RESOLVED, that all of the lice ses , including on-sale and
Sunday on-sale intoxicating liquor and restaurant, issued for
the Pacific Garden �testaurant at 3 8 St. Peter Street , are hereby
suspended for a period of thirty ( 0) days , but said suspension
is stayed for six months under the terms , conditions and require-
ments set forth in the Report of t e Administrative Law Judge
which is attached; and be it
FURTHER RESOLVED, that the R port of the ALJ dated January 25 ,
1989, with its Findings of Fact, onclusions of Law, Recommenda-
tions and Memorandum, is expressl ratified and adopted as the
written findings and conclusions f the Council with four ex-
ceptions : first, that Finding of Fact No . 12 is deleted in its
entirety; second, that Recommend tion No . 6 be amended to read
as follows :
"6 . If at the end af he period of the stay of
imposition, the City C uncil finds that the
license holder has not achieved a satisfactory
level of compliance, o that a se arate vio-

Philip Byrne , Assistant City Attorney , appeared on behalf of
the City of St . Paul and th Department of Community Services ,

The St . Paul City Counci and the Administrative Law Judge
has jurisdiction in this mat er pursuant to MSA s . 14 .50 and St .
Paul Legislative Code s . 310.0 & 310 .06 .
ISSUE
Whether the license ho der has operated the Pacific Garden
Restaurant in violation of S . Paul Legislative Code s .331 , Food
License , during the period ebruary 11 , 1g87 to December 28 ,
19$8 ; and if so , whether the restaurant license should be
revoked, subject to fine , conditions , suspended, and if
suspended, for what period of time .
FINDI GS OF FACT
1 . This matter was origi ally scheduled for hearing December
22, 1988 , by Notice to the license holder dated November 25 ,
198fi . By Stipulation of the parties , the hearing was
continued in an Interim rder dated December 27 , 1988 , with
terms that incorporated t at Stipulation .
2 . On January 3, �9�9 the St . Paul City Council under
authority of Section 310 05 (a) St. Paul Legislative Code ,
eleeted to initiate a he ring regarding the Pacific Garden ,
Inc , d/b/a Pacific Gard n Restaurant , the license holder
herein . By Stipulation f the parties, further notice was
waived, the hearing sche uled and held on January 13 , 1989,
in the St . Paul Public Li rary, St . Paul , Minnesota .
3 . The license holder o ns and has operated since 1982 the

� Pacific Garden Restaurant which is located in the Lowry
, Building , 338 St. Peter S reet , St . Paul , Minnesota . The
establishment has both a 1 quor license and a food license
and is open six ( 6) days a eek. The bar is open only during
periods the restaurant is o en .
4 . I-Ming Lai , and his wi e , Esther Lai , are the principle
shareholders and operators f the Pacific Uarden Restaurant .
They have no other busines . Between them, they do nearly
all of the food preparation and personally supervise on a
daily basis all aspects of he restaurant operation . Mr . Lai
has had food handlers training prior to 1982 .
5 . Between February 11 , 19t's7, and December 2$ , 1985 , the
Pacific Garden has been subject to thirteen ( 13 ) separate on-
site inspectioris by the Cit of St . Paul , Division of Public
Health . There were other contacts between the inspectors and
the license holder in addi ion to the on-site inspections ,
relating to corrections and conditions at the restaurant .
6. Deficiencies or viol�tions of St. Paul Legislative Code
s . 331 were found on all ' nspections performed during the
period cited .
7. On four (4) occasions the establishment was scored
according to a method estab ished by the State of Minnesota
Department of Public Health . The system has a 0-100 range
and is weighted accordin to the seriousness of the
deficiency found with the d ficiencies scored and subtracted
from 100 . The scores obta ned by the establishment are as
follows :

8. On all on-site inspections made at the establishment ,
inspectors found evidence o cockroaches on the premises , a
violation of St. Paul Legis ative Code s . 331 . 18 , Insect and
Rodent Control .
9 . The license holder ha had since 198�4 a professional
licensed pest control com any on contract. They have
regularly sprayed the premi es at intervals of once to four
times per month. The lic nse holder has personally used
insect fog bombs to suppleme t the professional spraying done
on the premises.
10 . The establishment is locateci on two (2) floors of the
Lowry Building, the first loor and a storage room in the
basement . The storage room as a door leading to common area
outside of its leased premis s .

