STAFF PRESENT: Cbristine Rozek, License, Inspections, Environmental Protection (LIEP)
The meeting was called to order at 4:04 p.m.
Gerry Strathman explained this meeting is to heaz objections to licenses for Capitol View Cafe at
637 Smith Avenue South.
Christine Rozek reported this is an application for Wine On Sale, Malt On Sale (Strong),
Restaurant (A), and Sidewallc Cafe Licenses for Capitol View Cafe, Inc., 637 Smith Avenue
South. The current owner has applied for corporation status; therefore, this is a new application.
Once the license is granted, liquor liability insurance will be needed from the licensee.
Environmental Health needs to make one final inspection before the licenses will be issued. At
this point, there is no pending adverse action against the licensee. Tn the past yeaz there have
been two police calls to this address, and both have been for false security alarms. The
recommendation from LIEP is for approval.
Mr. Strathman asked for clarification on the sidewalk license. Ms. Rozek responded it does not
allow for the service of wine or beer on the sidewalk.
Cary Kimmel, 405 Baker Street West, appeazed and stated the neighborhood already has a
problem with pazking due to another business around the corner that stays open untii 9 p.m.
There aze times when a person has to walk a distance to their home from their vehicle. If Capitol
View Cafe were to stay open late, that would exacerbate the present problem. Mr. Kimmel
wondered if this condition could be placed on the license. Ms. Rozek responded she is not aware
of a liquor license that has restrictions on the hours of operation because State law allows service
until 1:00 am.
Mr. Strathman asked do his concerns rise to the level that he thinks the license should be denied.
Mr. Kimmel responded he is against substances in light of a restaurant and a bar; however, the
owners have been decent neighbors, and he has nothing personal against them.
He received ttuee letters regarding the licenses, stated Mr. Strathman. Cary and Liz Kiimnel,
405 Baker Street West, wrote about the following concerns: visibility is unpaired when vehicles
park in front of the business, tabtes on the sidewalk obstruct vision, no on site pazking for the
business, increased parking pressure in the neighborhood, strong alcohol and its influence on
human behavior. Angela and Leonazd Amacher, 409 Baker Street West, wrote about the
following concerns: late night noise, debris, urinating on street and lawns, fighting, hollering,
many police calls, parking pressure, and loitering. Chazlette House and Dawn Reding, Smith-
Dodd Association, wrote Nick Ramirez is a member in good standing and the cafe has been a
positive addition to the neighborhood and business community on the West Side.

Pat and Nick Ramirez, owners, appeazed. Ms. Ramirez stated this is a faznily owned business,
they have been there six yeazs, and are currenfly open from 7:00 am. to 230 p.m. They would
like to estend their hours; the latest they will be open is 9:00 pm. They are not applying to be a
baz; the wine and beer will compliment meals.
Gerry Strathman asked do they have any observations about the concerns they have heard. Ms.
Ramirez responded they could go to some businesses in the azea to see if customers can park
there. Right now, the rental hail has taken all the pazking so Capitoi View does not do much
business when the rental hall is open.
Mr. Strathman asked about visibility. Ms. Raxnirez responded they aze planning on a pafio next
summer and wouid then eliminate using the front sidewalk. Mr. Ramirez responded the front
now has two tables with umbrellas. They do not have a lot of business in the front, but it will
provide visibility to let people lrnow they aze a restaurant. There are parking problems. The
bank is not willing to rent them parking space. They might buy properry far additional parking.
How will the business look different, asked NIr. Strathman. Mr. Ramirez responded the tables
and umbrellas were out approximately ten times this sununer. Mr. Kimmel stated it is dangerous
because it is hard for drivers to see ahead or behind it. Neighbors have gone around the azea to
auoid the intersection. His kids have to go out in the street riding their bikes when tables are on
the sidewalk. Mr. Kimuiel suggested smaller tables. Ms. Ramirez responded they could do that.
Mr. Strathman asked about staying open later. Mr. Ramirez responded that is not in their piaus.
Annette Roblis, West Side Neighborhood Association, appeared and stated the Ramirez family
has been in the community a long time. The association has no objections to the license.
Gerry Strathman recommended approval of this application. All requirements have been met.
The owners have shown the appropriate level of respect and sensitivity to the neighbors.
