requested that the legal des ri tion be clarified to read

WHEREAS , this clarifica io would be accomplished by
exchange of quit claim deeds b tween WW II Realty and the

by the City Attorney and Dep r ent of Public Works and con-
sidered at this meeting; now t erefore, be it
RESOLVED by the Council o the City of Saint Paul that
the execution by proper City o ficers of a quit claim deed to
Lot 8 , Block 28 , Rice and Ir i es Addition to St. Paul except
the Northwesterly Twenty (20 eet thereof taken for widenin�
of West Seventh Street and i s delivery to WW II Realty, a
Minnesota general partnershi , and acceptance of a quit claim

Pursuant to the Februar 1 1989 letter of Mr. James T.
Hart, Assistant City Attorne , nclosed is the original of the
proposed Quit C1aim �eed fro t e City r�f St. Paul ta WW II
Realty, a Minnesota general r nership. A1so enclosed is a copy
of the proposed Quit Claim De d from WW II Realty to the City of
St. Paul with regard to this a e property.
The proposed exchange is �� n cesary due to the fact that the
current legal description for 't is property is ambiguous because
the lot and West Seventh Stre t do not lie in a direct east-west
direction. Attached is a cop f the pertinent part of the
survey of this property. The c rent legal description is as
follows :
Lot 8, Block 28, Rice an i vine 's Addition to
St. Paul, exce t the Nor h 0 feet thereof .
An exchange of deeds is ee ed to establish the actual
property owned by the Grantee an the City and to eliminate the
ambiguity caused by the use o t e phrase "North 20 feet" of a
lot which actually lies at a or heasterly angle. Also, the
exchange of deeds is required in order that WW II Realty obtain
title insurance on the proper y n question.
I am simultaneously submi t ng the proposed Quit Claim Deed
to WW II Realty to obtain thei ignature. I will then record
both the deed from the City an he deed from WW II Realty at the
