WHEREAS, public hearings and citi en participation is a cornerstone of open,
fair government and democracy;
WHEREAS, the City of St. Paul has � ell estabiished, natio�aily recognized
system of citizen participation t �t brings people together to improve their
neighborhoods and improve the gov �n ental decisions affecting communities;
and
WHEREAS, Senate File #235 and its �o arison House bill addresses group home
issues such as definitions, dispe 5a1 , and concentration levels. but da not
provide for public hearings nor m �ningful citizen participation;
NOW, THEREFORE, BE IT RESOLVED, t at the City Council of St. Paul re4uests
that the bilis be amended to require pubiic hearing before the state
agency responsible for licensing r sidential facility, with a 60-day
notice to the affected Cortmunity 1a ning District or municipality prior to
the public hearing� and a 30-day ptice to property owners within 350' of
the proposed location of the facil9t prior to the public hearing; and
BE IT FURTHER RESOIVED, that the it of St. Paul lobbyists are directed to
work for the adoption of this ame m t without sacrifice to other sections
of the bili related to dispersal , �o centration and definitions.

WHEREAS. persons with disabilitiesl'ar entitled to live in the teast
restrictive environment, possible, an have a range of residential choices
throughout the region; and
WHEREAS, adequately dispersed, wel - naged community residential facilities
can be good neighbors in their c un'ties;
WHEREAS, overconcentrations of c un ty residential facilities negatively
impact surrounding canmunities and de rive facility residents of the
benefits of heaithy residential en ir nments; and
WHEREA5, existing laws regarding c mm nity residential facilities have come
under increasing criticism for inc p ete definitions of facilities,
unenforceabie concentration limits� 1 ck of comprehensive dispersal
requirements, lack of adequate con ro s over the quality of care provided
and lack of citizen participation 9n tate and country licensing decisions;
and
WHEREAS, testir�ny at city public ea ings on group homes often focus on
programmatic concerns, staffing le el , house rules, security and licensing
issues; and
WHEREAS, neighborhood organization a d citizens have valuable experience in
the locating of corrxnunity residentiai facilities and shouid be weicomed as
part of the decision-making proces ;
