WHEREAS , the Northwestern Bell Telephone Company of Iowa
requires a utility easement on, under , and across the following
described land.
Commencing at the southwest corner of Lot five (5)
of Stryker ' s Addition, thence East, along the
south line of said Stryker ' s Addition, a distance
of 53. 30 feet to the actual point of beginning of
the easement to be described , thence continue East
along said south line a distance of 8. �10 feet;
thence North, at right angles , a distance of
8. �10 feet; thence West, parallel with said south
line of said Stryker ' s Addition, a distance of 8. P10 feet;
thence South, at right angles, a distance of 8. 00 feet
to the point of beginning and there terminating .
WHEREAS , the Department of Community Services , Division of
Parks and Recreation has reviewed and approved the request for
this easement; and,
WHEREAS , the compensation for this easement has been set at
$300. 41�. Said compensation shall be deposited in Fund No. 325--
231PJ2.
THEREFORE BE IT RESOLVED, that the Council of the City of
Saint Paul hereby approves the easement request and authorizes
the proper City officials to execute and convey to Northwestern
Bell Tele�phone Company a utility easement which is attached
hereto and incorporated herein.

Attached plea�se find correspondence from Evergreen Land Services Co. on
behalf of NoNthwestern Bell Telephone Co. , concerning an easement for
communicatior�s equipment at the Margaret Recreation Center site.
The Division ;has reviewed this request and recommends approval . We have
discussed th� proposal with Evergreen to determine whether or not an
easement is r�eally needed--we could authorize this under the City's utility
permit procedures--but the company requires an easement.
Therefore, we request that your office review the documents, obtain
additional iriformation from Evergreen if needed, and prepare and process
the necessaryt City Council Resolution and then the agreement. Payment for
the easement should be deposited to Fund 325-23102.

KNOW ALL MEN BY THESE PRESENTS , that the undersigned ,
hereinafter referred to as ��Grantor , �� in consideration of the sum of
One Dollar and other good and valuable consideration , receipt whereof
is hereby acknowledged , hereby grants and conveys to Northwestern
Bell Telephone Company, an Iowa Corporation , hereinafter referred to
as "Grantee , �� its successors and assigns , a right-of-way and easement
to excavate for , construct , operate , inspect , maintain , repair ,
alter , add to, or remove a communications system consisting of an
above-ground cross-connect cabznet , buried cables and facilities
related and appurtenant thereto on , under and through part of the
following descrXbed parcel or tract of land situated in the County of
Ramsey , , State of Minnesota , to-wit :
Lot Four (4) of Stryker � s Addition to the City of St . Paul ,
according to the recorded plat thereof on file and of record in
the office of the Register of Deeds in and for Ramsey County,
Minnesota .
Except for the right of access , Grantee ' s easement shall be
confined to an eight (8) foot by eight (8) foot area
described as follows , to-wit :
Commencing at the southwest cort�er of Lot five ( 5) of said
Stryker ' s Addition , thence East , along the south line of
said StrylCer ' s Addition , a distance of 53 . 30 feet to the
actual poi,'nt of beginning of the easement to be described ,
thenc� continue East along said south line a distance of
8 .00 feet ; thence North, at right angles , a distance of
8 .00 feet ; thence West , parallel with said south line of
Stryker ' s Addition , a distance of 8 .00 feet ; thence South,
at right �ngles , a distance of 8 . 00 feet to the point of
beginning and there terminating .
together with the right of access to Grantee upon the above premises
for the purposes above set forth .
The Grantee sh�ll , after the installation of the above-described
communications facility or after the exercise of any rights granted
herein , restor� the lands subject to this easement to as near their
original condi!tion as is reasonably possible .
The Grantor , its successors or assigns , hereby covenants that no
structure will be erected or permitted on said easement and that it
will not ahang�e the ground elevation thereof or perform any act which
will interfere with or endanger said communications facility .
Grantor covenants with Gracitee , its successors and assigns , that
Grantor is the owner of he above-described premises and has the right
to sell and canvey an easement in the manner and form aforesaid .
This instrumer�t and the covenants and agreements contained herein are
binding upon the Grantor , its personal representatives , heirs ,
su�cessor� Ur.3 as�ig3is .
