WHEREiA.S , the present Chief of the Fire Department of the
City of S�aint Paul has formally given notice to the Mayor of
his intentl, to etire in July of 1989 ; and
WI-�ERE�,S , the method for appointing a new person to the
;�osition af Fire Chief is clearly set forth under Section 12. 12
of thz Sai�t P ul City Charter ; and
WHERE}�S , he �ouncil is aware �that the Chief has not formally
vacated h�s p sition '�ut has given a clear intent to vacate
as of a ce�tai date ; and
WH�,RE1�S , it is the position and intent of this Council
to be pre�are to make an apjoointrnen� to this vacancy as soon
as possib]�e a d to have whateve-r work can be completed prior
to this da�e c mpleted; anc?

WHERE�S , ection 12. 12 of the Saint Paul Charter requires
that c�ual�fic tions for the position be established by the
Council an� th t an examining committee pe established by appoint-
meazt by th� Ci y Council ; and
WHERFI-�S , appointment to such a committee is both made
anc? approved b the Council but such appointment must be made
pursuant t�p t e appointment process in the Saint Paul Admini-
strative Cc1de ; nd
WHEREI�S , the Adminis�ra�ive Code provides that notice
of appointliment to suc� committee must be given at least 45
days beforq an ppointment is so made ; and
WHEREPuS , t is the duty of such a committee to provide
for com;�etiitiv examinations to test the relative fitness of
candidates , th grading of candidates , and the certification

RESOL ED, that the City Council hereby recognizes and
acknowledg s t e notice of resignation submitted to the Mayor
of the Ci�y o Saint Paul by the present Fire Chief indicating
that the ire Chief intends to resign in July of 1989 ; and,

FURTH�R ESOLVED, that the Council hereby requests the
i�tayor to gIive otice of the need for appointment to the examining
committee irequ red under the Charter, said notice to be effective
as of thel dat of passage of this resolution and that pursuant
to the r les of procedure for such appointment this Council
shall not� mak appointment to such committee for at least 45
days afterithe date of such notice ; and, be it
FURTH�R ESOLVED, that the Council recognizes that it
will be t�e d ty of said committee to provide for competitive
examinatio�s o test relative fitness for candidates for the
position c�f F re Chief, the grading of the candidates for Fire
Chief and the certification to the Mayor of the five best quali-
fied candi�late for this position; and, be it
FURTH�t� ESOLVED, that it is the intent of this Council
in an ef�ort to provide for appointment to this vacancy as
soon as p ssi le that this committee be established and advised
of its d�ties as quickly as possible but that it is further
the posit�on of this Council that there would be no listing
nor publi�ati n of the names of any of the candidates until
such time ias t e vacancy is formally and legally declared.

Dear Presid�ent �cheibel and Members of the City Council:
For your inlform tion, attached is a copy of a letter from
Chief Conroly wh ch I received today. The Chief has advised me he
is withdrawing is letter of intent to retire, dated August 22,
1988.
Because of the mbiguity of a specific retirement date, together
with the ti3ning and uncertainty of the Council's determination
regarding the F're Department Relief Association consolidation
� issue, my reco endation is that the Council lay over the council
` resolution sche uled for h�aring on Thursday, January 5, 1989.
Obviously, once a definite date of retirement is known, the
resolution can e brought forward again for consideration by the
City Council.

On December� 30 the Relief Association voted to begin the
process of onsolidation with the Public Employees
Retirement ssociation. If consolidation is in fact
accomplashe there would be very significant changes
to retiremer�t benefits.
In view ,of Ihe potential for pension benefits to change
and the impact such changes would have to my post-
retiremant i come I feel that I owe it to my family and
myself to de ay my decision to retire indefinitely.
Therefore, p ease regard this letter as a withdrawl of
