WHEREAS, an Ordinan�e, Council Fie No. 90-��/37 granting permission to Greg Ekbom� owner of
the Day By Day C�fe. ati 477 West Seventh Street, Saint Paul, Minnesota, to construct, operate, and
maintain a stairwa� whic�h extends into the Goodrich Avenue right-of-way, has been prepared and
introduced to the �ounc�l of the City of Saint Paul, and will be adopted�ea- a.bo�1���h. ►o� 1�R�
to be effective eventuall�r.�a��-fi Fe.b, ��,�aa � ; and
WHEREAS, Greg Ekbo has agreed to commence construction entirely at his own risk, following
the approval of this reso ution and the issuance of all required permits; and
WHEREAS. Greg �kbo has agreed to the removal of the stairway and complete restoration of the
right-of-way to the �atisf ction of the Director of Public Works, in the event the said Ordinance fails to be
approved by the Cpuncil of the City of Saint Paul;
NOW THEREFOR�, BEII IT RESOLVED, that, pending the�said Ordinance becoming effective,the-
Director of the Deplartmelnt of Public Works is hereby authorized and directed to issue a permit to
Greg Ekbom, owner of ttne Day By Day Cafe, at 477 West Seventh Street, Saint Paul, Minnesota
for the constructiorl, operation, and maintenance of said stairway extending into the Goodrich Avenue
right-of=way, subje�t to tMe same conditions and requirements as set out in the Ordinance, Council File
No. 90-:�;( 3� � pending before the Council of the City of Saint Paul, informal approval of said
construction, peration �nd maintenance being hereby granted in anticipation of the final adoption and
approval of said O�rdinarnce.
