An ordinance amending Chapt r 0 of the Saint Paul Legislative Code
pertaining to zoning for th C ty of Saint Paul and the zoning maps
thereof.
WHEREAS, Pursuant to Minnesota Statu es, § 462.357 and § 64.400 of the
Legislative Code, Bruce Nelson duly eti ioned to rezone the west 50' of 1272
Point Douglas Road South located on he east side between Ogden and Carver
from B-2 to R-1 for the purpose of plat ing a parcel that is within two
separate zoning districts, the petition having been certified by the Planning
Division on December 13, 1988, as ha in been consented to by at least
two-thirds of the owners of the area 'of the property to be rezoned, and
further having been consented to by t least 67% of the owners of the property
situated within 100 feet of the tota c ntiguous property within one year
preceding the date of the petition; nd
WHEREAS, The Zoning Committee on Jan ar 19, 1989, conducted a public hearing
for the purpose of considering the r zo ing petition, and pursuant to Section
107.03 of the Administrative Code, s bm tted its recommendation to the
Planning Commission that the petitio b granted; and
WHEREAS, The Planning Commission con id red the rezoning petition at its
meeting held on January 27, 1989, an r commended that the City Council
approve the petition; and
WHEREAS, Notice of a public hearing ef re the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
February 6, 1989, and notices were d ly mailed to each owner of affected
property and property situated wholl o partly within 350 feet of the
property sought to be rezoned; and
WHEREAS, A public hearing before the Ci y Council , having been conducted on
February 23, 1989, where all interes ed persons were heard, and the Council
having considered all the facts and ' ec mmendations concerning the petition;

On January 19, 1989, the Zoning o ittee of the Plannir.g Commission held a
public hearing on this rezoning. Th petitioner testified. At the close of
the public hearing, the Committee 'vo ed 8 to 0 to approve the rezoning based on
staff findings.
On January 27, 1989, the Planning Co .�ission upheld the Zoning Committee's
recommendation on a unanimous voi e ote .
This rezoning is scheduled to be ea d bv the City Council on February 23,
1989. Concurrently, the Council il also consider spproval of a final plat
for this property. Please notify me bv February 22 if ar.v member of the City
Council wishes to have slides of he site presented at the public hearing.

B. SUFFICIENCY: The petition was d ' 1 ed sufficient by the Planning Division on
December 13, 1988; 7 parcels eli ib , 5 parcel-s required, 6 parcels signed.
C. PARCEL SIZE: The property in qu ti n is a smaller SO' by 120' or 6,000 square
foot piece being split from a la e parcel, now 300' by 120' and attached to an
adjacent flag-shaped parcel to t e st and south.
D, EXZSTING LAND USE: The subject op rty is a 6,000 square foot vacant piece of
land. Currently, this piece is rt of a larger parcel of land containing a
plumbing contractor's shop (zone B- ) . This piece would be attached to a
parcel occupied by a single famil r sidence (zoned R-1) . -

F. ZONING HISTORY: In August, 1988, th applicant applied for a lot split of the
subject parcel. Staff determined th t the lot split would create a parcel with
two different zoning districts. e applicant was advised that a rezoning would
be necessary before the lot split co ld be approved.
G. DISTRICT COMMENT: The District 1 Ex cutive Committee sent a letter in support
of the rezoning.

