WF�REAS, no ac ion has been taken regarding carc�liance with the Sept�nber 21, 1988 notice and order, and as a result the Division of Public Health requ sted that a public hearing be scheduled to take place on Thursday, Feb ry 16, 1989 for the City Council to consider the advisability and n essity of ordering the correction of the nuisance condition or in th alternative consider the demolition and removal of this building; and WHEREAS, the ve referenced owners, interested parties and responsi.ble partie have been personally served notice of the time and purpose of the Feb ry 16, 1989 hearing before the Council; and Wf�REAS, a hea ing was held before the Saint Paul City Council on February 16, 1989 �nd all testimony and evidence was considered by the Council. NOW, TE�REFORE;, BE IT RESOLVED that based upon all of the testimany and evidence prese�ted at the February 16, 1989 hearing the Saint Paul City Council hereb1y adopts the following Findings and Order concerning the building at 194 W. Robie Street: 1. That on J ly 26, 1988 the building located on the Subject Property was detern�ined to vacant and open to access. The building has remained vacant and has n either open or boarded since July of 1988. 2. That sinc July of 1988 the City of Saint Paul has on several occasions issued rders to the owners to make this building secure and not accessable. On s veral occasions, because of the inaction on the part of the awners, the Ci}ty has had to hire a private contractor to make the building secure ar�d not open to access. 3. That ther are now and have been since July of 1988, m�zltiple mz exterior Housing ode or Building Code violations in existance at the Subject Property. 4. That the �wners, interested parties and responsible parties of this building are as previously stated in this resolution. That on Se r 21, 1988 a Dangerous Structure Notice was sent to the o�mers, inte ested parties and responsible parties ordering these persons within thi y (30) days from the date of the Notice to either dernolish the buildi g or make repairs and correct the list of deficiencies. 7. That the or' er of September 21, 1988 has been disregarded by the owners, interested rties and responsible parties. 8. That the t story, wood frame, fire damaged, single family house located on the Subj t Property is a dangerous structure under Section 45.01, Si�bd. 3, of he Saint Paul Legislative Code in that it is "any str�ture which is tentially dangerous to persons or property including but not limited to", "a structure which is in clanger of partial or con�lete collapse".. 9. That the t story, o�ood frame, fire damaged, single family house located on the SuL'ect Property is a nuisance as defined under Saint Paul Legislative Code tion 45.02, Subd. 10, in that it is a dangerous structure located �n the City of Saint Paul that has created a dangerous or unhealthy condi ion or which threatens the public peace, health, safety or sanitary conditijon of the City or which is offensive or has a blighting influence on the c ity. 10. That the co t of abatement of this nuisance is estimated to exceed two thousand dolla s (52,000.00) or the abatement involves demolition of a building other tha a structure accessory to a residential building. ORDER The Saint Paul City Council hereby makes the following order: l. The above eferenced a�mers, interested parties ar�l responsible parties and their ssigns shall make the Subject Property safe and not detr�m�ental to the �blic peace, health, safety, and welfare and rezrave its blighting infl ence on the comrnanity by rehabilitating this building and correcting tho e deficiencies set forth in the list previously referenced in acco dance with all applicable codes and ordinances, or in the alternative by demolishing the building and filling the site in accordance with al applicable codes and ordinances. The rehabilitation or demolition of t is building m�zst be com�leted within thirty (30) days of the date of mai ing of this resolution. 2.