" 11 . In one instance , Ma 20 , 1987, the inspector noted that
in connection witn the s raying for cockroaches , the license
holder should also weath rstrip the storage room door leading
outside of the leased pr mises .
12. There are common reas within the Lowry Building that
are adjacent to the fo d service areas leased by this and
other license holders in the Lowry Building that show
evidence of cockroach in estation .
13 . The license holder consistently took corrective action
� and follow up inspectio s consistently showed corrections or
"abatement" had been d ne on previously noted deficiencies .
This includes calls to he exterminating company immediately
upon notification that the inspector had found evidence of
the presence of cockro ches . The license holder has also
made efforts to seal cr cks and openings both in the storage
room and in public plac s in the restaurant .
14 . During the time p riod of February 11 , 1987 to December
28, 198$ , there have b en numerous violations noted relative
to the thawing method, anitation , and temperature control of
food, both stored and prepared, all violations of St. Paul
Legislative Code s . 331 . 11 ( 6) , Food Protection .
15 . The license holde has in place a cleaning schedule and
plan to be used by th kitchen, bar and waitress personnel . .
Cleaning is done twice a day both in the kitchen and the
public area.
16. I-Ming Lai is the only employee who has had food.
handling training.
17 . The are other food service lieenses located in the Lowry
Building.
CONCLUSIO NS
1 . The St. Paul City Council and the Administrative Law
Judge has jurisdictio in this matter pursuant to MSA s . 14 .50
and St. Paul Legislat ve Code s . 310 .05 & 310 .06 .
2 . The City of t. Paul has fulfilled all relevant
substantive and proce ural requirements of law and rule .
3. The license hol er is licensed by the City of St. Paul
for on sale liquo as well as food establishment in
accordance with St . Paul Legislative Code s . 331 ; and the
license holder is, herefore , required to comply with the
said Code relating t food licenses.
4. The City of St. aul has proved by a preponderance of the
evidence that on n merous occasions between February 11 ,
' 19$7, and December 2 , 19�8 , the license holder had violated .
the St . Paul Legisla ive Code s . 331 . 11 and 331 . 18 relating to

the operation of a food serv' ce establishment .
5 . As a result of these vio ations over this period of time ,
some disciplinary action is ecessary.
Based upon the foregoing F ndings ot Fact and Conclusions ,
the Administrative Law Judge mak s the following:
RECOMMENDATIONS
IT IS HEREBY RECOMMENDED that the City Council take
disciplinary action against the license holder as follows :
1 . That a condition be placed upon the license of the
Pacific Garden , Inc , to re uire , for a period of three ( 3 )
years, all employees involv d in the preparation of food to
have formalized food handle training courses approved by the
Division of Public Health nd that such training be within
three ( 3) years prior to e ployment or within 45 days after
employment; and that copies of completion certificates be
maintained on the premises .
2 . That the license be sus ended for a period of thirty ( 30 )
days .
3. That the imposition o the suspension be stayed for a
period of six ( 6 ) months c ntingent upon the license holder
complying with the followin terms and conditions :
a . Within thirty ( 30 ) days of City Council action , the
license holder devel p , with the assistance of the
Division of Public H alth a formalized and detailed
cleaning plan and sch dule that is satisfactory to the
Division and that rec rds of daily completion of the
schedule be maintained on the premises and available for
inspection .
b. That the license older assist in developing , with
the assistance of the Division of Public Health , the
building owner and a p ofessional/licensed extermination
company a plan to loc te the source of the cockroaches
within the Lowry Bu lding and to comply with any
reasonable long term xtermination plan as approved by
the Division of Public Health .
4 . That the Division of P blic Health be directed to do the
following:
a . Make frequent ins ections during the period of stay
of imposition of susp nsion to determine compliance by
the license holder wi h the terms and conditions of the
stay of suspension .
b. To score the esta lishment on a monthly basis using
the service rating heet developed by the State of

� Minnesota and report t e scores to the City Council at
the end of the stay of imposition .
c . I'o submit to the ity Council , at the end of the
stay of' imposition , a summary of actions taken by the
Division and the license holder relating to the
conditions on the lice se and the terms of the stay of
suspension together wit comments on whether the license
holder has achieved s tisfactory compliance with the
State and local health laws and regulations .
5 . Because of the pr sence of other food service
establishments in the Low y Building and because of the
consistent but only partial y successful efforts the license
holder has made over se eral years to eradicate the
cockroaches , it is recomme ded that the Division of Public
Health be directed to work ith the Lowry Building owner and
a professional/licensed ext rmination company to attempt to
locate the source of the cockroach infestation and to develop
with them a long term plan o eradicate the cockroaches from
the building.
6 . If at the end of the p riod of the stay of imposition, �
the City Council finds t at the lieense holder has not
achieved a satisfactory lev 1 of compliance , the thirty ( 30 )
day suspension should be imp sed.
7 . At the end of the six ( ) month period of suspension and
with the recommendation of he Division of Public Health, it
is recommended that the thir y ( 301 day suspension be lifted .

