RESOLUTION

WHEREAS, Section 5.02 of the Charter of the City of Saint Paul
and Section 3 .04 of the Saint Paul Administrative Code authorize
the City Council, upon request of the City Attorney, to appoint
special counsel and provide . compensation therefor in cases of
conflict of �nterest or of special and unusual circumstances; and
WHEREAS� Saint Paul police officers Carolen Bailey, Cheryl
Indehar and Richard Simmons were party defendants in a lawsuit
brought aga�nst the City by former license inspector Joseph
Carchedi; and
WHEREAS, Officers Bailey, Indehar and Simmons each consulted
with private counsel prior to the City's appointment of special
outside counsel for them; and
WHEREAS, although Saint Paul Administrative Code Chapter
A-10 requires prior written approval and appointment of outside
counsel upon request of the City Attorney,. the City Attorney has
determined that given the unique circumstances of this litigation,
the officers acted in good faith; and
WHEREAS, the Council of the City of Saint Paul accepts and
approves thi�s finding by the City Attorney and in this instance
only, hereby finds that Saint Paul Administrative Code Chapter
A-10 shall not control; now, therefore, be it
RESOLVED, that by virtue of the above recitations and upon
recommendation of the City Attorney, the Council hereby approves
payment of attorneys fees in the following amounts:
