Paul Ff�e Rrevention regarding: OEADBOLT LOCK REQUIREMENTS, wherein, th� request was made that the board grant a blanket exemption for the requirement of deadboit locks on all doors for certain occupancies, such as convents, supervised living facilities and shelters that house runaway or problem teens, physically or mentally handicapped adults, or others that by nature of the sevices provided, require the staff access to the room withou�t a key for the safety of the occupants. Fire Prevention would submit a list and description of the occupancy each manth at the Board meeting. They would meet the foliowing criteria: T 1 �yo:?��..� 1 . Th� safety of the occupant is not compromised by eliminating the deadbolt. 2. Elimination of the deadbolt is essential to the nature of the life style in the occupancy. 3. Stc�ff or responsibie adults are on the premises 24 hours to assure the privacy and safety of the occupant. BOARD ACTI0�1 Motion made by Wifliam Tilton to grant the Fire Marshall the power to exempt the requirement of deadbolt locks for certain occupancies, according to the criteria of the ietter dated Septemi�er 13 , 1990. (Letter attached to the minutes) Seconded by Ron Ankeny. MOTION CARRIED UNANIMOUSLY. Joan Pearson made the motion to grant a variance on the deadbolts for the properties at 1778 Rome Ave, 1706 University Ave. and 1540 Lincoln Ave. , these are group homes and fall under the criteria of the requirements needed. PMA Limited Partnership (Vacant bidg) Brian Nelson APPEARANCE : Brian Nelson 8 Jim Masterman SUBJECT: Appeilant is requesting a waiver of the vacant building fee in the amount of $ 1 ,660. 00 . PROCEEDINGSs The Appellant stated that the Partnership is insolvent. It has been For Sale for some years. There is the risk of losing the property. Taxes are in arrears. Steve Roy, from the Division of Public Health informed the Board that the buiiding has been unoccupied and vacant since 1986. There has b�en an on going problem with glass falling out on the side walk, pigeon infestation, and there has been complaints about youngsters or adults getting into the" building. The appellant was notified to correct these items, they were not done, the City had to incur expenses by hiring a contractor to correct these problems. PROCEEDINGS: The appellant stated that the fence that had t�een installed w�js approved by the Heritage Preservation. The City came to inspect the fence and informed Mr . Carr that the fence was to high. Mr . Carr removed the lattice from the top to bring the fence height into code comptiance. Mr. Carr would like a variance to ,put the lattice work back on the top ofi the fence. Dorathy Hosking, a neighbor stated that. she opposed the height of the fence. She feels the fence is ugly. Chairman Glassman informed the board that there had been a petition circulated and signed by neighbors in favor of the fence. Mr. Amey sent a letter to the board, to inform them. that there were no bui )ding code implications from the Baard' s approval or disapproval of the fence. Mr. Amey informed the board that building per�nits were required subject to the boards findings. BOARD ACTION': Motion made by Ron Ankeny to deny the request for a variance on the fence height. ' Chairman Glassman informed the board that he received a letter from Richard Amey Supervisor of Inspections, stating that there will be no building code implications i=rom the Board's approval or disapproval on the fence being installed. Mr. Amey informed the Board that building permits are required subject to the findings of the board. Owens ' ( 1 unit) SUBJECT: Appellant is reyuesting a variance on Item #5 - Remove and rewire illegal convenience outlet circuits to code. Letter dated August 3 , 1990. PROCEEDINGS: ' The appellant is requesting some additional time to bring the electrical service up to code. The building is currently va�ant. Harold Robin�on, an inspector from the Division of Public Health stated that the City's position is, that if, a building is vacant the owner can take atl the time needed to bring the building into code compiiat�ce, as long as no one lives in the building. The appellant has the place rented and the new tenants are scheduled to move in by the 15th of October. The work will not be done, therefore the appellant needs the extension to time. G 4 �y����i� Mr. Robinson stated that the house has 30 amp service. Permits will have to be taken out. It must be inspected by an Electrical Inspector upon completion. APPEARANCE : Micnacl Cox Pat Fish, from the Department of Fire and Safety stated tt�at the residents ot Riley Row had met with Ms. Fish to discuss the issue of an alternative egress . She understood tnat the owners of the building were going to install a stairway from the back of the building, from the third floor, down on the roof of the second floor of the building. Michael Cox stated that would be a problem, because of the size of the land behind the townhouses to construct a proper stairway. Mr. Cox had someone demonstrate the "Jomy" ladder that they were considering using as a second exit. The iadder would be fastened to the wall , it is operated by pulling a handle to release ladder, which has a quard rail attached to it. Pat Fish, stated that the Fire Department has reviewed the "Jomy" ladder, at the request of the dealer. Ms. Fish stated that there are a couple of assumptions being made here, which are, the person on the third floor must always be mentally and physical capable of operating the ladder , and also, will the ladders always be in, working condition. Building department wili not issue a permit for a ladder. Michael Cox Stated that the building has an Alarm System which is inter-connected. Our experience has been that because of the nature of certain occupancies, deadbolt locks are counter-productive to the life style of residents there, such as , in convents, supervised living facilities, and shelters that house runaway or problem teens, physically or mentally nandicapped aduits, or otners tnat by nature of tne service provided there require that staff access the room without a key for the safety of the occupant. We request that the Board grant a blanket exemption for this type of occupancy so to expedite the inspection process and spare the care-givers the expense and time to file an appeal . Fire Prevention could submit a list and d�scription of these addresses 'with a brief description of the occupancy each month at the Board meeting. They would meet the following criteria: l.