H. FINDINGS:
1. The applicant proposes to split of the eastern 50 feet of a larger 300' by 120'
parcel zoned B-2 (Community Bus ne s) and attach it to an irregular flag shaped
parcel to the south and east zo ed R-1 (One Family Residential) . There is a
plumbing contractor's shop on t e astern portion of the commercially zoned lot
and a single family residence 1 ca ed on the flag shaped lot. The applicant is
the fee owner of the properties an plans no additional development for either
parcel.
2. Section 67.304(a) allows the di 'is'on of lots without platting subject to six
requirements. The proposed lot sp it fails to meet the requirement that "the
division does not result in a s li zoning classification." To rectify this
split zoning classification, th a licant is petitioning to rezone the subject
property to R-1.
3. To the east of U.S. Highway 61, th area is zoned R-1 and is developed primarily
as single family residences on ar lots. There is only one other commercially
zoned property, an auto repair ar e, located on the southeast corner of the
intersection at Carver and Poin D glas Road, approximately 650 feet south of
the sub�ect area.
4. The Comprehensive Plan Land Use ol'cy 4.2-4 states that "the city will continue
to review its present commercia zo ing to ensure that each zoning -
classification reflects uses ap op iate to the intended application of the�
district and each area is appro ri ely zoned for its intended function."
5. The rezoning is in conformance it the District 1 element of the Comprehensive
Plan which strongly discourages co ercial expansion along Point Douglas Road
north of Carver. The rezoning d he companion lot split limits the
opportunity for expansion on the re aining commercially zoned property and thus,
lessens the potential for confli ts with the surrounding residential uses.
6. In conclusion, rezoning the subj ct area to R-1 would be compatible with the
surrounding land uses and is co is ent with the policies of the �ity.
I. STAFF RECOMMENDATION: Based on ta f report findings 1 through 6, staff
recommends approval of the Rezon'ng from B-2 to R-l.

On January 19, 1989, the Zoning Co i tee of the Planning Commission held a
public hearing on this rezoning, e etitioner testified. At the close of
the public hearing, the Committee ote 8 to 0 to approve the rezoning based on
staff findings.
On January 27, 1989, the Planning o ission upheld the Zoning Committee's
recommendation on a unanimous voic v te.
This rezoning is scheduled to be h ar by the City Council on February 23,
1989. Concurrently, the Council w 11 also consider approval of a final plat
for this property. Please notify e y February 22 if any member of the City

public hearing at which all persons pr se t were given an opportunity to be heard
pursuant to said application in accor �nc with the requirements of Section 64.400
of the S�int Paul Legislative Code; a d
i+'�iF.REAS, Saint Paul Planning Commissi n, ased on the evidence presented to its
Zoning Committee at the public hearin a substantially reflected in the minutes,
made the following findings of fact:
1.� The applicant proposes to split o f e eastern SO feet of s larger 300' by 120'
parcel zoned B-2 (Co�unity Busin ss) and attach it to an irregular flag shaped
parcel to the south and east zone R-1 (One Family Residential) . There is a
plumbing contractor's shop on the ea tern portion of the commercially zoned lot
snd a single family residence loc te on the flag shaped lot. The applicant is
the fee owner of the properties a d lans no additional development for either
parcel. - .
2. Section 67 .304(a) allows the divi io of lots without platting subject to six
requ:rements. The proposed lot s li fails to meet the requirement that "the
division does not result in a spl't oning classification. " To rectify this
split zoning classification, the '�pp icant is petitioning to rezone the subject
property to R-1.
3. To the east of U.S. Highway 61, e area is zoned R-1 and is developed primarily
as single family residences on 1 rg lots . There is onl� one other commercially
zoned property, an auto repair g ra e , located on the southeast corner of the
intersection at Carver and Point Do glas Road, approximately 650 feet south of
the subject area. �

4. The Comprehensive Plan Land Use p li y 4.2-4 states that "the city will continue
to review its present commercial on ng to ensure that each zoning
classification reflects uses appr pr ate to the intended application of the
district and each area is appropr at ly zoned for its intended function."
5. The rezoning is in conformance wi h he District 1 element of the Comprehensive
Plan which strongly discourages c m= rcial expansion along Point Douglas Road
north of Carver. The rezoning a t e companion lot split limits the
opportunity for expansion on the e ining commercially zoned property and thus,
lessens the potential for confli ts ith the surrounding residential uses.
6. In conclusion, rezoning the subj ct area to R-1 would be compatible with the
surrounding land uses and is can is ent with the policies of the city.
NOW, THEREFORE, BE IT RESOLVED, by t e aint Pau� Planning Commission that the
petition of Bruce Nelson to rezone e astern 50 feet of the property at 1272 South
Point Douglas Road, more particular scribed as the west SO' of the north 120' of
Lot 2, Block 1, Proposed Plat of La e ddition from a B-2 zoning classification to a
