At the Publid Works Committee meeting on January 30, 1991,the committee voted
to amend agemda it�ms 7 and 8, the resolutions authorizing quit claim deeds to I.S.D.625
for certain paucels c�n the condition that if the parcels were not used for school purposes,
tide would rev�ert baick to the City. I had previously advised the committee about the legal
problems associated with this. We left it that I would provide you language to be placed
in the resolutions amd deeds.
To accomplish the intent of the council I recommend that the following language be
placed in the f rst p�ragraph of each resolution between the words "conveying title" and the
words "of the Rams�y School site",or "of the Hazel Park School site" as the case may be.

The same lamguage should be placed in the quit claim deeds after the language of
conveyance. This language creates a determinable fee, which means that the property
would automaCically 'revert to the city without the city taking any action upon the happening
of the limitati�n. S�ee Consolidated School District No. 102 v. Walter, 243 Minn. 159, 66
I�.W.2d 881 (X954), and Minn. Stat. SOlA.04(5) (1990).
