thereof having been given as prescribed by the City Charter; and
WHEREAS, The Co ncil has heard all persons, objections and recommendations pertaining to said proposed improve-
ment and has fully consid red the same; now, therefore, be it
RESOLVED, That t e Council of the City of Saint Paul does hereby order that the above-described improvement
be made, and the proper ity officers are hereby directed and authorized to proceed with the improvement; and be it
FURTHER RESOL ED, That upon the completion of said improvement, the proper City officers shall calculate
all expenses incurred therei and shall report the same to the City Council in accordance with Chapter 14 of the City Charter.

PROJECT
Grade and pave M NTANA AVENUE from Arkwright Street to the proposed cul-de-sac
approximately 290,west of the west line of Arkwright Street. Also, grade and pave '
NEBRASKA AVENUE from Arkwright Strest to the proposed cul-de-sac approximately
420' west of the w�st line of Arkwright Street. Also, construct a sanitary sewer in
NEBRASKA AVEI�UE from 370' west of the west line of Arkwright Street to 300' west of
the west line of Ariqwright Street. Aiso, construct sewer service connections. Also,
construct a street lijghting system.
Aiso open and wid n MONTANA AVENUE creating a cul-de-sac for street purposes by
condemning and t king that part of Lots 25, 26 and 27, Blocic 1 �n Lots 12, 13 and 14,
Block 4 all in Mort n's Addition lying within the arc of a circle having a 50' radius. The
center of said circl lying on the centerline of Montana Avenue and 265' west of the
centerline of Arkw ght Street.
Also open and wid n NEBRASKA AVENUE creating a cul-de-sac for street purposes by
condemning and t king that part of Lots 28, 29 and 30, Blocic 4�i Lots 9, 10 and 11,
Blocic 5 all in Mort n's Addition lying within the arc of a circle having a 50' radius. The
center of said circl lying on the centerfine of Nebraska Avenue and 395' west of the
centerline of Arkw ght Street.
Also condemning nd taking a 15' easement for sewer purposes on, over and across
Lots 9, 10, 11, 30 nd 31, Blocic 4�p,� Lots 1, 2, 3, 4 and 5, Blocic 5 all in Morton's
Addition. Said eas ment lying 15' southeasterly and adjacent to the southeasteriy line of
Soo Line Railroad �rom Arfcwright Street to Montana Avenue. Also condemning slope
easements on the �bove grading project.
PROPOSED IMPRIOVEMENTS
The street will be c nstructed 32' wide with bituminous surface and concrete curb and
gutter, and 15' bou evards and street lighting system installed.
.A storm water drai age system will be constructed to serve these streets. This system
wiil drain into two n w storm sewers that are proposed to be constructed along the Soo
Line Railroad.
Sanitary sewer is p oposed for approximately 70' on Nebraska. The reminder of
Nebraska and Mon ana have an existing sanitary sewer.

A water main wouid! be constructed for the length of this improvement. Water and sewer
connections would �be stubbed to the property line as necessary.

There are two xisting houses that face these improvements, but there are homes that
face Arkwrightland these streets wiil abut the long side of their property. The remainder
of the land is unimproved with a dirt trail to serve the homes faang the proposed
improvement. There is approximately 200' of water main in Montana, and Nebraska has .
no water main
Do nothing. T is will not be a problem but the legislative code restricts house
construction o unimproved streets. Therefore, no new home could be constructed in the
area unless a aiver is granted. ,
If waivers are ranted, the increased density will place addtional pressure on the dirt
streets.

Addition. Said eas ment lying 15' southeasterly and adjacent to the southeasterly line of
Soo Line Railroad f om Arkwright Street to Montana Avenue. Also condemning slope
easements on the bove grading project.
INITIATIN A TI
This project was ini iated by a petition signed by 3 of the 9 abutting property owners
representing appro imately one-half of the assessable property.
PROPOSEDIMPRbVEMENTS
The street will be c�nstructed 32' wide with bituminous surface and concrete curb and
gutter, and 15' boullevards and street lighting system installed.
A storm water drair�age system will be constructed to serve these streets. This system
will drain into two nlew storm sewers that are proposed to be constructed along the Soo
Line Railroad. I

Sanitary sewer is pjroposed for approximately 70' on Nebraska. The reminder of
Nebraska and Mon�ana have an existing sanitary sewer.

