WHEREAS, the Division of Public Health has requested the City Council to
hold public hearir�gs to consider the advisability and necessity of the repair or
wrecking and remo�fial of a two story, partly boarded, single family, wood frame,
deteriorated aban�oned house located on property hereafter referred to as the
"Subject Property"' and commonly known as 874 Marion Street. This Abstract
property is legally described as:
Lots 27 and 28 in Block 12 of Blocks 7, 8, 9, 10, 11, 12, 13, 14 and
15, Lewis' (2) Addition to St. Paul, according to the recorded plat
thereof, and situate in Ramsey County, Minnesota
WHEREAS, based upon the records in the Ramsey County Recorder's Office on
July 25, 1990 and other information available to the Division of Public Health
on or before October 9, 1990, the following persons are owners, interested and/or
responsible parties of the Subject Property: Thomas S. Muraski, 2840 Chowen
Avenue South, Minneapolis, MN 55416-4397; Twin City Federal Savings, Attn:
Foreclosure Depar�tment, 801 Marquette Avenue, Minneapolis, MN 55402; Mildred
Blank, 1431 40th �venue NE, St. Petersburo, Florida 33703.
The address�s of the above noted persons were obtained from various sources
including the taxlrecords, phone books, mortgage companies, etc. ; and
WHEREAS, th� Division of Public Health has issued an order identified as
an "Abandoned Bu'�lding Notice" dated July 26, 1990 which is attached and
incorporated as p rt of this Resolution by this reference. This ordPr was served
in accordance wit� the provisions of Chapter 45 of the Saint Paul Legislative
Code on all owners, interested. andJor responsible parties of the Subject Property
then known to the enforcement officer. The notice and order informed these
parties that the two story, partly boarded, single family, wood frame,
deteriorated house located on the Subject Property is an abandoned building and
a nuisance pursuant to Sections 45.01 , Subd. 1 and 45.02, Subd. 11 of the Saint
Paul Legislative Code. The July 26, 1990 order also had attached to it a list
of deficiencies regarding the house on the Subject Property, said list is
attached and incorporated as part of this resolution; and
WHEREA�S, the July 26, 1990 order informed all then known owners, interested
parties and respo �nsible parties that they must either repair the structure on the
Subject Property by correcting the list of deficiencies or demolish the
structure, either action to take place by August 26, 1990;
WHEREAS, na action has been taken regarding compliance with the July 26,
1990 notice and olyder, and as a result the Division of Public Health requested
that a public heairing be scheduled to take place on December 10, 1990 before the
Neighborhood Services Committee of the Saint Paul City Council to prepare a
recommendation to be reviewed and decided on December 11, 1990 by the Saint Paul
City Council in �considering the advisability and necessity of ordering the
correction of the nuisance condition or, in the alternative, to consider the
demolition and removal of this structure; and

WHEREAS, thP above referenced owners, interested and/or responsible parties
have been served notice of the tirne, place and pLirpose of the public hearings
before the Neighborhood Services Committee of the City of Saint Paul City Council
on December 10, 1990 and the Saint Paul City Council on December 11 , 1990 in
accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code;
and
WHEREAS, a hearing was held before the Neighborhood Servic�s Comrnittee of
the Saint Paul City Council on December 10, 1990 and all testimony and evidence
was considered by the cornmit.tee; ar�d
WHEREAS, the Neighborhood Services Committee after receiving testimony �nd
evidence, made the recommendation to approve a request by the Division of Pu.blic
Health to ord_er the above referenced owners, intereste� p�rties and responsible
parties and their assibns to make the Subject Property safe and not detrimentat
to the public p�eace, health, safety and welfare and. remove its bli;hting
influence on the omrr�unity by rehahilitatino this structure and correctino those
deficiencies set forth in the list previously referenced in accordance with all
applicable codes and ordinances, or in the alternative by demolishing the
structurP and filling the site in accordance with all applicable codes and
ordinances, Thejrehabilitation or demolition of the structure to be completed
within thirty t3Q} days of the date of mailino of this resolution; and
WHEREAS, a hearing was held befoie the Saint Paul City Council on December
11 ,1990 and all testimony and evidence includino the action taken by the
Neighborhood Services Committee was con�iderPd by the Cottncil; and.
NOW THEREFORE, BE IT RESOLVED, that based upon all of the testimony and
evidence presented. at the December 11 , 19'�0 hearing, the Saint Paul City Council
hereby adopts the followino Findings and Order concPrning the house at $74 Marion
Sr reet:
1 . That in M�y of 1�87 the house located on th? Subject Property was
deterrnined to be unoccupied. The hou.se has remained vacant and has
been either open to access or board_ed since July of 198r'.
2. Thatlsince July of 198; the City of Saint Paul has on several
occa�ions issued ord.ers to the owners to rnake this houce secure �nd
not �ccessible. On three occasions, because of the inaction on thc�
partlof the ownerc, the City has had. to hire a private cont.r�.ctor to
makelthe house secure.
3. That the owners of the Subject Property have repeated_ly failed to
reoi�ter and pay the vac�nt building fee for this structure as
required by Chapter 43 of the Saint Paul Leoislative Code.
4. That there are now and have been since Ju.ly of 1987 multiple
exterior Housing Code or Building Code violations in existence at
the Subject Propertv,
5 . That the owners, interested. parties and responsible parties of this
hous� are as previously stated in this resolution. These�
individuals have been properly served. notice of the Decernber 11 ,
1990 hearinG concerning this house.

2. If the above corrective action is not completed within the thirty
{30) day time period, the proper City officials of the City of Saint
Paul are hereby authorized to take whatever steps are necessary to
demolish this structure and fill the site and charge the costs
incurred against the Subject Property pursuant to the provisions of
Section 45.Q�8 of the Saint Paul Legislative Code.
3. In the event the building is to be demolished by the City of Saint
Paul, all personal property or fixtures of any kind which shall
unreasonably interfere with the demolition and removal shall be
removed from the building by the owners, interested parties and
responsible parties by the end of the thirty (30) day time period.
If the personal property is not so removed, the City of Saint Paul
shall remove and dispose of such property and fixtures as is
provid.ed by law.
4. IT IS FURTHER ORDERED, that a certified copy of this resolution and
the incorporated Order and list of deficiencies be mailed to the
last known address of the owners, interested parties and responsible
part;ies pursuant to Section 45 .11, Subdivision {5? of the Saint. Paui
Legi�lative Code.

On July 26, 199,�0 the Division of Public Health mailed. an order to the then
known owner-s, interested parties and responsible paities of this bu.ilding

Inasrnuch as the orders h�.ve i�ot been completed_ to the satisfactioz� of this
Division and the continued abandoned condition of the buildii�o contributes a
blighting influence and potential hazard to the neighborhood, it is the
recomrnendation of this Division that thp City Council pass a resolution
ordering the ow'ners, intei�ested and/or responsible parties to either repair or
demolish the buildino in a timely rr�anz�er to the satisfaction of the City.
In the event thi� owners, int.erested. and/or re�ponsible parties fail to comply
with the Council Resolution, the Division of Public Health should be
