RESOLVE�, .that in lieu of a suspension of the on-sale
intoxicating� liquor license and all other licenses held by
T.R. Enterpr ses , Inc . dba Ryan' s Bar, Thomas R. Ryan, Pres . ,
for the prem�ses at 201 E. 4th St . , in Saint Paul , said
licenseholde$� and its managing employees are reprimanded
for the viol tion of permitting the display and consumption
of alcoholic beverages , after the closing hour. This appear-
ance shall c unt as a First Appearance under section 409 .26(b)
of the Legis ative Code, and a subsequent violation shall be
regarded as Second Violation or Appearance for purposes of
determining he presumptive penalty.
This �e olution and the action taken above are based upon
the facts co tained in the attached police report dated
November 16 , 1988 . Such facts are not contested by the license-
holder, as e idenced by the attached letter signed by Michael
C. Black, at orney for the licensee . The action taken is also
based on the facts , circumstances , and arguments presented by
and on behal of the licenseholder, and the recommendation of
the City Attorney' s Office.
The fore,oing action departs from the presumptive penalties
in section 4�9 . 26(b) for the following reasons : the prior good
record of the bar, the cooperative attitude of management , the
fact that no ales were made, and that two of the three persons
in the bar we e employees who had performed work on the premises
after closing on that occasion.

This o fice represents T.R. Enterprises, Inc. , which is the
licensee for the b siness known as Ryan's Bar at 201 East Fourth Street,
St. Paul, Minnesot .
My cli nt has provided me with your correspondence dated
December 29, 1988 oncerning an alleged violation of Section 409.07(c)
of the Legislative Code, which occured on or about November 16, 1988.
My cli nt has investigated this matter, and based upon the in-
formation he has 1 arned, he has decided not to contest the allegations
ma.de by your offic .
I unde stand that the procedure in such a case is for your
office to schedule, this matter on the City Council agenda, at which time
you will submit th matter to the Council for the consideration of a
sanction against m client. I understand that you will prepare a draft
resolution for ado tion by the Council for a license suspension for an un-
specified period o time. However, you have indicated that, other than
describing the nat re and relative seriousness of the alleged violation
you will be making no recommendation concerning a sanction. My client will
have the opportuni }> to describe mitigating factors to the Council and
suggest an appropr ate remedy.
Assumi g that I have accurately described the process, I request
that you schedule his matter with the City Council for consideration of this
alleged violation.

still listed as a icense holder. Her name should be removed from the license,
since she no longe holds a security interest in it. Mr. Ryan provided the

Dear Mr. Byrne:
This office represents T.R. Enterprises, Inc. , which is the
licensee for the bu iness known as Ryan's Bar at 201 East Fourth Street,
St. Paul, Minnesota.
My clie t has provided me with your correspondence dated
December 29, 1988 c ncerning an alleged violation of Section 409.07(c)
of the Legislative ode, which occured on or about November 16, 1988.
My clie t has investigated this matter, and based upon the in-
formation he has le rned, he has decided not to contest the allegations
made by your office
I under�tand that the procedure in such a case is for your
office to schedule his matter on the City Council agenda, at which time
you will submit the matter to the Council for the consideration of a
sanction against my client. I understand that you will prepare a draft
resolution for adop ion by the Council for a license suspension for an un-
specified period of time. However, you have indicated that, other than
describing the natu e and relative seriousness of the alleged violation
you will be making o recommendation concerning a sanction. My client will
h�ve the opportunit to describe mitigating factors to the Council and
suggest an appropri te remedy.
Assuming that I have accurately described the process, I request
that you schedule th"s matter with the City Council for consideration of this
alleged violation.

By the ay, I note from your correspondence that Arlene Viner is
still listed as a l�icense holder. Her name should be removed from the license,
since she no longer� holds a security interest in it. Mr. Ryan provided the
License Inspector w�th this information some time ago.
