WHEREAS, based upon the rec rd in the Ramsey County Recorder's Office on May 12, 1988, the following r ons are owners, interested parties or responsible parties of the Subj t Property: Harry J. The notice and order informed these parties t t he one and one-half story single family, wood frame house loca n the Subject Property is an abandoned building and a nuisance pursua t o Sections 45.01, Subd, 1 and 45.02, Subd. 11 of the Saint Paul Leg sl tive Code. WHEREAS, the August 9, 198 o der inforn�ed all owners, interested parties and responsible parties that th�y st either repair the structure on the Subject Property by correcting e list of deficiencies or demolish the structure, either action to tak�p ace by October 25, 1988. WEIEREAS, no action has beet� en regarding compliance with the August 9, 1988 notice and order, and as a re lt the Division of Public Health requested that a p�zblic hearing be schedu�.ed to take place on Tuesday, Febru,ary 28, 1989 for the City Council to conside t e advisability and necessity of ordering the correction of the nuisance cond ti n or in the alternative consider the demolition and retnoval of this ou e; and Wf�REAS, the above referen ed owners, interested parties and responsible parties have been personally se notice of the time and purpose of the February 28, 1989 hearing befor t e Council; WHEREAS, a hearing was hel�l fore the Saint Paul City Council on February 28, 1989 and all testirn�ny and �evi ence was considered by the Council. NOW THEREFORE, BE IT RESOI.�VED, that based upon all of the testi.nbny and evidence presented at the Feb ry 28, 1989 hearing, the Saint Paul City Council hereby adopts the follo i Findings and Order concerning the house at 918 Farrington Street: 1. That in August of 198 t house located on the Subject Property was determined to be vacant and o access. The house has remained vacant and has been either open or board s' ce August of 1983. 2. That since August of ]�98 the City of Saint Paul has on several occasions issued orders to the , ers to make this house secure and not accessible. On one occasion, l�ec se of the inaction on the part of the owners, the City has had to hi�e private contractor to make the house secure and not open to access. � 3. That the Division of ic Health of the City of Saint Paul condemned this structure as "Unfit for Habitation under Chapter 34 of the Saint Paul Legislative Code" in Augu , 1983. The building is still subject to this condemnation order. 4. That there are now an ve been since August of 1983, multiple exterior Housing Code or Build ng Code violations in existence at the Subject Property. � 5. That the owners, inte$�es p�rties and responsible parties of this house are as previously stated� in this resolution. These individuals have been properly served notice of the �eb ry 28, 19$9 hearing concerning this house. 6. That the order of August �, 988 have been disregarded by the owners, interested parties and responsible!pa ies. 8. That the one and one-halfis ry single family, wood frame house located on the Subject Property isjan abandoned building under Section 45.01, Subd. 1, of the Saint Paul Legisla�iv Code in that it is a building or �, portion thereof which has stood unpcc ied for longer than one (1) year" and during that period of time it has �ee either "unsecured", "boarded", or has had "multiple exterior Housing Cod� o Building Code violations" or has been "placarded as "Unfit for Htunan Hab�ita ion" pwzrsuant to Chapter 34 of the St. Paul Legislative Code." That the one and one-hal� s ry single family, wood frame house located on the Subject Property i a uisance as defined under Saint Paul Legislative Code Section 45.02, S . 11, in that it is an abandoned building located in the City of Saint Paul t t has created a dangerous or unhealthy condition or which threatens the ic peace, health, safety or sanitary condition of the City or which is�of ensive or has a blighting influence on the comnunity. 11. That the costs of aba Int of this nuisance are estimated to exceed two thousand dollars ($2,000.00) r he abatement involves demolition of a building other than a structure a ce sory to a residential building. � ORDER x The Saint Paul City Council �er by makes the following order� �i 1. The above referenced owr�er , interested parties and responsible parties and their assigns shall the Subject Property safe and not detrimental to the public peace, he lth, safety, and welfare and remove its blighting influence on the c it by rehabilitating this house and correcting those deficiencies se f rth in the list previously referenced in accordance with all a�licable c e and ordinances, or in the alternative by demolishing the house and fillin t e site in accordance with all applicable codes and ordinances. The rehab li tion or demolition of the house must be co�leted within thirty (30) day o the date of mailing of this resolution. 2. If the above correctivelac ion is not completed within the thirty (30) day time period, the proper City of icials of the City of Saint Paul are hereby authorized to take whatever ste a e necessary to demolish this house and fill the site and charge the costs i ur ed against the Subject Property pursuant to the provisions of Section 45.08 pf he Saint Paul Legislative Code. 3. Any repair or d�nolition must be leted in accordance with all applicable laws.