f MORANDUM
The City of St . Paul h s proved , by a preponderance of the
evidence , that the lice se holder has violated certain
signiticant provisions of t e St . Paul Legislative Code , Section
331 in the numerous inspect ons done on the establishment over a
ten ( 10 ) month period of ti e . Although some of these violations
were smaller and housekeepi g in nature , others were significant
and related directly to spe ific provisions of the Code relating
to the way ana manner i which food was properly stored ,
refrigerated , tha�aed and pr pared . There also was the consistent
problem with cockroaches .
The license holder has consistently demonstrated a
conscientious and cooperat ve attitude and has made consistent
efforts to correct def'icie cies noted by the inspectors . These
efforts are demonstrated by the numerous corrections noted on all
follow up inspections .
COCK OACH VIOLATION
The license holder has had a licensed exterminating company
that has sprayed on the p emises for several years . Although
much effort has been m de to eradicate the presence of
cockroaches , their continu d presence suggests that the source
may be somewhere outside of the leased premises controlled by the
license holder. EvidenCe of cockroaches in adjacent areas and
the fact that there is a doorway leading to the storage room
would make spraying the sto age room only a short term remedy .
The inspectors should work with the professional spraying
company employed to ensure proper timing and distribution of
effort as well as assistin them in locating the actual source of
the cockroaches and t�e est methods of obtaining long term
results better than has be n experienced in the past.
In order to obtain a ong term solution , it seems apparent
that it will be necessary or the inspectors to broaden the area
of their inspections to i clude the areas adjacent to the lease
holders premises and to work with the building owners to
eliminate cockroaches lo ated adjacent to the lease holders
premises both for this 1 ' cense holder as well as other food
service license holders in the Lowry Building.
HOUSEKEEPI G/CLEANING VIOLATIONS
Although the license h lder does have a cleaning schedule in
place, it is indefinit and inadequate and in need of
clarification . A more det iled plan addressing individual duties
for individual employees ' s necessary to obtain consistent long
term compliance with healt standards .

, FOOD STORAGE/ REPARATION VIOLATIONS
'I'raining of the employees at the establishment is inadequate
and the consistent deficienc � es relative to the thawing , storing
and preparation of food cou d be eliminated with education and
training . Although Mr . La ' performs a majority of the food
preparation , other employees are involved to some degree and all
could benefit from additional or "refresher" training . He
testified to his willingnes to train his employees as well as
himself. The fact that he has a formalized plan at all is
evidence of his concern for this aspect of his business . His
testimony was that he doe not object to developing a more
detailed plan with the Depar ment .
Since the license hold r has for years had prof'essional
assistance in an attempt to radicate the presence of cockroaches
on the premises , it appears evident , that it will be necessary to
expand the treatment to the uilding areas outside of the leased
premises if the infestation s going to be eliminated long term.
This 4ri11 require the inspectors to go beyond the confines of the
license holders premises and work with the building owner and the
professional exterminating company .
The license holder has emonstrated his cooperation in the
past and his willingness to work toward a permanent solution to
all deficiencies noted . The have also expressed willingness to
work with the Division of ublic Health in the future . The
establishment is well equip ed and the license holder has the
capacity, with assistance fr m the city , to maintain long term
compliance with the Leg slative Code relating to his
establishment .

This includes calls to the x erminating company immediately
upon notification that the �inspector had found evidence of
the presence of cockroache . The license holder has also
made efforts to seal cracks an openings both in the storage
room and in public places in t e restaurant.

28 , 1988, there have been n merous violations noted relative
to the thawing method, sanit t ' on , and temperature control of
food, both stored and prep re , all violations of St. Paul

plan to be used by the kit he , bar and waitress personnel .
Cleaning is done twice a ay both in the kitchen and the

1 . The St. Paul City Cou�cil and the Administrative Law

I�RE OMMENDATIONS
IT IS HEREBY REC4MM NDED that the City Council take
disciplinary action agai�st the license holder as follows :
1 . That a condit�on be placed upon the license of the
Pacific Garden , Inc� o require , for a period of three ( 3)
years, all employee$ i volved in the preparation of food to
have formalized food� h ndler training courses approved by the
Division of Public e lth and that such training be within
three ( 3) years pri r to employment or within 45 days after
employment; and th t copies of completion certificates be
maintained on the p em ses .
2 . That the licensl b suspended for a period of thirty ( 30 )
days .
3. That the imposft on of the suspension be stayed for a
period of six ( 6 ) on hs contingent upon the license holder
complying with the ol owing terms and conditions :
a. Within thi�t ( 30 ) days of City Council action, the
license holde evelop , with the assistance of the
Division of �b ic Health a formalized and detailed
cleaning plan �n schedule that is satisfactory to the
Division and h t records of daily completion of the
schedule be ma�n ained on the premises and available for
inspection.
b. That the li ense holder assist in developing, with
the assistanc � f the Division of Public Health , the
building owne a d a professional/licensed extermination
company a pla � o locate the source of the cockroaches
within the pw y Building and to comply with any
reasonable lo g term extermination plan as approved by
the Division f ublic Health.

