VJHEREAS, Department of Fire and S ty Services, Division of Code Enforcement has
requested the Ciry Council to hold public he s to consider the advisability and necessity of
ordering the repair or wrecking and removal of a two-story, wood frame structure located on
property hereinafter refened to as the "Subject Properry" and commonly known as 932 Concordia
Avenue. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey Counry Recorder's Office and
information obtained by Division of Code Enforcement on or before May 7, 1998, the following are
the now known interested or responsible parties for the Subject Propeny: Open Door Baptist
Church, c/o Della Vernell, Unity Baptist Church, 118 Victoria Street North, St. Paul, MN 55104,
Attn: Rev. David Johnson
WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul I.egislative Code an order identified as an"Order to Abate Nuisance
Building(s)" dated June 15, 1998; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested ar responsible parties that they must repair or
demolish the structure located on the Subject Property by 7uly 15, 1998; and
WHEREAS, the enforcement o�cer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Division of Code
Enforcement requested that the City Clerk schedule public hearings before the Legislative Hearing
Officer of the Ciry CouncIl and the Saint Paul Ciry Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul Ciry
Council on Tuesday, October 20, 1998 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the S�bject Property safe and not detrimental to the public peace, health,
safety and welfare and remove its blighting influence on the community by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.

WHEREAS, a hearing was held befare the Saint Paul Ciry Council on Wednesday, October
28, 1998 and the testimony and evidence including the action taken by the L.egislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, ttiat based upon the testimony and evidence presented at the above
referenced public heatings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Properry at 932 Concordia Avenue:
1. That the Subject Property comprises a nuisance condition as defined in 5aint Paul
Legislarive Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Division of Code Enforcement has posted a placard on the Subject Properry
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Department of Fire and Safety
Services, Division of Code Enforcement, VacanUNuisance Buildings.
8. That the lrnown interested parties and owners aze as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternafive by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation ar

2. If the above corrective ac6on is not completed within this period of time the Fire and Safety
Services, Division of Code Enforcement is hereby authorized to take whatever steps aze
necessary to demolish and remove this structure, fill the site and charge the costs incurred
against the Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul
L,egislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the properiy by the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properry as provided by law.
4. It is further ordered, that a copy of.this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L,egislative Code.

recommendauon of the Division of Code Enforcement that the Ciry Council pass a resolution
ordering the responsible parties to either repair, or demolish and remove this building in a
timely manner, and failing that, authorize the Division of Code Enforcement to proceed to
demolition and removal, and to assess the costs incurted against the real estate as a special
assessment to be collected in the same manner as taxes.

Gerry Strathman called the meeting to order at 10:00 a.m.
Summarv Abatement Apneal for 1904 7efferson Avenue. (Laid over from 10-6-98)
Sharon Bougie and het attorney R. Donald Hawkinson appeazed.
Gerry Strathman stated this item was laid over because there were a number of differences as to
what happened. There was not anyone from the cleanup crew present at the previous meeting nor
was there a videotape available. Chuck Votel responded there is a videotape now and members
of the cleanup crew aze here as well.
(A videotape was shown of the property before the cleanup and afterwazds.)
Gerry Strathman asked for the basis of the appeal. R. Donald Hawkinson responded the garage
door was closed before the cleanup crew arrived, the crew wrongfully opened the garage door,
and they did not have a search warrant.
Richard Weiner and Terry O'Rourke, who both worked on the cleanup of this site, appeared.
Gerry Strathman asked was the gazage door open when they arrived. Mr. O'Rourke responded
the door was open about 2 feet, which was enough for him to see inside of it.
G. Donald Hawkinson stated he has two letters from neighbors indicating the garage door was
unlocked. (Mr. Hawkinson presented these letters to Getry Strathman.) One letter was from
Gene Baum and the other was from Lorraine McEvoy, both of 1901 Juliet Avenue. Mr.
Strathman stated neither letter indicates whether the garage door was open or closed.
Sharon Bougie stated the gazage had been broken into. Tt had previously been nailed closed. The
only way to get into the garage was with a garage door opener. After the City crew had taken her
belongings out of the garage, they damaged the opener. Ms. Bougie could not enter her gazage.
She had to open another door which had previously been barred closed in order to gain access.
Gerry Strathman stated there are two issues here: 1) Whether this was a legal or illegal entry into
the property, 2) Was the owner properly notified and did the City crew do the cleanup. The
entry issue cannot be resolved here because this hearing is not a judicial setting. As for the other
issue, paperwork indicates notices were mailed on several occasions. (Chuck Votel presented
copies of notices that were mailed.)

