Wf�REAS, the Division of PuL ic Health has issued orders identified as
a "Dangerous Structure Notice" t October 12, 1988 which is attached
and incorporated as part of this Re olution by this reference. This order
was served on all owners, intere t parties and responsible parties of
the Subject Property l�own to th e orcement officer. The notice and
order informed these parties tha�, t e two story, wood frame, fire damaged,
single family house located on t e ject Property is a dangerous
structure and a nuisance pursuan t Sections 45.01, Subd. 3, and 45.02,
Subd. 10 of the St. Paul Legisl ti e Code. The C�ctober 12, 1988 order
also had attached to it a list o d ficiencies regarding the house on the
Subject Property, said list is a ta ed and incorporated as part of this
resolution; and
WHEREAS, the October 12, 198 ' o er informed all owners, interested
parties and responsible parties they must either repair the house on
the Subject Property by correcti e list of deficiencies or demolish
the house, either action to take la e by November 12, 1988.
WEIEREAS, no action has been t�ake regarding com�liance with the
October 12, 1988 notice and order, a d as a result the Division of Public
Health requested that a public h ri g be scheduled to take place on
Tuesday, March 7, 1989 for the Ci y uncil to consider the advisability
and necessity of ordering the cor ec ion of the nuisance condition or in
the alternative consider the demo it'on and removal of this house; and

Wf�REAS, the above referencedlo ers, interested parties and
resp�nsible parties have been per�o lly served notice of the time and
purpose of the March 7, 1989 hear�ing before the Council; and
4Vf�REAS, a hearing was held fo e the Saint Paul City Council on
March 7, 1989 and all testimony a�id vidence was considered by the
Council.
NOW, THEREFORE, BE IT RESOLVE t t based upon all of the test�mony
and evidence presented at the Mar h , 1989 hearing the Saint Paul City
Council hereby adopts the followi g indings and Order concerning the
house at 554 Edmund Avenue:
1. That on April 13, 1988 th h use located on the Subject Property
was determined to be vacant and o � n to access. The house has remained
vacant and has been either open o rded since April of 1988.
2. That since April of 1988 e City of Saint Paul has on several
occasions issued orders to the o r to make this house secure and not
accessible, On several occasions, ause of the inaction on the part of
the owners, the City has had to h re a private contractor to make the
house secure and not open to acce s.
3. That the owners of the S j t Property have repeatedly failed to
register and pay the vacant build'ng fee for this structure as required by
City ordinance.

4. That there are now and I v been since April of 1988, multiple
exterior Housing Code or Buildi�g ode violations in existence at the
Subject Property. �
5. That the owners, intere�t parties and responsible parties of
this house are as previously st�t in this resolution. These individuals
have been properly served notic� o the March 7, 1989 hearing concerning
this house.
6. That the owners, intere�t parties or responsible parties have
been ordered to repair this houSe nd have failed to do so.
7. That on October 12, 198 a ngerous Structure Notice was sent to
the owners, interested parties d esponsible parties ordering these
persons to either demolish the u or make repairs and correct the list
of deficiencies by November 12, 198 .
8. That the order of Octobe.�r 1 , 1988 has been disregarded by the
owners, interested parties and rres nsible parties.
9. That the two-story, �fr , fire damaged, single family house
located on the Subject Property s dangerous structure under Section
45.01, Subd. 3, of the Saint Pau�l gislative Code in that it is "any
structure which is potentially cl�ng rous to persons or property including
but not limited to", "a structur� w ich is in danger of partial or
complete collapse".
10. That the two-story, wood' fr , fire damaged, single family house
located on the Subject Property �s nuisance as defined under Saint Paul
Legislative Code Section 45.02, . 10, in that it is a dangerous
structure located in the City of Sa nt Paul that has created a dangerous
or unhealthy condition or which hr atens the public peace, health, safety
or sanitary condition of the Cit o which is offensive or has a blighting
influence on the conmunity.
11. That the cost of abatemen�. o this nuisance is estimated to exceed
two thousand dollars ($2,000.00) !or the abatement involves demolition of a
house other than a structure acc�ss ry to a residential building.

The Saint Paul City Council er by makes the following order:
1. The above referenced own Ys, interested parties and responsible
parties and their assigns shall the Subject Property safe and not
detrimental to the public peace, he lth, safety, and welfare and remove
its blighting influence on the c ity by rehabilitating this building
and correcting those deficiencie � s forth in the list previously
referenced in accordance with al a licable codes and ordinances, or in
the alternative by demolishing t ' ilding and filling the site in
accordance with all applicable c es and ordinances. The rehabilitation
or demolition of this house must ompleted within thirty (30) days of
the date of mailing of this resol ti n.

The single family house meets one or #nor of the ooriditions that constitute a
dangerous structure, as defined in Ch� r 45 of the Saint Paul Legislative
Code.
On October 12, 1988, the Division of �uL ic Health mailed an order to the
aaners, interested parties and respo ib e parties of these buildings requiring
that the buildings be either repaired correcting the attached list of
deficiencies, or demolisl�d on or bef re November 12, 1988. Inasnx�ch as the
orders have not been ca�leted to the sa isfaction of the Division and the
continued dangerous condition of the ings contril�utes a blighting
influence and potential hazard to the ne'ghborhood, it is the recamnenclation of
the Division that the City Council pa s resolution ordering the owners,
interested parties and responsible pa i s to either repair or dern�lish the
b�tilding in a timely manner to the sa is ction of the City.

The_Division of Public Health has d te 'ned that the above-noted building
is a dangerous structure, which Cha e 45 of the St. Paul Legislative
Code defines as: -
"any structure which is potenti 11 dangerous to_persons or property
including but not limited to:
(a) a structure which is in da ge of partial or complete collapse;
or
(b) a structure w�hich has any xt rior parts such as chimneys, eaves,
porches, siding, -railings, or trim which are loose or in danger
- of falling; or
(c) a structure which has any s such as porches, stairs, ram�s,
rails, balconies, or roofs wh'ch are accessible and which are
either collapsed, in dange o collapsing, or unable to support a
. person." .
The Ordinance further states that a da gerous structure is a nuisance and
_ it may be ordered torn dawn by the it . If you do not want to have the
City-begin action to have the build ng torn down you are hereby notified
that th� attached list of deficienc es must be repaired or you must have
the building torn down on or before No ember 12, 1988. Any repair or
delnolition naist be comq�leted in acc r nce_with all applicable laws.
If the w�ork is not com�leted or if �u have not had the building torn down
_ by the above date, the Division of ic Health will refer this matter to
the City Council to receive authori y raze the b�uilding and charge all
costs incurred against the real es te as a special assessment to be
collected in the same manner as tax . The City Council will schedule a
public hearing to consider if the b '1 ing should be torn down. If a
public hearing becomes necessary, y ill be notified of the time and
date of the hearing and you will be al owed to present evidence to the

orders have not been caY�►leted to th tisfaction of the Division ar�d the
continu�ed dangerous condition of the ldings contributes a blighting
infl�nce and potential hazard to ighborYiood, it is the recam�endation of
� the Division that the City �uicil ss a re�olution ordering the awners,
interested parties and responsible 'rt es to either repair or demolish the
' building in a timely manner to the i faction of the City.

If the work is not co�leted or if o have not had the building torn down _
by the above date, the Division of lic Health will refer this matter to _
the City Council to receive author �y to raze the building and charge all
