RFSOLVED, that, upon execuuon and delivery of a release in full to the City of Saint Paul,
the proper City officers are hereby authorized and directed to pay from the Tort Liability
Fund, 09081-0511, to American Fanrily Insurance, as subrogee for Michele and Daniel Lutz,
the sum of $29,394.82 in full settlement of their subrogation claim for damages sustained on
October 8, 1998 as a result of the tear gassing of the Lutz' home at 1140 St. Paul Avenue.

On October 8, 1998 the City of Saint Paul Police Department fired tear gas into the Lutz'
residence at 1 140 St. Paul Avenue. The Lutz' home was mistakenly identified as the home
where a suspect was hiding. As a result of the tear gas, the Lutz' were required to stay at a hotel
for approximately five weeks. There was also damage to the house and contents from the tear
gas. I have reached a settlement with the Lutz' insurance carrier in the amount of 529,394.82.
