pertaining to the payment of
severance pay to employees.
hereas, It is the intentions of the City Council to
provi e that the payment of severance pay to eligible
emplo ees may be paid either in one lump sum or in five equal
annua installments at the option of the employee, and this
amend ent is to be applicable to all eligible employees
sever ng employment with the City from and after the date of
the a option of the ordinance amendment.
THE C UNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1

Dear Mr. Schill�er:
At its meeting on Monday, January 30 , 1989 , the Finance , Manage-
ment and Persqnnel Committee was examining a resolution proposed
by your depa�rtment providing for and authorizing employees
to receive at; the employees ' option their severance pay either
in one lump sum �ayment or five equal installments . Mr. Bob
Vanyo of your office was asked why it was necessary that the
City Council jpass such a resolution each year and his advice
to the Commi�tee was that the present and existing ordinance ,
Section 38 .07 of the Saint Paul Administrative Code , made specific
provision forj the City Council each year by resolution, making
such a determi�nation.
The Committe� indicated a willingness to favorably consider
amending the iordinance to provide that in all cases the retiring
employee wou�d have the option of receiving payment as one
lump sum or ' five equal installments , and directed the admini-
stration to Iprepare and present to it a draft ordinance ac-
complishing t�at purpose.
I have prepared and attached to this letter a draft of an ordi-
nance amendi;ng Section 38 . 07 (b) of the Administrative Code
deleting thc�se provisions requiring an annual City Council
resolution, �and further specifically providing that separated
employees wo�ld have the option of requesting one or five install-
ment payment . If this is satisfactory to the Administration,
I have app�oved the form of the ordinance and you may then
process it o the City Council . If you have any questions ,
