Property l�own to the enforc nt officer. The notice and order informed these
parties that the two and one- lf story, wood frame, single family house
located on the Subject Propert i an abandoned building and a nuisance
pursuant to Sections 45.01, S . 1 and 45.02, Subd. 11 of the Saint Paul
Legislative Code. The August 0, 1988 order also had attached to it a list of
deficiencies regarding the hou e n the Subject Property, said list is attached
and incorporated as part of th s esolution; and
Wf�REAS, the November 2 , 988 order informed all owners, interested
parties and responsible partie t t they must either repair the structure on
the Subject Property by correc in the list of deficiencies or demolish the
structure, either action to ta e lace by January 29, 1989.
WHEREAS, no action has e taken regarding com�liance with the November
29, 1988 notice and order, an as a result the Division of Public Health
requested that a public heari scheduled to take place on Tuesday, April
25, 1989 for the City Council o onsider the advisability and necessity of
ordering the correction of th n 'sance condition or in the alternative
consider the demolition and r 1 of this house; and
Wf�REAS, the above ref re ed owners, interested parties and responsible
parties have been served noti accordance with the provisions of Chapter 45
of the Saint Paul Legislative C of the time and purpose of the April 25,
1989 hearing before the Counc'l;
WHEREAS, a hearing was he d before the Saint Paul City Council on April
25, 1989 and all testirnony an e idence was considered by the Council.
NOW THEREFORE, BE IT R SO VED, that based upon all of the testimony and
evidence presented at the Apr 1 5, 1989 hearing, the Saint Paul City Council
hereby adopts the following F nd ngs and Order concerning the house at 851
Dayton Avenue:
1. That in July of 19 5 he house located on the Subject Property was
determined to be vacant and o n to access. The house has remained vacant and
has been either open or board ince July of 1985.
2. That since July of 1 85 the City of Saint Paul has on n�erous
occasions issued orders to th o ers to make this house secure and not
accessible. On nLUnerous occa io s, because of the inaction on the part of the
owners, the City has had to h re a private contractor to make the house secure
and not open to access.
3. Since July of 1985 t e City has on nimlerous occasions had to abate
nuisances existing on the ext ri r property areas.
4. That the owners of th Subject Property have repeatedly failed to
register and pay the vacant il ing fee for this structure as required by City
ordinance.
5. That there are n a have been since July of 1985, multiple
exterior Housing Code or Bui i Code violations in existence at the Subject
Property.

6. That the owners, inte s parties and responsible parties of this
house are as previously stated 'n his resolution. These individuals have been
properly served notice of the r� 25, 1989 hearing concerning this house.
7. That on November 29, 98 an Abandoned Building Notice was sent to the
owners, interested parties and re nsible parties ordering these persons to
either demolish the house or e repairs and correct the list of deficiencies
by January 29, 1989.
8. That the order of Nov 29, 1988 have been disregarded by the
owners, interested parties and re ponsible parties.
9. That the two and one- 1 story, wood frame, single family house
located on the Subject Propert i an abandoned building under Section 45.01,
Subd. l, of the Saint Paul Leg sl tive Code in that it is "a building or
portion thereof which has s occupied for longer than one (1) year" and
during that period of time it s been either "unsecured", "boarded", or has
had "multiple exterior Housing e or Building Code violations".
10. That the two and one- 1 story, wood frame, single family house
located on the Subject Propert i a nuisance as defined under Saint Paul
Legislative Code Section 45.02 S . 11, in that it is an abandoned building
located in the City of Saint P ul that has created a dangerous or unhealthy
condition or which threatens t e lic peace, health, safety or sanitary
condition of the City or which is offensive or has a blighting influence on the
conmunity.
11. That the costs of nt of this nuisance are estimated to exceed
two thousand dollars ($2,OQ�. ) r the abatement involves demolition of a
building other than a structu cessory to a residential building.
ORDER
The Saint Paul City Coun il ereby makes the following order:
1. The above referenced o ers, interested parties and responsible
parties and their assigns sha 1 ke the Subject Property safe and not
detrimental to the �blic pea e, health, safety, and welfare and remove its
blighting influence on the c ity by rehabilitating this house and
correcting those deficiencies se forth in the list previously referenced in
accordance with all applicabl c es a.nd ordinances, or in the alternative by
demolishing the house and fil in the site in accordance with all a�licable
codes and ordinances. The re ab litation or demolition of the house must be
completed within thirty (30) y of the date of mailing of this resolution.
2. If the above correct ve action is not cc�mpleted within the thirty (30)
day time period, the proper C ty officials of the City of Saint Paul are hereby
authorized to take whatever s e are necessary to demolish this house and fill
the site and charge the costs in urred against the Subject Property pursuant to
the provisions of Section 45. 8 f the Saint Paul Legislative Code.

On November 29, 1988, the Divisio o Public Health mailed an order to the
owners, interested parties and re sible parties of this building requiring
that the building be either repai ed by correcting the attached list of
deficiencies, or demolished on or be ore January 29, 1989. Inasmuch as the
orders have not been completed to th satisfaction of the Division and the
continued abandoned condition of he building contributes a blighting influence
and potential hazard to the neig r ood, it is the recomnendation of the
Division that the City Council s resolution ordering the owners,
interested parties and responsib rties to either repair or demolish the
building in a timely manner to t e tisfaction of the City.
In the event the owners, interes ed parties or responsible parties fail to
comply with the Council Resoluti n, the Division of Public Health should be
authorized to demolish the build ng and assess all costs incurred in the
demolition against the real esta s a special assessment to be collected in
the same manner as taxes.

additions to an electrical system 're upgrading of the service size to
current National Electrical Code ( .E C. ) requirements. Some pl��nbing