A water main wou d be constructed for the len th of this im rovement. Water and sewer

connections woul be stubbed to the property line as necessary.
EXISTING CONDnTIONS
There are two exi ing houses that face these improvements, but there are homes that
face Arkwright an these streets will abut the long side of their property. The remainder
of the land is unim roved with a dirt trail to serve the homes facing the proposed
improvement. Th re is approximately 200' of water main in Montana, and Nebraska has
no water main.
HISTORY �
This project was b fore the City Council several times before. The first time was in the
late 1950's and mo t recently in 1987. The public hearing in 1987 was scheduled at the
request of one pro erty owner who did not attend the hearing, and the proposal was
denied.

An informational m eting was held on December 15, 1988 at the East Side YMCA. The
meeting was atten ed by four property owners.
ALTERNATES II
Do nothing. This w�ll not be a problem but the legislative code restricts house
construction on unirnproved streets. Therefore, no new home could be constructed in the
area unless a waiv�r is granted.
If waivers are grant�d, the increased density will place additional pressure on the dirt
streets.

PROJECT
Grade and pave MO TANA AVENUE from Arkwright Street to the proposed cul-de-sac
approximately 290' est of the west line of Arkwright Street. Also, grade and pave
NEBRASKA AVENUE from Arkwright Street to the proposed cul-de-sac approximately
420' west of the wes line of Arkwright Street. Also, construct a sanitary sewer in
NEBRASKA AVENI�E from 370' west of the west line of Arkwright Street to 300' west of
the west line of Ark�right Street. Also, construct sewer service connections. Also,
construct a street lig ting system.
Also open and wider� MONTANA AVENUE creating a cul-de-sac for street purposes by
condemning and tal�ing that part of Lots 25, 26 and 27, Block 1 � Lots 12, 13 and 14,
Block 4 all in Morto 's Addition lying within the arc of a circle having a 50' radius. The
center of said circle ying on the centerline of Montana Avenue and 265' west of the
centerline of Arkwri ht Street.
Also open and wide NEBRASKA AVENUE creating a cul-de-sac for street purposes by
condemning and ta ing that part of Lots 28, 29 and 30, Block 4 r� Lots 9, 10 and 11,
Block 5 all in Morto 's Addition lying within the arc of a circle having a 50' radius. The
center of said circle lying on the centerline of Nebraska Avenue and 395' west of the
centerline of Arkwri ht Street.
Also condemning a�d taking a 15' easement for sewer purposes on, over and across
Lots 9, 10, 11, 30 a�d 31, Block 4�i , Lots 1, 2, 3, 4 and 5, Block 5 all in Morton's
Addition. Said eas�ment lying 15' southeasterly and adjacent to the southeasterly line of
Soo Line Railroad f om Arkwright Street to Montana Avenue. Also condemning slope
easements on the �bove grading project.
INITIATING ACTION
This project was in�tiated by a petition signed by 3 of the 9 abutting property owners
representing appro�Cimately one-half of the assessable property.
PROPOSED IMPF�OVEMENTS
The street will be constructed 32' wide with bituminous surface and concrete curb and
gutter, and 15' boulevards and street lighting system installed.
A storm water dra�age system will be constructed to serve these streets. This system
will drain into two ew storm sewers that are proposed to be constructed along the Soo
Line Railroad. i
Sanitary sewer is � roposed for approximately 70' on Nebraska. The reminder of
Nebraska and Mor�tana have an existing sanitary sewer.

A water main would �e constructed for the len th of this im rovement. Water and sewer

connections would be stubbed to the property line as necessary.
EXISTING CONDIT�ONS
There are two existi�hg houses that face these improvements, but there are homes that
face Arkwright and t�ese streets will abut the long side of their property. The remainder
of the land is unimpqoved with a dirt trail to serve the homes facing the proposed
improvement. Ther� is approximately 200' of water main in Montana, and Nebraska has
no water main.
HISTORY
This project was be ore the City Council several times before. The first time was in the
late 1950's and mo�t recently in 1987. The public hearing in 1987 was scheduled at the
request of one property owner who did not attend the hearing, and the proposal was
denied.
NEIGHBORHOOD MEETING
An informational m eting was held on December 15, 1988 at the East Side YMCA. The
meeting was attenc�ed by four property owners.
ALTERNATES
Do nothing. This v�ill not be a problem but the legislative code restricts house
construction on uniimproved streets. Therefore, no new home could be constructed in the
area unless a waiv�er is granted.
If waivers are granted, the increased density will place additional pressure on the dirt
streets.

AECOMMENDATION
The Department of F?ublic Works feels that this is a worthwhile project and recommends
that it be approved. Iln the event the City Council denies these improvements, the
building ordinance r�stricting development on unimproved lands will hamper further
development along these streets.
