOING FOR SEVERAL MINUTES. WE THEN DROVE UP AND JUMPED OUT ON THE GROUP. IN THE GROUP WE FOUND LOPEZ, FRANK. HE WAS OBVIOUSLY INTOXICATED AND ADMITTED TO BEING DRUNK. HE TOLD US HE WAS DRINKING AlL NIGHT IN BAiIEYS BAR. HE WAS TAGGED # 99315628 FOR UNDERAGE CONSUMPTION. WE THEN WENT INTO THE BAR TO SPEAK WITH THE BARTENDER. I. NOTICED A LARGE GROUP OF PEOPLE IN THE BACK OF THE BAR. I WALKED BACK AND SEVERAL OF THEM RAN OUT THE BACK DOOR. I WALKED UP TO TWO TABLES WITH VERY YOUNG APPEARING PEOPLE SEATED THERE. TNEY ARE SkERISE NtCOLE BLA(R 7-12-79 AND GOLDEN REED '1-31-80. - SHERISE HAD A DRINK DIRECTLY IN FRONT OF HER. i ASKED WHAT IT WAS AND SHE SAID IT WAS ORANGE JUICE. i SIPPED IT AND FOUND IT TO BE A SCREWDRIVER. I COULD TASTE THE VODKA IN IT. SHE THEN SAID IT WAS NOT HERS AND THAT SHE WAS WATCHING IT FOR SOMEONE ELSE. I ASKED WHO AND SHE DID NOT SAY. SHE HAD A ILLINOIS PIC ID. 1 THEN SPOKE TO GOLDEN REED 1-3'I-80. I ASKED HOW OLD HE WAS AND HE SAID 21. I TOLD HIM I DID NOT BELIEVE HIM. HE THEN SAID HE WAS '19. HE HAD A CAN OF BEER IN FRONT OF HIM AT THE TABLE. HE DENIED IT WAS HIS. THE BEER WAS HALF EMPTY. I THEN SPOKE TO THE BARTENDER, CARL TASHNEY. HE SAID THAT HE WAS NOT AWARE OF ANY MINORS IN THE BAR. HE SAID IT IS HARD FOR HIM TO CONTROI THE BAR BECAUSE HE WORKS BY HIMSEIF. HE SAID HE CANNOT MONITOR PEOPLE COMING AND GOING OUT THE BACK DOOR WHEN THE BAR IS BUSY.
