WIIEREAS, Saint Paul Legislative Code § 410.03(g) prohibits the issuance of a ficense
for on-sale nonintoxicating malt liquors for any premises located within three hundred feet from
any public or pazochial school, church or synagogue, except a restaurant with an on-sale wine or
intoxicating malt liquor license; and
11 WHEREAS, the Code permits the City Council to disregard the distance provision upon
12 "written petition signed on behalf of the school, church or synagogue located within three

WHEREAS, the O�ce of License, Inspections and Environmental Protection has
received a letter from the Reverend James Burns of St. Francis Church, as well as from William
S. Fa11on, Chancellor, Archdiocese of Saint Paul and Minneapolis, supporting the request for the
3.2 malt license; now, therefore, be it
RESOLVED, that the provision of Saint Paul Legislative Code §410.03(g) prohibiting
issuance of a license within 300 feet of a charch shall be waived for the purposes of the license
application by St. Francis de Sales Church for 426 Osceola.
