Whereas, the City, Jercy's Macket and North Eas[ Neighborhood Deve]opment Corporation aze sponsoring a Back to the
50's/HalloweenBonfire which will include refreshments, music and a ceremony celebrating the continued redevelopment of the
East Side, now therefore, be it
Resolved, the Council of the City of Saint Paul hezeby accept the generous contribudon of Jerry's Market, North East
Neiehborhood Development Corporafion and any other private sector contributions in defraying the cost of the ceLebration and
appropriates their contributions to that purpose, and;
F�rther Resolved, the City Council declazes this event a public p�rpose whezeby city employees and officials aze allowed to accept
invitations to this gala event in celebration of East Side redevelopment, and;
Further Resolved, the Council of the City of Saint Paul hereby agrees to defend, indemnify and hold Jerry's Mazket, Phalen
Shopping Center and North East Neighborhood Development Corporauon harmless from any and all damages it may be required m
pay as a result of suits, claims, actions or judgements arising through participation in the above described event, and,
Further Resolved, the foregoing defense and indemnification does not cover:
1) Casualty, loss or property to the named partie's property or damage to cars pazked in the lot.
2) Any occurrences or events which are not part of the event and which do not occur or take place at the par6e's premises
dunng [he event.
3)Injuries or damages which arise from hidden traps or conditions existing on the grounds or property of the parties of
which they had actual or constructive notice.
4) In}uries which arise ont of criminal acrion, assaults, batteries or other acts of violence committed by any p�son or
persons.
Finally Resolved, that nothing in the foregoing shall be construed as a waiver of the municipal ron liability ]imits set forth in
Minnesota Statute 466.01 et s�
