WHEREAS, the Saint Paul City Council approved on September 23, 1998, the creation of a Multifaceted Pilot
Prevention Progam to Reduce Youth Access To Alcohol, which requires the Office of License, Inspections
and Environmental Protection and the Vice Unit of the Saint Paul Police Department to conduct liquor
compliance checks at each licensed liquor establishment consistent with the attached letter of commitment
from The i3niversity's Project Director, Traci L. Toomey, PhD, and
Wf�REAS, the Universiry of Minnesota has funds available to the City of Saint Paul to conduct compliance
checks as part of the University's study [Complying with the Minimum Drinking Age (CMDA)} of the
effectiveness of such tactics as a tool to limit youth access to alcohol, and
WF�REAS, the funding provided in the amount of $16,500.00 would be used by the Police and LIEP to
conduct checks, purchase product, and compensate underage decoys to be used in the above mentioned liquor
compliance checks, and
WI�REAS, the Mayor, pursuant to Section 10.07.04 of the City Charter, recommends the following changes

The University of Minnesota's Complying with the Minimum Drinking Age (CMDA) Study
would like to formalize plans to study the effectiveness of law enforcement alcohol compliance
checks in Saint Paul. Available anecdotal evidence suggests that compliance checks are an
effective tool in limiting youth access to alcohol. This letter provides details about the support
CNIDA will offer in exchange for your participation. A draft of the compliance check data
collection form that participating agencies must submit to the University of Minnesota is also
included.
CMDA Commitment
♦ With the understanding that the City of Saint Paul wi11 conduct compliance checks at a11
liquor establishments during the first six months of this project, follow-up with
establishments that fail, and conduct another round of compliance checks at all
establishments in the second year, CMllA agrees to provide the City $16,500 each year for a
two-year period. Upon receipt of a letter of intent from the city, the first yearly installment of
$16,500 wi11 be disbursed to the City of Saint Paul.
♦ In addition, CNIDA will psovide pr�labeled data collection forms fox all licensed liquor
establishments.
♦ CMDA will provide staff to assist with training buyers and provide support to LIEP staff as
requested.

City of Saint Paul Commitment
♦ LIEP will provide CMDA with an electronic file containing all licensees in the City of Saint
Paul, including any recards documenting businesses that have participated in training and
received the licensee fee discount (updated annually).
♦ LIEP will provide CMDA with information on when and how licensees aze notified of the
compliance check program, on chargesladministrative sanctions taken and their outcomes.
♦ LIEP will be responsible for conducting compliance checks at all establishments in Year One
with a repeat check for those failing. LIEP will retum completed data collection forms for aZl
compliance checks conducted during Yeaz One no later than the end of the project year
(August 31, 1999).

♦ Upon receipt of the data collection forms from Yeaz One compliance checks, CMDA will
provide the second insCallment of $16,500 (after September 1, 1999). In Year Two, LIEP will
again conduct compliance checks at all establishments and will provide data collection forms
to CMDA by the end of the project yeaz (August 31, 2000).
♦ LIEP wIll be responsible for hiring and paying buyers.
♦ Finally, LIEP will provide a letter of intent to the CMDA agreeing to the terms listed above.
This letter should include verification of the number of licensees in Saint Paul and a request
for payment of $16,500 per yeaz for a two-year period.

WHEREAS, for the past 10 years the City of Saint Paul has consistently enforced its licensing laws, which
prohibit the sale of alcohol to persons under the age of 21, through the imposition of stringent presumptive
civil penalties assessed against licensed liquar establishxnents who fail to check identification and serve
persons under the age of 21, and

11 WHEREAS, the main enforcement tools used by the City's Office of License, Inspections and
12 Environmental Protection (LIEP) and the Saint Paui Police Department to discourage and deter violations of
13 alcohol sales to persons under the age of 21 is alcohol awareness training for license holders and employees,

WI�EREAS, the City's procedures for compliance checks involve the use of under aged "decoys" or youthful
compliance checkers who attempt to purchase alcohol without proper identification, and
WHEREAS, a violation of law is verified when a license holder seils alcohol to a"compliance checker" who
is under the age of 21, without frrst asking for proper identifzcation of age, and
WHEREAS, the Saint Paul Hospitaliry Association and the Minnesota Licensed Beverage Association have
asked the City to address the lazger problem of youth access to alcohol by targeting the other sources that
youth use to obtain alcohol, besides the licensed beverage dealer, and
WHEREAS, there are opportunities for the City to work with interested groups and organizations to expand
the City's efforts to prevent youth access to alcohol, said groups including the University of Minnesota, the
Saint Paul Ramsey Departrnent of Health, and the non-profit organization, Minnesota Join Together, and
others, and
WHEREAS, the City Council desires to respond to these opportunities to expand both the approach and the
methods used to prevent youth access to alcohol to address 1) the youthful offender, 2) individual servers and
sellers of alcohol, 3) the so called social providers, as well as 4) licensed liquor establishments, Now
Therefore, Be It
RESOLVED, that the Council of the City of Saint Paul does hereby establish a multifaceted one year pilot
program to expand efforts to limit the access of youth to alcohol in the City of Saint Paul, said program
described in the attached "Program Outline" which shall be deemed part of this Resolution, and Be It

