WHEREAS, the City of St. Paul administered Phase II of the firefighters
physi al abilities test in May of 1988; and
WHEREAS, the r sults of the examination lead to District Court action
by th State Department of Human Rights and its Director,
Steph n Cooper, on behalf of the 17 women that failed the
physi al abilities test, claiming that the test was discrim-
inato y; and
WHEREAS, the C'ty Council advised the City Attorney's Office to open
negot'ations with the State of Minnesota in an attempt to
resol e the suit; and
WHEREAS, a fir proposal has been submitted to the State and a settle-
ment hat is agr�eable to both parties has not resulted; and
WHEREAS, the City Attorney has indicated to the State that the City is
only interested in a settlement in which all parties agree .
and i a settlement could not be reached, then it would perhaps
be in the best interest of all parties to pursue a determin-
ation by the Courts;
NOW, THEREFORE, BE IT RESOLVED, that the City of St. Paul end
negot'ations with the State Human Rights Department and its
Direc or, Stephen Cooper, and now instruct the City Attorney's
Offic to seek resolution of the lawsuit through the Courts.