5 . Because of ' he presence of other food service
establishments in t e Lowry Building and because of the
consistent but onl artially successful efforts the license
holder has made � o er several years to eradicate the
cockroaches , it i �, r commended that the Division of Public
Health be directed !t work with the Lowry Building owner and
a professional/lic ns d extermination company to attempt to
locate the source f he coekroach infestation and to develop
with them a long t r plan to eradicate the coekroaehes from
the building.
6. If at the end �o the period of the stay of imposition,
the City Council finds that the license holder has not
achieved a satisfa �to y level of compliance , the thirty ( 30 )
day suspension sho �.d be imposed.
7. At the end of he six ( 6) month period of suspension and
with the recommend �ti n of the Division of Public Health, it
is recommended that' t e thirty ( 30 ) day suspension be lifted .

The City of St. Paul ha roved, by a preponderance of the
evidence, that the licen�e holder has violated certain
significant provisions of th t. Paul Legislative Code , Section
331 in the numerous inspecti�ns done on the establishment over a
ten ( 10 ) month period of time�» Although some of these violations
were smaller and housekeepin in nature, others were significant
and related directly to spec�fic provisions of the Code relating
to the way and manner in w ich food was properly stored,
refrigerated , thawed and prep�r d. There also was the consistent
problem with cockroaches . �
The license holder �as consistently demonstrated a
conscientious and cooperativ ttitude and has made consistent
efforts to correct deficienc 'e noted by the inspectors . These
efforts are demonstrated by t e numerous corrections noted on all
follow up inspections .

COCRRO�AC VIOLATION
The license holder has h d a licensed exterminating company
that has sprayed on the pre i es for several years . Although
much effort has been mad to eradicate the presence of
cockroaches, their continued ` p esence suggests that the source
may be somewhere outside of t 'e leased premises controlled by the
license holder. Evidence o c ekroaches in adjacent areas and
the fact that there is a d o way leading to the storage room
would make spraying the stora e room only a short term remedy .
The inspectors should w�rk with the professional spraying
company employed to ensure pr per timin� and distribution of
effort as well as assisting t�e in locating the actual source of
the cockroaches and the be t methods of obtaining long term
results better than has been �x erienced in the past.
In order to obtain a lo �g term solution, it seems apparent
that it will be necessary fo� t e inspectors to broaden the area
of their inspections to incl�de the areas adjacent to the lease
holders premises and to w rk with the building owners to
eliminate cockroaches locat .d adjacent to the lease holders
premises both for this licehs holder as well as other food
service license holders in th ' L wry Building.
HOUSEKEEPING/ LE NING VIOLATIONS
Although the license hold�r does have a cleaning sehedule in
place, it is indefinite n inadequate and in need of
clarification. A more detail d lan addressing individual duties
for individual employees is iec ssary to obtain consistent long
term compliance with health s an ards .

� FOOD STORAGE/ RE ARATION VIOLATIONS
Training of the employee , at the establishment is inadequate
and the consistent deficienc e relative to the thawing, storing
and preparation of food cou `d be eliarinated with education and
training. Although Mr . La erforms a majority of the food
preparation , other employees a e involved to some degree and all
could benefit from additiona or "refresher" training . He
testified to his willingnes t train his employees as well as
himself. The fact that he as a formalized plan at all is
evidence of his coneern forj, t is aspect of his business . His
testimony was that he doe ' ot object to developing a more
detailed plan with the Depart. e t.
Since the license hold � has for years had professional
assistance in an attempt to e a icate the presence of cockroaches
on the premises , it appears e i ent , that it will be necessary to
expand the treatment to the ui ding areas outside of the leased
premises if the infestation ' s oing to be eliminated long term.
This will require the inspect r to go beyond the confines of the
license holders premises and o k with the building owner and the
professional exterminating co�pany.

The license holder has em nstrated his cooperation in the
past and his willingness to o k toward a permanent solution to
all deficiencies noted. They h ve also expressed willingness to
work with the Division of ,ub ic Health in the future . The
establishment is well equipp�d and the license holder has the
capacity, with assistance fr m the city, to maintain long term
compliance with the Legi�sl tive Code relating to his
establishment .

I have received this date a Data S eet from the St. Paul City
Attorney as to the use of an autom tic room fogger to distribute
the pesticide D-Con in between reg lar visits of the Adams Pest
Control Service. If there is any uestion at all as to whether or
not this product should be used in a restaurant the operators will
discontinue it.
Even though the cooking utensils a d work surfaces are covered
during the application of this spr y, it is my recommendation to
the operator' s that they discontin e it, because of a possible
skin and eye irritant.