The University of Minnesota's Complying with the Minimum Drinking Age (CMDA) Study
would like to formalize plans to study the effectiveness of law enforcement alcohol compliance
checks in Saint Paul. Available anecdotal evidence suggests that compliance checks are an
effective tool in limiting youth access to alcohol. This letter provides details about the support
CNIDA will offer in exchange for your participation. A draft of the compliance check data
collection form that participating agencies must submit to the University of Minnesota is also
included.
CMDA Commitment
♦ With the understanding that the City of Saint Paul wi11 conduct compliance checks at a11
liquor establishments during the first six months of this project, follow-up with
establishments that fail, and conduct another round of compliance checks at all
establishments in the second year, CMllA agrees to provide the City $16,500 each year for a
two-year period. Upon receipt of a letter of intent from the city, the first yearly installment of
$16,500 wi11 be disbursed to the City of Saint Paul.
♦ In addition, CNIDA will psovide pr�labeled data collection forms fox all licensed liquor
establishments.
♦ CMDA will provide staff to assist with training buyers and provide support to LIEP staff as
requested.

City of Saint Paul Commitment
♦ LIEP will provide CMDA with an electronic file containing all licensees in the City of Saint
Paul, including any recards documenting businesses that have participated in training and
received the licensee fee discount (updated annually).
♦ LIEP will provide CMDA with information on when and how licensees aze notified of the
compliance check program, on chargesladministrative sanctions taken and their outcomes.
♦ LIEP will be responsible for conducting compliance checks at all establishments in Year One
with a repeat check for those failing. LIEP will retum completed data collection forms for aZl
compliance checks conducted during Yeaz One no later than the end of the project year
(August 31, 1999).

♦ Upon receipt of the data collection forms from Yeaz One compliance checks, CMDA will
provide the second insCallment of $16,500 (after September 1, 1999). In Year Two, LIEP will
again conduct compliance checks at all establishments and will provide data collection forms
to CMDA by the end of the project yeaz (August 31, 2000).
♦ LIEP wIll be responsible for hiring and paying buyers.
♦ Finally, LIEP will provide a letter of intent to the CMDA agreeing to the terms listed above.
This letter should include verification of the number of licensees in Saint Paul and a request
for payment of $16,500 per yeaz for a two-year period.

WHEREAS, for the past 10 years the City of Saint Paul has consistently enforced its licensing laws, which
prohibit the sale of alcohol to persons under the age of 21, through the imposition of stringent presumptive
civil penalties assessed against licensed liquar establishxnents who fail to check identification and serve
persons under the age of 21, and

11 WHEREAS, the main enforcement tools used by the City's Office of License, Inspections and
12 Environmental Protection (LIEP) and the Saint Paui Police Department to discourage and deter violations of
13 alcohol sales to persons under the age of 21 is alcohol awareness training for license holders and employees,

WI�EREAS, the City's procedures for compliance checks involve the use of under aged "decoys" or youthful
compliance checkers who attempt to purchase alcohol without proper identification, and
WHEREAS, a violation of law is verified when a license holder seils alcohol to a"compliance checker" who
is under the age of 21, without frrst asking for proper identifzcation of age, and
WHEREAS, the Saint Paul Hospitaliry Association and the Minnesota Licensed Beverage Association have
asked the City to address the lazger problem of youth access to alcohol by targeting the other sources that
youth use to obtain alcohol, besides the licensed beverage dealer, and
WHEREAS, there are opportunities for the City to work with interested groups and organizations to expand
the City's efforts to prevent youth access to alcohol, said groups including the University of Minnesota, the
Saint Paul Ramsey Departrnent of Health, and the non-profit organization, Minnesota Join Together, and
others, and
WHEREAS, the City Council desires to respond to these opportunities to expand both the approach and the
methods used to prevent youth access to alcohol to address 1) the youthful offender, 2) individual servers and
sellers of alcohol, 3) the so called social providers, as well as 4) licensed liquor establishments, Now
Therefore, Be It
RESOLVED, that the Council of the City of Saint Paul does hereby establish a multifaceted one year pilot
program to expand efforts to limit the access of youth to alcohol in the City of Saint Paul, said program
described in the attached "Program Outline" which shall be deemed part of this Resolution, and Be It

WHEREAS, the Saint Paul City Council approved on September 23, 1998, the creation of a Multifaceted Pilot
Prevention Progam to Reduce Youth Access To Alcohol, which requires the Office of License, Inspections
and Environmental Protection and the Vice Unit of the Saint Paul Police Department to conduct liquor
compliance checks at each licensed liquor establishment consistent with the attached letter of commitment
from The i3niversity's Project Director, Traci L. Toomey, PhD, and
Wf�REAS, the Universiry of Minnesota has funds available to the City of Saint Paul to conduct compliance
checks as part of the University's study [Complying with the Minimum Drinking Age (CMDA)} of the
effectiveness of such tactics as a tool to limit youth access to alcohol, and
WF�REAS, the funding provided in the amount of $16,500.00 would be used by the Police and LIEP to
conduct checks, purchase product, and compensate underage decoys to be used in the above mentioned liquor
compliance checks, and

The University of Minnesota's Complying with the Minimum Drinking Age (CMDA) Study
would like to formalize plans to study the effectiveness of law enforcement alcohol compliance
checks in Saint Paul. Available anecdotal evidence suggests that compliance checks are an
effective tool in limiting youth access to alcohol. This letter provides details about the support
CNIDA will offer in exchange for your participation. A draft of the compliance check data
collection form that participating agencies must submit to the University of Minnesota is also
included.
CMDA Commitment
♦ With the understanding that the City of Saint Paul wi11 conduct compliance checks at a11
liquor establishments during the first six months of this project, follow-up with
establishments that fail, and conduct another round of compliance checks at all
establishments in the second year, CMllA agrees to provide the City $16,500 each year for a
two-year period. Upon receipt of a letter of intent from the city, the first yearly installment of
$16,500 wi11 be disbursed to the City of Saint Paul.
♦ In addition, CNIDA will psovide pr�labeled data collection forms fox all licensed liquor
establishments.
♦ CMDA will provide staff to assist with training buyers and provide support to LIEP staff as
requested.

City of Saint Paul Commitment
♦ LIEP will provide CMDA with an electronic file containing all licensees in the City of Saint
Paul, including any recards documenting businesses that have participated in training and
received the licensee fee discount (updated annually).
♦ LIEP will provide CMDA with information on when and how licensees aze notified of the
compliance check program, on chargesladministrative sanctions taken and their outcomes.
♦ LIEP will be responsible for conducting compliance checks at all establishments in Year One
with a repeat check for those failing. LIEP will retum completed data collection forms for aZl
compliance checks conducted during Yeaz One no later than the end of the project year
(August 31, 1999).

♦ Upon receipt of the data collection forms from Yeaz One compliance checks, CMDA will
provide the second insCallment of $16,500 (after September 1, 1999). In Year Two, LIEP will
again conduct compliance checks at all establishments and will provide data collection forms
to CMDA by the end of the project yeaz (August 31, 2000).
♦ LIEP wIll be responsible for hiring and paying buyers.
♦ Finally, LIEP will provide a letter of intent to the CMDA agreeing to the terms listed above.
This letter should include verification of the number of licensees in Saint Paul and a request
for payment of $16,500 per yeaz for a two-year period.

WHEREAS, for the past 10 years the City of Saint Paul has consistently enforced its licensing laws, which
prohibit the sale of alcohol to persons under the age of 21, through the imposition of stringent presumptive
civil penalties assessed against licensed liquar establishxnents who fail to check identification and serve
persons under the age of 21, and

11 WHEREAS, the main enforcement tools used by the City's Office of License, Inspections and
12 Environmental Protection (LIEP) and the Saint Paui Police Department to discourage and deter violations of
13 alcohol sales to persons under the age of 21 is alcohol awareness training for license holders and employees,
14 and the use of unannounced compliance checks, and

WI�EREAS, the City's procedures for compliance checks involve the use of under aged "decoys" or youthful
compliance checkers who attempt to purchase alcohol without proper identification, and
WHEREAS, a violation of law is verified when a license holder seils alcohol to a"compliance checker" who
is under the age of 21, without frrst asking for proper identifzcation of age, and
WHEREAS, the Saint Paul Hospitaliry Association and the Minnesota Licensed Beverage Association have
asked the City to address the lazger problem of youth access to alcohol by targeting the other sources that
youth use to obtain alcohol, besides the licensed beverage dealer, and
WHEREAS, there are opportunities for the City to work with interested groups and organizations to expand
the City's efforts to prevent youth access to alcohol, said groups including the University of Minnesota, the
Saint Paul Ramsey Departrnent of Health, and the non-profit organization, Minnesota Join Together, and
others, and
WHEREAS, the City Council desires to respond to these opportunities to expand both the approach and the
methods used to prevent youth access to alcohol to address 1) the youthful offender, 2) individual servers and
sellers of alcohol, 3) the so called social providers, as well as 4) licensed liquor establishments, Now
Therefore, Be It
RESOLVED, that the Council of the City of Saint Paul does hereby establish a multifaceted one year pilot
program to expand efforts to limit the access of youth to alcohol in the City of Saint Paul, said program
described in the attached "Program Outline" which shall be deemed part of this Resolution, and Be It
