Wf�REAS, no action has been ke regarding compliance with the December 8, 1988 notice and order, and as r sult the Division of Public Health requested that a public hearing heduled to take place on Thursday, April 18, 1989 for the City Council to on ider the advisability and necessity of ordering the correction of the nu sa e condition or in the alternative consider the demolition and remov 1 f these structures; and WHEREAS, the above referenced o ers, interested parties and responsible parties have been personally serv otice of the time and purpose of the April 18, 1989 hearing before the Co il; Wf�REAS, a hearing was held fo e the Saint Paul City Council on April 18, 1989 and all testimony and ev' e e was considered by the Council. NOW, THEI2EFORE, BE IT RESOLVE t t based tzp�n all of the testimony and evidence presented at the April 1 , 89 hearing, the Saint Paul City Council hereby adopts the following Findi s nd Order concerning the structures at 787 Hague Avenue: 1. That in April, 1986, the u located on the Subject Property was determined to be vacant and open a cess. The house has remained vacant and ha.s been either open or boarded s' ce April, 1986. 2. That since April, 1986, t C'ty of Saint Paul has on several ocr_asions issued orders to the o rs to make these structures secure and not accessible. On several occasions, ause of the inaction on the part of the owners, the City has had to hire a pr vate contractor to make the buildings secure and not open to access. 3. That there are now and hav n since April, 1986, m�zltiple exterior Housing Code or Building Code viol ti ns in existence at the Subject Property. 4. That the owners, interest rties and responsible parties of these structures are as previously stat i this resolution. These individuals have been properly served notice o t e April 18, 1989 hearing concerning these structures. 5. That on December 8, 1988 n ndoned Building Notice was sent to the owners, interested parties and r sible parties ordering these persons to either demolish the buildings or repairs and correct the list of deficiencies by February 8, 1989. 7. That the order of Dec , 1988 has been disregarded by the owners, interested parties and responsibl rties. 8. That the two-story, wood r , duplex located on the Subject Property is an abandoned building under S ti n 45.01, Subd. 1, of the Saint Paul Legislative Code in that it is " b 'lding or portion thereof which has stood unoccupied for longer than one fl) y r" and during that period of time has been either "unsecured" or "boar " or has had "multiple exterior Housing Code or Building Code violations". 9. That the two-story, wood r , fire damaged, duplex located on the Subject Property is a nuisance as de ined under Saint Paul Legislative Code Section 45.02, Subd. 11, in that 't s an abandoned building located in the City of Saint Paul that has crea dangerous or unhealthy condition or which threatens the �blic peace, h lth, safety or sanitary condition of the City or which is offensive or has a lighting influence on the conmunity. 10. That the deteriorated, de c ed garage located on the Subject Property is a dangerous structure under ti n 45.01, Subd. 3 of the Saint Paul � Legislative Code in that it is "a st cture which is potentially dangerous to persons or property" including be ng "in danger of partial or cc�mplete collapse." 11. That the deteriorated, de c ed garage located on the Subject Property is a nuisance as defined under Sa nt Paul Legislative Code Section 45.02, Subd. 10, in that it is a dangero s tructure located in the City of St. Paul that has created a dangerous or lthy condition or which threatens the public peace, health, safety or ni ry condition of the City or which is offensive or has a blighting infl en e on the community. 14. That the costs of abatemen o these nuisances are estimated to exceed two thousand dollars t$2,000.00) r he abatement involves demplition of a building other than a structure a ce sory to a residential building. ORDER The Saint Paul City Council h r y makes the following order: 1. On December 8, 1988, the Division o lic Health mailed an order to the owners, interested parties and re s' le parties of these buildings requiring that the buildings be either repair , y correcting the attached list of deficiencies, or demolished on or o February 8, 1989.