Gerry Strathman recommended denying the appeal citing notice was aiven and the cleanup was
done. Mr. Strathman informed the appeilants that if they disaa eed with his decision, a notice
can be filed with Mr. Sirathman by noon of October 22. This notice wi11 be provided to the
councilmembers for consideration before making their final declsion on this matter at the
October 28 Ciry Council meeting.

Pastor David Johnson, co-pastor of Unity Bapfist Church, appeared.
Chuck Votel reported this building has been vacant since May 6, 1997. The current property
owner is the Open Door Baptist Church. The church has not indicated what they intend to do
with the property. Nineteen summary abatement notices have been issued for nuisance
violations. A citafion has been issued to the owner for failing to pay the vacant building fee. The
real estate ta�ces are unpaid. Ramsey County Talcation has placed an estimated market value on
the property of $45,300. The Code Enforcement officers estimated the cost to repair the structure
is $60,000 to $200,000 depending on the final usage of the building. The cost to demolish is
$9,000 to $10,000.
Pastor David Johnson stated their plan is to demolish the buiiding. The owner is Unity Baptist
Church. Unity Baptist Church is a merged congregation of two former churches named Park
Baptist Church and Open Door Baptist Church. The merger occuned in Februaz'y 1998. The
reason for the difficulty in caring for the building was caused by the transition. The church has
received tentative approval of a loan to demolish the building. The estimated cost of the
demolition is $25,000. Mr. Johnson requested additional time for final approval of the loan and
Co demolish the buIlding.
Gerry Strathman asked about the difference between the church estimate and Code
EnforcemenYs estimate. Chuck Votel responded Code EnforcemenYs estimate is from
demolition contractors, but it does not include asbestos removal nor additional gazbage removal.
Asbestos removal can be thousands of dollars, however the difference between the estimates still
seems high. Pastor David 7ohnson stated his recollection is that the contractor said the cost for
the asbestos abatement would be $16,000. Mr. Strathman stated if the City has a lower bid, the
church should find out the name of that company.
Gerry 5trathman asked how long it will take to get trus building demolished. Pastor David
Johnson responded it is contingent on getting financing. The goal was to have the building
removed before freezing, and that is not faz from now.
Gerry Strathman asked if he grants additional time, can he be assured the property will be kept
clean. Pastor David Johnson responded he cannot promise that. The trash is dumped from other

people. The church does not have the resources nor the people to take caze of the dumping. The
church has contracted with the Thomas Dale Block Club, however they have not been efficient.
Gerry Strathman asked is the structure dangerous. Chuck Votel responded it is constantly open
and orders have to be issued to have it secured, but it is not dangerous.
Gerry Strathman recommended amending the order to remove or repair within 45 days. Pastor
David 7ohnson stated he has no problem with this recommendation.

the owner fails to comply with the order, Code Enforcement is ordered to remove the

Ying Vang and Pang Vang appeazed and stated they purchased the buAding from Tracy Moos on
September 18, 1998. Ying Vang stated they are almost done with repairing the building. Two
family members aze ready to move in after the building is reinspected.
Chuck Votel reported that the building is close to being ready for reinspection. The new owners
have obtained a code compliance inspection; they have plumbing and building pernuts. They
still need to get an electrical permit, and the furnace needs some work before it can be signed off.
Mr. Votel suggested this matter be laid over for a while.
Ying Vang stated he had the fumace tested by St. Paul Plumbing and Heating Company. Pang
Vang stated they have to finish the bathroom floor and the gutters.
Gerry Strathman recommended laying over to the November 17, 19981egislative heazing.

Gerry Strathman called the meeting to order at 10:00 a.m.
Summarv Abatement Apneal for 1904 7efferson Avenue. (Laid over from 10-6-98)
Sharon Bougie and het attorney R. Donald Hawkinson appeazed.
Gerry Strathman stated this item was laid over because there were a number of differences as to
what happened. There was not anyone from the cleanup crew present at the previous meeting nor
was there a videotape available. Chuck Votel responded there is a videotape now and members
of the cleanup crew aze here as well.
(A videotape was shown of the property before the cleanup and afterwazds.)
Gerry Strathman asked for the basis of the appeal. R. Donald Hawkinson responded the garage
door was closed before the cleanup crew arrived, the crew wrongfully opened the garage door,
and they did not have a search warrant.
Richard Weiner and Terry O'Rourke, who both worked on the cleanup of this site, appeared.
Gerry Strathman asked was the gazage door open when they arrived. Mr. O'Rourke responded
the door was open about 2 feet, which was enough for him to see inside of it.
G. Donald Hawkinson stated he has two letters from neighbors indicating the garage door was
unlocked. (Mr. Hawkinson presented these letters to Getry Strathman.) One letter was from
Gene Baum and the other was from Lorraine McEvoy, both of 1901 Juliet Avenue. Mr.
Strathman stated neither letter indicates whether the garage door was open or closed.
Sharon Bougie stated the gazage had been broken into. Tt had previously been nailed closed. The
only way to get into the garage was with a garage door opener. After the City crew had taken her
belongings out of the garage, they damaged the opener. Ms. Bougie could not enter her gazage.
She had to open another door which had previously been barred closed in order to gain access.
Gerry Strathman stated there are two issues here: 1) Whether this was a legal or illegal entry into
the property, 2) Was the owner properly notified and did the City crew do the cleanup. The
entry issue cannot be resolved here because this hearing is not a judicial setting. As for the other
issue, paperwork indicates notices were mailed on several occasions. (Chuck Votel presented
copies of notices that were mailed.)

