Dear Sir or Madam:
At today's meeting of t e City Council 's Public Works
Committee, I objected to t e City's assessment for grading
and paving Benson Avenue i ront of our property� which was
in the amount of $13, 263.7 .
I was instructed to p t my objection in writing for the
purpose of preserving our i ht to appeal the assessment if
ratified by the Council at i s hearing on March 28, 1989.
Please take notice that su h an appeal is planned if the
assessment is ratified as t stands.
We were dismayed upon r eiving the assessment for several
reasons, not the least of hi h were that we were not signatory
to the petition that initi t the grading and paving and,
further, that we never rec i d actual notice of such
improvements until they be a .
We appreciate that th i provements were completed well
under-budget and that we a e ffered the option to pay for them
in installments. But our ai grievance is that our assessment
is still disproportionate o he actual benefit we have
derived from these improve en s.
The aesthetic value o t e improvements is nominal to us;
our business provides its er ices on location for clients
throughout the country, an o ly rarely does one of them ever
have to call on us persona ly.
As far as improved mo il 'ty, our drivers and employees
were never hindered in get in to and from the physical plant
prior to grading and pavin . In reality, the only real benefit
to our property would be a y 'ncrease in its value, which surely
must be modest in comparis n o the assessment.

On the contrary, we e 1 that the paving of Benson Avenue
has been a liability to u . We have experienced a terrific
increase in the number of t efts from our yard� which the St .
Paul Police informed us i ue to the increased traffic that
now passes by us on Benso . We have since tried concealing
the yard with an expensiv oncrete block, barbed-wire fence
along Benson. Yet since ec mber 1988 alone, we have had to
report over $8 ,000 worth f stolen equipment and supplies to
the police.
Although the increas d raffic we now have in front of
us can be attributed in p rt to tne new rort Roau A�ari:i��eni.s
just up the street (which w understand, were responsible for
the petition to grade and pa e in the first place) , we contend
that much of it is direct y result of the improved access
across Benson effected by th grading and paving.
Sec. 14.01 of the Ci y harter requires that "in no case
shall the amounts assesse e ceed the benefits to the
property" from the improv me ts. Sec. 14.01 .4(2) adds that
if the assessment exceeds "'t e actual benefits to the
property, " there is basis fo an appeal (emphasis added) .
Although they are di fi ult to quantify, we think that
the equitable factors pre io sly mE�ntioned, now that they have
been raised, should prope ly be considered in determining what
actual benefits were conf rr d on our property by the improve-
ments. We therefore are re pectfully demanding a reassessment
or new assessment and wou d ppeal the Council 's ratification
�f the current assessment aG ;t v�anas.
