Christine Rozek reported this is an application for Wine On Sale, Malt On Sale (Strong), Restaurant (A), and Sidewallc Cafe Licenses for Capitol View Cafe, Inc., 637 Smith Avenue South. The current owner has applied for corporation status; therefore, this is a new application. Once the license is granted, liquor liability insurance will be needed from the licensee. Environmental Health needs to make one final inspection before the licenses will be issued. At this point, there is no pending adverse action against the licensee. Tn the past yeaz there have been two police calls to this address, and both have been for false security alarms. The recommendation from LIEP is for approval. Mr. Strathman asked for clarification on the sidewalk license. Ms. Rozek responded it does not allow for the service of wine or beer on the sidewalk. Cary Kimmel, 405 Baker Street West, appeazed and stated the neighborhood already has a problem with pazking due to another business around the corner that stays open untii 9 p.m. There aze times when a person has to walk a distance to their home from their vehicle. If Capitol View Cafe were to stay open late, that would exacerbate the present problem. Mr. Kimmel wondered if this condition could be placed on the license. Ms. Rozek responded she is not aware of a liquor license that has restrictions on the hours of operation because State law allows service until 1:00 am. Cary and Liz Kiimnel, 405 Baker Street West, wrote about the following concerns: visibility is unpaired when vehicles park in front of the business, tabtes on the sidewalk obstruct vision, no on site pazking for the business, increased parking pressure in the neighborhood, strong alcohol and its influence on human behavior. Angela and Leonazd Amacher, 409 Baker Street West, wrote about the following concerns: late night noise, debris, urinating on street and lawns, fighting, hollering, many police calls, parking pressure, and loitering.