Gerry Strathman recommended denying the appeal citing notice was aiven and the cleanup was
done. Mr. Strathman informed the appeilants that if they disaa eed with his decision, a notice
can be filed with Mr. Sirathman by noon of October 22. This notice wi11 be provided to the
councilmembers for consideration before making their final declsion on this matter at the
October 28 Ciry Council meeting.

Pastor David Johnson, co-pastor of Unity Bapfist Church, appeared.
Chuck Votel reported this building has been vacant since May 6, 1997. The current property
owner is the Open Door Baptist Church. The church has not indicated what they intend to do
with the property. Nineteen summary abatement notices have been issued for nuisance
violations. A citafion has been issued to the owner for failing to pay the vacant building fee. The
real estate ta�ces are unpaid. Ramsey County Talcation has placed an estimated market value on
the property of $45,300. The Code Enforcement officers estimated the cost to repair the structure
is $60,000 to $200,000 depending on the final usage of the building. The cost to demolish is
$9,000 to $10,000.
Pastor David Johnson stated their plan is to demolish the buiiding. The owner is Unity Baptist
Church. Unity Baptist Church is a merged congregation of two former churches named Park
Baptist Church and Open Door Baptist Church. The merger occuned in Februaz'y 1998. The
reason for the difficulty in caring for the building was caused by the transition. The church has
received tentative approval of a loan to demolish the building. The estimated cost of the
demolition is $25,000. Mr. Johnson requested additional time for final approval of the loan and
Co demolish the buIlding.
Gerry Strathman asked about the difference between the church estimate and Code
EnforcemenYs estimate. Chuck Votel responded Code EnforcemenYs estimate is from
demolition contractors, but it does not include asbestos removal nor additional gazbage removal.
Asbestos removal can be thousands of dollars, however the difference between the estimates still
seems high. Pastor David 7ohnson stated his recollection is that the contractor said the cost for
the asbestos abatement would be $16,000. Mr. Strathman stated if the City has a lower bid, the
church should find out the name of that company.
Gerry 5trathman asked how long it will take to get trus building demolished. Pastor David
Johnson responded it is contingent on getting financing. The goal was to have the building
removed before freezing, and that is not faz from now.
Gerry Strathman asked if he grants additional time, can he be assured the property will be kept
clean. Pastor David Johnson responded he cannot promise that. The trash is dumped from other

people. The church does not have the resources nor the people to take caze of the dumping. The
church has contracted with the Thomas Dale Block Club, however they have not been efficient.
Gerry Strathman asked is the structure dangerous. Chuck Votel responded it is constantly open
and orders have to be issued to have it secured, but it is not dangerous.
Gerry Strathman recommended amending the order to remove or repair within 45 days. Pastor
David 7ohnson stated he has no problem with this recommendation.

the owner fails to comply with the order, Code Enforcement is ordered to remove the
buildina.
Ying Vang and Pang Vang appeazed and stated they purchased the buAding from Tracy Moos on
September 18, 1998. Ying Vang stated they are almost done with repairing the building. Two
family members aze ready to move in after the building is reinspected.
Chuck Votel reported that the building is close to being ready for reinspection. The new owners
have obtained a code compliance inspection; they have plumbing and building pernuts. They
still need to get an electrical permit, and the furnace needs some work before it can be signed off.
Mr. Votel suggested this matter be laid over for a while.
Ying Vang stated he had the fumace tested by St. Paul Plumbing and Heating Company. Pang
Vang stated they have to finish the bathroom floor and the gutters.
Gerry Strathman recommended laying over to the November 17, 19981egislative heazing.

