PLEASE TA E NOTICE that pursuant to Section 13 .03.5 of the
St. Paul City �harter, Rein Midway Limited Partnership, a

Connecticut li ited partnership (hereinafter "Appellant" ) , for
itself and on ehalf of Adwell Corporation, hereby appeals to the
Ramsey County District Court from the award of damages effected
by the Resolut'on of the St. Paul City Council, adopted January
31, 1989 as Ci y Council File No. CF 89-170, a true and correct
copy of which �s attached hereto as Exhibit A and by this refer-
ence incorpora ed herein (hereinafter "Final Order" ) . Appellant
claims an inte est in the land described in Exhibit B attached
hereto and by his reference incorporated herein, and the
improvements thereon, which together are known as the Midway
Shopping Cente� in St. Paul, Minnesota. The permanent and
temporary ease ents legally described in, and whose condemnation

is confirmed b� the Final Order lie entirely within the property
in which Appellant claims an interest. For the purposes of this
appeal, Appell�nt' s interest in said property is that of the fee
owner. Appellan� is currently fee owner of the improvements
constituting M�idway Shopping Center and is the ground lessee of
record with respect to the land underlying the improvements.
Appellant is i� the process of purchasing the land from the
ground lessor/�ee owner, Adwell Corporation, and has received an
assignment fro�n Adwell Corporation of all of its right and
interest in and to any award in this condemnation. Appellant' s
objection, and the ground of this appeal, is that the City
Council 's awar , to-wit, $35,120.00, substantially undervalues
the interest tlken in this condemnation. Appellant, for itself
and on behalf f Adwell Corporation, claims that it is entitled
to an award in ' excess of $80, 000.00.
