2 WHEREAS, the City of Saint Paul, on October 13, 1498, received a Nofice of Tax
3 Liability from the State of Minnesota stafing that ALEE, INC., d/b{a the Bourbon Baz, owes
4 delinquent taxes to the State of Minnesota; and
5
6 WHEREAS, ALEE, INC., d/b/a the Bourbon Baz, 691 Dale 5treet, holds the following
7 licenses at that location: Restaurant (C); Liquor On-Sale - Sunday; Entertainment (A);
8 CigaretteiTobacco; and Liquor On-Sale(C); and

WI3EREAS, Minn. Stat. §270.72, subd. 1(1994) requires the revocation of any license
for the conduct of a profession, occupation, trade or business held by an applicant who owes
more than $500 or more in delinquent taxes or has not filed returns; and
WHEREAS, under said statute the State of Minnesota must notify the applicant of the
intent to require revocation of such license, and of their right to a hearing; and
WHEREAS, a hearing under this statute is expressly provided to be in lieu of any other
hearings or other proceedings required by law, which would include the heazing provisions of
Saint Paul Legislative Code §310.05; and
WHEREAS, the City has agreed with the Department of Revenue that the definition of
"revoke" as used in the statute is proceduraily the same as the process used by the City of Saint
Paul for a license suspension; and
WFIEREAS, the license suspension must be implemented within thirty (30) days of
receipt of the Notice of Ta�c Liability, and is in effect until the Commissioner issues a tax
clearance certificate; and
WHEREAS, no ta�c clearance certificate has been forwarded to the City of Saint Paul,
Office of LIEP, by either the applicant or the Commissioner of the Minnesota Department of
Revenue; now, therefore, be it

RESOLVED, that the licenses held by ALEE, INC., d/b/a the Bourbon Bar, 691 Dale �� +� !`
Street, be and hereby aze suspended effective the 12:01 a.m. on the Wednesday following the
adoption of this Resolution, and will not be reinstated unril such time as the City of Saint Paul
has received a tas clearance certificate from the Commissioner of the Miruiesota Department of
Revenue, and has given written nouce to the licensee of the lifting of this suspension.
