Chairman Glassman called h meeting to order at 1 :30 p.m.
January 10. 1989. He welc m d the appellants and explained the
procedures , stating the wha he board does is recommends action
to the City Council .
1 . Approval of the minutes f the December 13, 1988 meeting as
submitted in writing.
Motion made by David Schultz t approve minutes of the December 13,
1988 meeting. Seconded b Robert Viering. MOTION CARRIED
UNANIMOUSLY.

Chairman Giassman. stated th t he attended a City Council meeting
regarding a discussion on th inleader Ordinance. There were
two proposals presented. O e, the rainleader issue would be
handled like any violation t at comes before the board. Second,
the appellant would have to p al direct)y to the Council .
Mr. Glassman was asked to c ' nt. Both proposals started out by
saying, if an extension of ti e is not granted by the Director,
then the owner may appeal th t ecision to the Board of Appeals &
Review. The Board would ha e he right to give an extension of
time.
Mr. Glassman requested th t he language on the ordinance be
changed to give the Boar t e right to grant a variance or
anything that the Board felt wa correct.

��ntil the ordinance is clearly defined, the Board will not be
hearinq any appeals regarding rainleaders.
It was decided that after clarification of the ordinance, that the
cases that were before the board and were denied a variance. wouid
be reviewed aaain.

Chairman Glassrnan reminded the Board Members that there has not
been a replacement appointed for Mr. Gienn Gausman, who
represented the Engineering Profession. Mr. Gausman's term
expired November , 1988.
Chairman Glassman suggest�d to the Board that maybe the board
should request to the City Council that the name of the Board be
changed. He feels that citizens are confused as to the nature of
this board, what does it realiy do? lt was unanimously agreed
by all the board members present, to write a letter to Council
President James 5cheibel to consider a name change for the Board
of Appeals & Review.

2. CASE HEARINGS:
CASE NO: PROPERTY APPEALED APPELLANT:
134-88-H 1493 Rice Street Robert Bolin, Sr.

APPEARANCE : Robert Bolin, Jr.
5UBJECT: Appellant is appealing the vacant building registration
fees and penalties in the amount of $360.00.
PROCEEDINGS: Robert Bolin represented his father. Financialiy
his father cannot afford to pay the fees as he is on a very limited
income. The family is trying to acquire title of the property as
the property was in the mothers name and she is deceased. The
father would like to get a low interest loan. The interior of the
building needs a sink, tub, toilet, water heater and smoke
detectors in order to be occupied.
Jim Prili , from Public Health, stated that the building has been
vacant and boarded for over a year. The fees are $360.00. The
fees on the building go along with the owner, but not as an
assessment against the property.

of the registration fees f r vacant building, but to waive the

SUBJECT: Appellant is reques i g a variance on the number of
handsinks , as per letter dat d October 7 , 1988.
PROCEEDINGS Ms. Stangeland h s owned the building for 10 years.
A year end a half ago Ms. St n eland received some rehab money to
bring the building into code c mpliance.
Carolyn Sheperd, from Public Health stated that there are two
sinks for 23 occupants . Th ath situation is two toilets , one
tub, one shower and one hand sink in the corridor on each floor.
Mr. Tilton stated that th uilding has a variance permitting
substandard use of the build"n . What the board is finding out
is that the building does no ave the facilities that apparently
everyone thought the buil i g had. It appears that what is
happening is a request for sub-substandard building. Mr.
Tilton feels that the board a not allow this kind of a situation
to exist.
BOARD ACTION: Motion made b ill Tilton to grant a variance for
two years or until present w er sells the building, whichever
comes first, and is requir d to install an additional handsink.
Included in the variance, i o allow the sinks to remain in the
hails. Seconded by Harold K u son. MOTION CARRIED UNANIMOUSLY.

down the waste pipe by hot water heater, incinerator venting is
rusted out as well as unit , spalled and loose cement falling from
basement walls , daylight can be seen between foundation and
building west wall and rodent infestation, because of financial
hardship.
Appellant has been working with the inspector and was able to
help resolved the code violations, therefore, appellant has
withdrawn her case.

SUBJECT: Appeilant is appeating the deficiency list in general ,
pertaining to loose windows. water damage to walls and ceilings
plaster and paint, provide rigid gas piping on space heater,
space heaters not properly installed, detector battery not
connected, because he fee} s it just not necessary.
PROCEEDINGS: Appellant is appealing all the items on the
deficiency list dated November 1 , 1988, because of angry and
lousy tenant. The windows have been repair. Water tlamaged walls
have been painted. The appellant is confused as to the rigid gas
piping on the space heater which passed inspection the last time
the Certificate of Occupancy was renewed.
BOARD ACTION: Motion made by Harold Knutson to deny the appeal ,
instead grant an extension of time until the next renewal of the
Certificate of Occupancy due January 27, 1989, for clarification
on the deficiency list. Seconded by Harold Knutson. MOTION
CARRIED UNANIMOUSLY.

able to work out a viable so u ion to the code violations. The
Appellant is withdrawing the �a peal .