referenced public heatings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Properry at 932 Concordia Avenue:
1. That the Subject Property comprises a nuisance condition as defined in 5aint Paul
Legislarive Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Division of Code Enforcement has posted a placard on the Subject Properry
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Department of Fire and Safety
Services, Division of Code Enforcement, VacanUNuisance Buildings.
8. That the lrnown interested parties and owners aze as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe

prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with

only way to get into the garage was with a garage door opener. After the City crew had taken her
belongings out of the garage, they damaged the opener. Ms. Bougie could not enter her gazage.
She had to open another door which had previously been barred closed in order to gain access.
Gerry Strathman stated there are two issues here: 1) Whether this was a legal or illegal entry into
the property, 2) Was the owner properly notified and did the City crew do the cleanup. The
entry issue cannot be resolved here because this hearing is not a judicial setting. As for the other
issue, paperwork indicates notices were mailed on several occasions. (Chuck Votel presented
copies of notices that were mailed.)

Gerry Strathman recommended denying the appeal citing notice was aiven and the cleanup was
done. Mr. Strathman informed the appeilants that if they disaa eed with his decision, a notice
can be filed with Mr. Sirathman by noon of October 22. This notice wi11 be provided to the
councilmembers for consideration before making their final declsion on this matter at the
October 28 Ciry Council meeting.
Resolution ordering the owner to reuair or remove the building at 932 Concordia Avenue.
If the owner fails to com� with the order. Code Enforcement is ordered to remove the

Pastor David Johnson, co-pastor of Unity Bapfist Church, appeared.
Chuck Votel reported this building has been vacant since May 6, 1997. The current property
owner is the Open Door Baptist Church. The church has not indicated what they intend to do
with the property. Nineteen summary abatement notices have been issued for nuisance
violations. A citafion has been issued to the owner for failing to pay the vacant building fee. The
real estate ta�ces are unpaid. Ramsey County Talcation has placed an estimated market value on
the property of $45,300. The Code Enforcement officers estimated the cost to repair the structure
is $60,000 to $200,000 depending on the final usage of the building. The cost to demolish is
$9,000 to $10,000.
Pastor David Johnson stated their plan is to demolish the buiiding. The owner is Unity Baptist
Church. Unity Baptist Church is a merged congregation of two former churches named Park
Baptist Church and Open Door Baptist Church. The merger occuned in Februaz'y 1998. The
reason for the difficulty in caring for the building was caused by the transition. The church has
received tentative approval of a loan to demolish the building. The estimated cost of the
demolition is $25,000. Mr. Johnson requested additional time for final approval of the loan and
Co demolish the buIlding.
Gerry Strathman asked about the difference between the church estimate and Code
EnforcemenYs estimate. Chuck Votel responded Code EnforcemenYs estimate is from
demolition contractors, but it does not include asbestos removal nor additional gazbage removal.
Asbestos removal can be thousands of dollars, however the difference between the estimates still
seems high. Pastor David 7ohnson stated his recollection is that the contractor said the cost for
the asbestos abatement would be $16,000. Mr. Strathman stated if the City has a lower bid, the
church should find out the name of that company.
Gerry 5trathman asked how long it will take to get trus building demolished. Pastor David
Johnson responded it is contingent on getting financing. The goal was to have the building
removed before freezing, and that is not faz from now.
Gerry Strathman asked if he grants additional time, can he be assured the property will be kept
clean. Pastor David Johnson responded he cannot promise that. The trash is dumped from other

people. The church does not have the resources nor the people to take caze of the dumping. The
church has contracted with the Thomas Dale Block Club, however they have not been efficient.
Gerry Strathman asked is the structure dangerous. Chuck Votel responded it is constantly open
and orders have to be issued to have it secured, but it is not dangerous.
Gerry Strathman recommended amending the order to remove or repair within 45 days. Pastor
David 7ohnson stated he has no problem with this recommendation.

Ying Vang and Pang Vang appeazed and stated they purchased the buAding from Tracy Moos on
September 18, 1998. Ying Vang stated they are almost done with repairing the building. Two
family members aze ready to move in after the building is reinspected.
Chuck Votel reported that the building is close to being ready for reinspection. The new owners
have obtained a code compliance inspection; they have plumbing and building pernuts. They
still need to get an electrical permit, and the furnace needs some work before it can be signed off.
Mr. Votel suggested this matter be laid over for a while.
Ying Vang stated he had the fumace tested by St. Paul Plumbing and Heating Company. Pang
Vang stated they have to finish the bathroom floor and the gutters.
Gerry Strathman recommended laying over to the November 17, 19981egislative heazing.
