S. 364 . 09 , Laws of Minnesota 1986 ) prohibits�an employer from considering felonies over one year old in de isions to hire an individual . There are cerLain exception� to tl�iis polic}�. The exceptions are for the hiring of police or the issuance of a license for family day care or famil,v fo�ter care . Firefighters are not listed as exceptions to this pc�licy. In a rela�ed matter , current federal law prohibits the Federal Bureau of Investigation from allowing local fire officials to access th FBI databanks with candidate fingerprints without enabling tate legislation. In 1984 the Saint Paul City Council p ssed an ordinance which enabled the Fire Department to use th� FBI system; however, the ordinance ( 17114 ) was withdrawn when it was determined that state enabling legislatidn was required. STATUS The Minnesota �tate Fire Chief' s Association has introduced legislatian that would permit the fingerprinting of firefighte�r candidates. CITY POSITIION The City ol,f Saint Paul supports legislation which permits local officials to conduct fingerprinting of firefighter candidates to do background checks on candidates and which allows the, consideration of past felonies in hiring decisions for firefi�ghters.
