CITY OF AINT PAUL, MINNESOTA R � Presented By C� � �� a < Referred To ' --v Committee: Date /� -� � `�� 1 'i A RESOLUTION APPROVING � 2 I PARTICIPATION IN AND APPROPRIATING 3 FUIVDS 1�OR A JOINT STUDY ON SET-A-SIDE PROGRAMMING 4 5 6 7 WHEREAS, the City of Saint Paul has a long history of policies intended to oppose and dismantle 8 discrimination based on ace, color, religion, sex, and national origin, and disability; and 9 � 10 WHEREAS, amonjg thos�e policies was a long standing ordinance requiring that a portion of City 11 contracting awards'be seit aside for businesses owned by minorities, women, and disabled persons; 12 and ' 13 14 WHEREAS, set aside p�ograms are both an effective and appropriate means of redressing past 15 discrimination, both pub�ic and private; and 16 17 WHEREAS, the U.S. Su�preme Court has, in the case of Ci�y of Richmond vs. Croson, 109 S.C. 706 18 (1989), struck dowii a m�nicipal set aside program, and has established a daunting evidentiary 19 burden for state aMd loc�l jurisdictions who desire to adopt such programs; and 20 21 WHEREAS, the City of Saint PauPs set-a-side program has been suspended as a result of this 22 decision; and 23 24 WHEREAS, the S�tate o� Minnesota as a jurisdiction, undertook evidentiary hearings to establish 25 the legal basis for restorf ng the State Set Aside Program and adopted appropriate state law in 26 compliance with tHe U.S. Supreme Court decision; and 27 28 WHEREAS, the �"ity of Saint Paul has initiated the process for a similar study involving a 29 consortium of juri�dictions including also the City of Minneapolis, Hennepin and Ramsey Counties, 30 and the School Di�tricts�,of Minneapolis and St. Paul. The cost of the overall study will be 31 approximately $30�,000 with each jurisdiction paying one sixth of the cost, or $50,000 each; and 32 33 WHEREAS, a co�missi�on will be appointed composed of two representatives from each 34 participating juris iction which will select a consultant, oversee the restoration study, and the civil 35 ri�hts staffs of eac juri9diction will provide staff support; and t h e x u m a n R i g h t s D e p a r t me n t 36 W111 serve as eadjstaff for, correlate the i7rvaivement of other city office� 3� for the City o St; Paul , 38 � 39 ' 40 � 41 42 43 ' 44 45 � , . ,` . . .
